1968-103A SOLUTION of THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION NO.
63( -678 IN RECLASSIFICATION PROCEEDINGS
NO. 62- 63 -64.
WHEREAS, the City Council did heretofore, to wit, on
August 13, 1963, adopt Resolution No. 63R -678 in Reclassification
Proceedings No. 62 -63 -64 finding and determining that the property
and area therein described should be changed from RA, RESIDENTIAL
AGRICULTURAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, and R -3,
MULTIPLE FAMILY RESIDENTIAL ZONE, as more particularly set forth
in said resolution, subject to certain conditions enumerated
therein; and
WHEREAS, the owner of subject property has submitted
a revised tentative tract map of subject property to the City
Council for approval in which the depth of the lots originally
proposed for C -1 lots has been decreased and the depth of the
lots originally proposed for R -3 lots increased; and
WHEREAS, said revised tentative tract map has been
approved by the City Council; and
WHEREAS, the City Council finds that the descriptions
of the properties in Resolution No. 63R-678 proposed to be re-
classified to C -1, NEIGHBORHOOD COMMERCIAL ZONE and R -3, MULTIPLE
FAMILY RESIDENTIAL ZONE, should be amended to correspond with the
respective C -1 and R -3 areas in said revised tentative tract map.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 63R -678 in Reclassifica-
tion Proceedings No. 62 -63 -64 be, and the same is hereby amended
by amending the description of the real property contained in
said resolution to read as follows:
"All that real property situated in the City of Anaheim
County of Orange, State of California, described as
follows:
"PORTION 'A
The East half of the West half of the Northeast quarter
of the Northeast quarter of Section 14, Township 4 South,
Range 11 West in the Rancho Los Coyotes as said Section
is shown on the map recorded in Book 51, Page 11 of
Miscellaneous Maps, Records of said Orange County.
EXCEPTING THEREFROM that portion lying south of the line
perpendicular to the Easterly line of said East half
at the point distant Southerly measured along said
East line 230.00 feet from the Northeast corner thereof:
"PORTION 'Li':
RESOLUTION 1.4O.
The East half of the West half of the Northeast quarter
of the Northeast quarter of Section 14, Township 4 South,
Range 11 West in the Rancho Los Coyotes as said Section
is shown on the map recorded in Book 51, Page 11 of
Miscellaneous Maps records of said Orange County.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 1926
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from
Empire Financial Corporation, owner
of certain real property situated in the City of Anaheim, County
of Orange, State of California, described as follows:

The East half of the West half of the Northeast
quarter of the Northeast quarter of Section 14,
Township 4 South, Range 11 West in the Rancho
Los Coyotes as said Section is shown on the
map recorded in Book 51, Page 11 of Miscellaneous
Maps, Records of said Orange County.
EXCEPTING THEREFROM that portion lying south of
the line perpendicular to the Easterly line of
said East half at the point distant Southerly
measured along said East line 230.00 feet from
the Northeast corner thereof:
PORTION "B":
The East half of the West half of the Northeast
quarter of the Northeast quarter of Section 14,
Township 4 South, Range 11 West in the Rancho
Los Coyotes as said Section is shown on the map

EXCEPTING THEREFROM that portion lying Northerly

AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on Drappmhpr 18, 1967 notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC67-271
recommending that Variance No. 1926 be granted, in part
and

WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in granting said variance and
did set a public hearing thereon to be held on the 6th day
of February 19 68 at 1:30 o'clock P.M. in the City
Hall in the City of Anaheim and notice of such public hearing
was duly given as required by law and the Provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved or to the intended use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting the establishment of a
multiple family subdivision on Portion "B" of the real property
hereinbefore described, with a maximum of 60% of the lots to be
split into 35 -foot lots, the designation of the lots to be split
to be made by the developer and filed with the City Engineer
prior to the issuance of building permits, and witch waivers of
the following Anaheim Municipal Code requirements or limitations
on those lots to be split:
(a) A waiver of the minimum building site area (Section
18.28.050(1 -a));
(b) A waiver of the minimum building site width (Section
18.28.050(1 -b));
(c) A waiver of the maximum height of any building located
within 150 feet of any R -A Zone (Section 18.28.050(5 -b));
and
(d) A waiver of the yards and building setback requirements-
any building wall which does not contain main entrances
or windows opening into any habitable room shall have
a yard having a minimum depth of 5 feet (Section
18.28.050(6-b-3));
subject to the following conditions:
1. That this variance is granted subject to the
completion of Reclassification Proceedins No.
62 -63 -64 now pending.
2. That a Final Tract Map of subject property shall be
submitted to the City Council for approval, and
then recorded in the Office of the Orange County
Recorder.

3. That in order to permit subdivision of the 70 -foot
lots into 35 -foot lots with two dwelling units per
lot, at such time as such subdivision of the 70-
foot lots, which shall have been developed with
dwelling units, is proposed, a Parcel Map shall be
submitted to the City Engineer for approval and
then recorded in the Office of the Orange County
Recorder.
4. That plans for the development of the lots to be
split shall be submitted to and approved by the
Building Division.
5. That separate metering facilities for all public
utilities and separate sewer connections for each
duplex unit shall 'oe ?rovided.
6. That the minimum building site area shall be 3,955
squareeec :nor each 35 -foot lot having two dwelling
units.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
its successors or assigns, to comply with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance
is granted for the term prescribed by the Anaheim Municipal
Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 20th day of February, 1968.
