A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 993
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a conditional use permit
from Demetriou Del Guercio, 612 South Flower Street, Los
Angeles, California 90017, to establish a swimming pool show-
room and display area, with a waiver of the 6 -foot masonry wall
requirement along the north property line abutting an R -A Zone
(Section 18.40.070(6 -a) of the Anaheim Municipal Code), on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
All that portion of the Southeast one quarter of Section
26, Township 4 South, Range 10 West, in the City of
Anaheim, as said section is shown on a map thereof
recorded in Book 51, page 10, Miscellaneous Maps, records
of said Orange County, described as follows:
Commencing at the intersection of the West line of said
Southeast one quarter with a line that is parallel with,
and 40 feet Southerly, measured at right angles, from
the North line of said Southeast one quarter; said
intersection being the most Westerly corner of the land
described in Parcel 2 of the deed to the State of Cali-
fornia, recorded October 5, 1954 in Book 2834, page 198,
Official Records, and running thence along the South-
easterly and Southwesterly line of said Parcel 2, the
following courses and distances: North 89° 58' 50" East
along last mentioned parallel line, 382.62 feet;
South 65 56' 22" East 174.77 feet to the beginning of
a tangent curve concave Southwesterly and having a radius
of 770.00 feet; Southeasterly along said curve through
a central angle of 25 02' 23" an arc distance of
336.51 feet to the Southerly line of land described
in Certificate of Titles, No. 9296, filed in the office
of the Registrar of Titles, of said Orange County;
thence North 71 20' 45" East along said Southerly line
17.69 feet to the most Westerly corner of the land
described in Parcel 3 of said deed to the State of
California; thence South 40° 50' 15" East along the
Southwesterly line of said Parcel 3, a distance of
406.35 feet, more or less, to the Northwesterly line
of the land covered by Certificate of Titles No. 6495
filed in the office of said Registrar of Titles, thence
South 71 36' 30" West along said Northwesterly line,
17.53 feet to the Northeast corner of the land de-
cribed in the deed to Melrose Abbey, Inc., a corpora-
tion, recorded August 23, 1954, in Book 2798, page 249,
Official Records, said Northeast corner being on a
curve concave Southwesterly and having a radius of
2458.00 feet; a radial line at said point bears
North 49° 41' 49" East; thence Southeasterly along said
curve through a central angle of 5° 26' 48" a distance
of 233.66 feet to the most Easterly Southeast corner
of the land conveyed to Memorial Properties, Inc., by
deed recorded August 1, 1967 in Book 8327, page 759,
Official Records, said point being the TRUE POINT OF
BEGINNING of the boundary of the land herein described;
continuing thence Southerly, along said curve, through
a central angle of 2° 47' 50" an arc distance of 120.00
feet; thence South 71° 37' 45" West 216.34 feet to the
Easterly line of said land conveyed to Memorial
Properties, Inc., thence North 18° 22' 15" West, along
said Easterly line, 115.85 feet to an angle point there-
in thence North 71° 37' 45" East, along said Easterly
line, 184.80 feet to the true point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on January 3 1968 notices of
which said public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, said Commission, after due inspection, in-
vestigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. PC68 -9
granting Conditional Use Permit No. 993, subject to
certain conditions therein set forth and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in granting said conditional use
permit and did thereupon fix the 30th day of January
1968 as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful con-
sideration of the recommendations of the City Planning Commis-
sion and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
conditional use permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the area in which it is proposed to be located.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
ATTEST:
4. The traffic generated by the proposed use will not
impose an undue burden upon the streets and high-
ways designed and improved to carry the traffic in
the area.
5. The granting of the conditional use permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion in granting said conditional use permit be, and the
same is hereby sustained and that Conditional Use Permit
No. 993 be, and the same is hereby, granted permitting
the establishment of a swimming pool showroom and display area,
on the property hereinbefore described, with a waiver of the
6 -foot masonry wall requirement along the north property line
abutting an R -A Zone (Section 18.40.070(6 -a) of the Anaheim
Municipal Code), subject to the following conditions:
1. That this conditional use permit is granted subject
to the completion of Reclassification Proceedings
No. 67 -68 -45 now pending.
2. That subject property shall be developed sub-
stantially in accordance with plans and specifica-
tions on file with the City of Anaheim, marked
Exhibits Nos. 1 and 2.
The City Council hereby reserves the right to revoke
such conditional use permit for good cause or failure of said
owner, its successors or assigns to comply with the Anaheim
Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 30th day of January, 1968.
