1968-037WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 67 -68 -39 to consider an amendment to
Title 18 of the Anaheim Municipal Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the pro-
posed amendment be adopted by the City Council and that a
certain zone or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 23rd day
of January 196 as the time, and the City Council
Chambers in the City Hall of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, and the exclusion of said
property, hereinafter described, from the zone or zones in
which it now situated and the incorporation thereof in the
zone or zones hereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard, and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the Planning Commission, its report
of findings and recommendation; and
WHEREAS, the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County
of Orange, State of California, to wit:

Parcel 1: A portion of the North half of the West half of
the. Northwest quarter of the Northeast quarter of Section 22,
Township 4 South, Range 10 West, S.B.B. M., described as
follows:
Beginning at the Northeast corner of the North half of the
West half of the Northwest quarter of the Northeast quarter
of said Section 22; thence South 0° 14' 30" East along the
Easterly line of said North half of the West half of the North-
west quarter of the Northeast quarter, 156.00 feet; thence
South 89° 55' 35 West along a line parallel to the Northerly
line of said North half of the West half of the Northwest
quarter of the Northeast quarter of Section 22, 100.00 feet;
thence North 0° 14' 30" West along a line parallel to the
said Easterly line 156.00 feet to the said Northerly line of
the North half of the West half of the Northwest quarter of

Beginning at a point in the Easterly line of the North half of
the West half of the Northwest quarter of the Northeast quarter
of Section 22, 156.00 feet Southerly of the Northeast corner
thereof; thence South 0° 14' 30" East along the said Easterly
line 90.76 feet to a point in the curve concave Northerly hav-
ing a radius of 245.00 feet, the radial line of said curve at
said point bears North 18° 04' 03" West, said point being also
the Northeast corner of Lot "A" of Tract No. 1758, as shown on
a Map recorded in Book 53, pages 19 and 20 of Miscellaneous
Maps, records of Orange County, California; thence Westerly

be excluded from R -1, ONE FAMILY RESIDENTIAL ZONE, and incor-
porated in C -0, COMMERCIAL OFFICE ZONE, upon the following condi-
tions:
1. That the owners of subject property shall deed to the City
of Anaheim a strip of land 53 feet in width, from the cen-
ter of the street, along Ball Road, for street widening
purposes.
2. That the owners of subject property shall deed to the City
of Anaheim a strip of land 20 feet in width along the
northerly 116.50 feet of the easterly property line of sub-
ject property for alley purposes.
3. (a) That all engineering requirements of the City of Anaheim
for the alley along the northerly portion of the easterly
property line, including preparation of improvement plans
and installation of all improvements, such as grading, gut-
ters, headers, paving or other appurtenant work shall be
complied with as required by the City Engineer and in ac-
cordance with standard plans and specifications on file in
the Office of the City Engineer; and (b) that a bond in an
amount and form satisfactory to the City of Anaheim shall
be posted with the City to guarantee the installation of
said engineering requirements.

4. That the owners of subject property shall pay to the City
of Anaheim the sum of $2.00 per front foot, along Ball Road,
for street lighting purposes.
5. That the owners of subject property shall pay to the City
of Anaheim the sum of 15 per front foot along Ball Road
and Berry Avenue, for tree planting purposes.
6. That all vehicular access rights to Berry Avenue shall be
dedicated to the City of Anaheim.
7. That driveway locations along Bali Road shall be approved
by the City Engineer.
8. That Conditions Nos. 1, 2, 3(b), 4, 5, 6 and 7 abovemen-
tioned shall be complied with within a period of 180 days
from date hereof, or prior to the issuance of a building
permit.
9. That all air conditioning facilities shall be properly
shielded from view and the sound shall be buffered from
adjacent residential homes.
10. That the parking areas shall be lighted with down- lighting
of a maximum height of 6 feet, and said lighting shall be
directed away from the property lines to protect the resi-
dential integrity of the area.
11. That the driveways along Ball Road and Berry Avenue, which
are not to be used, shall be removed and curbs and gutters
constructed as required by the City Engineer and in accord-
ance with standard plans and specifications on file in the
Office of the City Engineer.
12. That trash storage areas shall be provided in accordance
with approved plans on file in the Office of the Director
of Public Works and Superintendent of Streets.
13. That Conditions Nos. 9, 10, 11 and 12 abovementioned shall be
complied with prior to final building and zoning inspections.
14. That ordinances reclassifying subject property shall be adopted
ted as and when each parcel is ready to comply with the condi-
tions pertaining to such parcel; provided, however, that the
word "parcel" shall mean presently existing parcels of record
and any parcel or parcels approved by the City Council for
a lot split.
BE IT FURTHER RESOLVED that the CityAttorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an ordinance amending Title 18 of the
Anaheim Municipal Code to accomplish the objects herein found
and determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
