A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF A1JALEII'' DENYING CONDITIONAL USE
P;RNIT NO. 991.
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a conditional use permit from
CARL L. RAU and MILDRED E. RAU, 923 West Lincoln Avenue, Anaheim,
California, to permit the stockpiling of topsoil and the storage
of equipment necessary for the loading and hauling of the top-
soil, on the following described property situated in the City
of Anaheim, County of Orange, State of California, to wit:
PARCEL 1: Lot 1 of Tract No. 994, as shown on a Map
recorded in Book 33, page 8 of Miscellaneous Maps,
records of Orange County, California.
EXCEPTING THEREFROM the Northerly 233.00 feet.
ALSO EXCEPTING THEREFROM that portion lying Westerly
of the Westerly line of the land described in a deed
to the Orange County Flood Control District recorded
July 27, 1961 in Book 5796, page 991 of Official
Records.
PARCEL 2: The West half of that portion of Richard
Street, 60.00 feet wide, as shown on a map of Tract
No. 994, recorded in Book 33, page 8 of Miscellaneous
Maps, records of Orange County, California, abandoned
by Order of the Board of Supervisors of Orange County
a certified copy of which order was recorded November 9,
1946 in Book 1505, page 142 of Official Records, lying
Southerly of the Easterly prolongation of the Southerly
line of the Northerly 233.00 feet of Lot 1 of said
Tract 7o. 994, and Northerly of the Easterly prolonga-
tion of the Southerly line of said Lot 1.
EXCEPTING THEREFROM that portion lying Easterly of the
Westerly line of the land described in a deed to the
Orange County Flood Control District, recorded July 27,
1961 in Book 5796, page 991 of Official Records.
AND WHEREAS, the
public hearing at the City
said request on January 3,
hearing were duly given as
of Title 18, Chapter 18.76
City Planning Commission did Mold a

1968, notices of which said public
required by law and the provisions
of the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection, inves
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution to. PC68 -12 granting Condi-
tional Use Permit No. 991, subject to the conditions therein
set forth; and

WHEREAS, thereafter, within twenty- -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in granting said conditional use permit
and said appeal was set for public hearing on February 20, 1968,
at the City hall, in the City of Anaheim, and notices of such
public hearing were duly given as required by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Zunicipal Code;
and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hear-
ing, that Conditional Use Permit No. 991 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission granting Conditional Use Permit No. 991 be, and the same
is hereby disapproved, and that the request of Carl L. Rau and
Mildred E. Rau for a conditional use permit to stockpile topsoil
and store equipment necessary to load and haul said topsoil, on
the property hereinbefore described, be and the same is hereby
denied; that a period of time, not exceeding one year, be allowed
for disposal of the materials stored on subject property; and
that no new materials shall be brought onto said property.
THE FOREGOING RESOLUTION is approved and signed by me
this 20th day of February, 1968.
