A RESOLUTION OF Ti -IE CITY COUNCIL OF THE
CITY OF ANAE IM GRATING VARIANCE NO. 1941.
WHEREAS, the City Planning Commission of the City of
Anaheim aid receive a petition for zoning variance from
S. I. R. DEVELOPMENT CO., INC., owner of certain real property
situated in the City of Anaheim, County of Orange, State of
California, described as follows:
That portion of the Northwest Quarter of Section 20,
Township 4 South, Range 10 West, in the Rancho Los
Coyotes, in the City of Anaheim, County of Orange,
State of California, as said section is shown on a
Map recorded in Book 51, page 10 of Miscellaneous
Maps, records of Orange County, California, and as
shown on a Map filed in Book 75, page 3 of Records
of Surveys on file in the Office of the County Re-
corder of Orange County, California, described as
follows:
Beginning at a point in the West line of said North-
west Quarter, said point being distant N 0° 28' 23"
W 10.00 feet from the Southwest corner of that certain
14.46 acre parcel of land described in Deed to Lucy
Frances Ball recorded in Book 32, page 63 of Deeds,
said point also being distant S 0° 28' 23" E 943.07
feet from the Northwest corner of said Section 20
thence 3 89° 05' 03" L parallel with the South line
of said 14.46 acre parcel 780.68 feet to an angle
point in the boundary line of that certain parcel of
land shown as Stehly Poultry Farms on said map filed
in Book 75, page 3 of Record of Surveys; thence
S 0° 20' 08" E along the Southerly prolongation of
tnat certain course in said last mentioned boundary
line as "S 0° 20' 08" E" a distance of 10.18 feet to
a point in the Southerly line of said parcel shown
as "Stehly Poultry Farm" thence N 89° 05' 03" E
along said last mentioned. Southerly line 552.40 feet
to a point in the Westerly line of the Kellogg Home-
stead Tract, as shown on said Hap filed in Book 75,
page 3 of Records of Surveys thence S 0° 25' 42" E
along said last mentioned Westerly line 375.08 feet
to the Southwest corner of said Kellogg Homestead
Tract, said corner being marked by a one -inch iron
pipe, as shown on said Map filed: in Book 75, page 3
of Record of Surveys; thence N 87° 11' 14' E along
the Southerly line of said Kellogg Homestead Tract
1.51 feet to a point in the West line of the North-
east Quarter of said Northwest Quarter of Section 20,
Township 4 South, Range 10 ;pest; thence S 0° 17' 56"
East along said last mentioned West line 895.68 feet
to a point in the Easterly prolongation of the North-
erly line of Tract No. 2013 as shown on a Map recorded;
in Book 58, pages 16 and 17 of Miscellaneous :Maps,
records of Orange County, California, thence S 89°
02' 30" i'i along said Easterly prolongation and along
the Northerly line of said Tract NO. 2015, a distance
of 1331.55 feet to the West line of said Northwest
Quarter; thence 14 0° 28' 23" W along said West line
1281.85 feet to the point of beginning.

XCEPTING THEREFROM that portion of said land in-
cluded within Tract No. 6089, as shown on a map
recorded in look 224, pages 14 and 15 of Miscella-
neous Maps, records of said Orange County.
ALSO EXCEPTING THEREFROM that portion of said land
included within Tract No. 6091, as shown on a map
recorded in Book 234, pages 3i and 32 of Miscella-
neous Maps, records of said Orange County.
ALSO EXCEPTING `T'i EF LFROi i that portion of said land
lying Southerly of the following described line:
Beginning at a point on the West line of said Tract
No. 6091 which bears LY 0° 20' 23" W 540.80 feet from
the Southwest corner of Lot 36 of said Tract No. 6091;
thence S 89° 31' 37 W 584.00 feet to the West line
of said Northwest Quarter.
AND WEEREAS, the City Planning Commission did hold a
public hearing at the City hall in the City of Anaheim upon said
petition on January 15, 1968, notice of which said public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due in-
spection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said nearing, did adopt Resolution No. PC68 -25, recom-
mending that Variance ivo. 1941 be granted, in part, subject to
certain conditions therein set forth? and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council did
elect, upon its own motion to review the action taken by the City
Planning Commission in granting said variance and cid set a public
nearing thereon to be held on the 20th day of February, 1960, at
7 :00 o'clock P.M. in tne City hall in the City of Anaheim and
notice of such public hearing was duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offerer at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conuitions applicable to the property
involved or to tne intended use of the property
that ao not apply generally to tne property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for tie preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity anu zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.

4. That the granting of such variance will not ad-
versely affect the comprehensive general zoning
plan.
NOW, THEREFORE, 3E IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting the subdivision of the
property hereinbefore described into 80 R -2 -5000 Zone lots, with
waivers of the following Anaheim Municipal Code requirements or
limitations:
(a) Minimum five (5) foot side yard building setback
requirement (Section 18.28.050(5 -b)); and
(b) Maximum height and location of fences (Section
18.04.090(2-h-2 and 4))
subject to the following conditions:
1. That tnis variance is granted subject to the com-
pletion of Reclassification Proceedings No.
67- 66--47 now oendine
2. That ale lots snail be developed with a minimum
of ten (10) feet between structures on adjacent
lots, and in no event shall this building separa-
tion be reduced to less than ten (10) feet.
BE IT FURTr ER RESOLVED that the request for a waiver
of tiie Anaheim Municipal Code limitation that the maximum
coverage by all residential and accessory buildings shall be
40% of the lo area, be, and the same is hereby denied.
The City Council nereuy reserves the right to revoke
such variance permit for good cause or failure of said owners,
their heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
