1968-029WHEREAS, the City Council did heretofore, to wit, on June 7, 1960, adopt Resolution No. 6065 in Reclassification Proceedings No. 59 -60 -94 finding and determining that the property and area therein described should be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE, and R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, to C -1, NEIGHBORHOOD- COMMERCIAL ZONE, as more particularly set forth in said resolution, subject to certain conditions enumerated therein; and WHEREAS, Condition No. 10 of said resolution required the owners of the respective parcels of subject property to place of record City of Anaheim C -1 Deed Restrictions limiting the uses of the property to the numerous uses listed in said condition; and WHEREAS, said C -1 Deed Restrictions were duly recorded in Official Records of Orange County, California, on August 15, 1960, in Book 5375, Pages 426 to 432, both inclusive, Document No. 143319; and RESOLUTION NO. 68R -29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO THE REMOVAL OF CERTAIN DEED RESTRICTIONS FROM THE PROPERTY HEREINAFTER DESCRIBED; AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN A CONSENT TO SUCH REMOVAL. WHEREAS, thereafter, on November 19, 1962, consent of the City of Anaheim having been given thereto, an amendment to the aforementioned Deed Restrictions was recorded in Book 6328, Pages 826 to 835, both inclusive, Document No. 14477, Official Records of Orange County, California; and WHEREAS, numerous requests have been received from the owners of certain of the parcels of property described in said reclassification proceedings asking that the consent of the City be given to the amendment or removal of said deed restrictions to permit a broader use of their respective parcels of property; and WHEREAS, the City Council did, in response to a peti- tion filed by the owner of Parcel No. 1 described in said re- classification, adopt Resolution No. 67R -604 consenting to the removal of said restrictions from said Parcel No. 1, after having held public hearings thereon as required by law; and WHEREAS, the City Council did, on October 31, 1967, authorize the initiation of proceedings for the removal of said C -1 Deed Restrictions from the remaining parcels of the property described in Reclassification No. 59- 60 -94, the City Council having found that said reclassification was approved and the uses of the property restricted by deed restrictions at a time prior to the C -1, General Commercial Zone revision and the adoption of site development standards for the C -1 Zone by the City; and WHEREAS, the City Planning Commission did hold a public hearing on the removal of said deed restrictions from said remain- ing parcels, after having given due notice thereof as required by 59 -60 -94 law, and did recommend to the City Council by Resolution No. PC -67 -262 that the consent of the City be given to the removal of said restrictions; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did set said matter for public hearing on January 16, 1968 at the Council Chambers in the City Hall, City of Anaheim, and did give due notice thereof as required by law; and WHEREAS, the City Council did hold and conduct said hearing at the time and place fixed therefor, and did give all persons interested therein an opportunity to be heard and did consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find that the consent of the City of Anaheim should be given to the removal of said C -1 Deed Restrictions from the property hereinafter described, subject to the conditions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the consent of the City of Anaheim be, and the same is hereby given to the removal of those certain City of Anaheim C -1 Deed Restrictions recorded on August 15, 1960, in Book 5375, pages 426 through 432, Document No. 143319, Official Records of Orange County, California, and thereafter amended on November 19, 1962, by Document No. 14477, recorded in Book 6328, pages 826 through 835, Official Records of Orange County, California, from that certain real property situated in the City of Anaheim, County of Orange, State of California, described as: Parcel 1: That portion of Lot 16 of Anaheim Extension in Rancho San Juan Cajon de Santa. Ana, County of Orange, State of California, as per map thereof by Wm. Hamel on file in the Recorder's Office of Los Angeles County, California, described as follows: Beginning at a point in the center line of Placentia Ave., said point being 195.84 feet South 0° 05' 15" West from the intersection of said center line of Placentia Ave., with the center line of South Street, running thence from said point of beginning of South 0° 05' 15" West 73.00 feet to the Southeasterly corner of that certain parcel of land conveyed to James B. Kerwin by deed recorded October 28, 1947 in Book 1590, at page 187 of Official Records, in the office of County Recorder of said Orange County. Thence South 74° 36' 05" West 299.70 feet along a line parallel with said center line of South Street, to the most Southerly corner of said Kerwin parcel of land. Then North 15° 45' 25" West 70.34 feet along the Westerly line of said Kerwin parcel of land, thence North 74° 36' 05" East 308.76 feet to the point of beginning. Parcel 2: That portion of Lot 16 of Anaheim Extension in the Rancho San Juan Cajon de Santa Ana, as per map thereof -2- recorded by Wm. Hamel on file in the Recorder's Office of Los Angeles County, California, described as follows: Beginning at a point in the center line of Placentia Avenue, South 0° 05' 15" West 268.84 feet from the North- east corner of said. Lot 16, said corner being considered to be the intersection of the center lines of South Street and Placentia Avenue; running thence South 0° 05' 15" West 106.15 feet along said center line of Placentia Avenue; thence South 74° 36' 05" West 270.72 feet along a line parallel to the said center line of South Street to a point in the East line of that certain parcel of land conveyed to C. L. Becker by deed recorded in Book 161, page 89, of Deeds, records of said Orange County; thence North 15° 45' 25" West 102.33 feet along the said East line of the parcel conveyed to C. L. Becker to a point in a line which bears South 74° 36' 05" West from the point of beginning, said line being parallel to the said center line of South Street; thence North 74° 36' 05" East 299.70 feet along said parallel line to the point of beginning. Parcel 3: That portion of Lot 16 of Anaheim Extension in the Rancho San Juan Cajon de Santa Ana, in the County of Orange, State of California, as per map thereof by Wm. Hamel on file in the Recorder's Office of Los Angeles County, California, described as follows: Beginning at a point in the center line of Placentia Avenue distant thereon South 0° 05' 15" West 374.99 feet from the Northeast corner of said Lot 16, said corner being considered to be the intersection of the center lines of South Street and Placentia Ave. and running thence South 0° 05' 15" West 118.98 feet along said center line of Placentia Ave.; thence South 74° 36' 05" West 238.23 feet along a line parallel to the said center line of South Street to a point in the East line of that certain parcel of land conveyed to C. L. Becker by deed recorded in Book 161, at page 89, of Deeds, records of said Orange County; thence North 15 45' 25" West 114.69 feet along said East line of the land conveyed to C. L. Becker to a point in a line which bears South 74° 36' 05" West from the point of beginning, said line being parallel to the said center line of South Street; thence North 74° 36' 05" East 270.72 feet along said parallel line to the point of beginning. For the purpose of this description the lines of said Lot 16 of Anaheim Extension are construed to be at the center line of streets. subject to the following conditions: be, and th removal of Anaheim. 1. That the owners of subject property shall pay to the City of Anaheim the sum of 15 per front foot, along State College Boulevard and Morava Avenue, for tree planting purposes. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 3. That all air conditioning facilities shall be properly shielded from view and the sound shall be buffered from adjacent residential homes. 4. That any lighting that is provided shall be directed downward and away from the property lines. 5. That Condition No. 1 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. 6. That Conditions Nos. 2, 3 and 4 above mentioned shall be complied with prior to final building and zoning inspection.
