1967-682RESOLUTION NO. 67R -682 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 67 -68 -29 to consider an amendment to Title 18 of the Anaheim municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, at such time as the property hereinafter described is annexed to the City of Anaheim, and at said hearing did receive evidence and reports from persons in- terested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 12th day of December 1967 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones here- inafter set forth, at such time as said property is annexed to the City of Anaheim, and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hear ing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth, at such time as said property is annexed to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the County of Orange, State of California, to wit: 67 -68 -29 That portion of Section 1, Township 4 South, Range 9 West, S.B.M., in the County of Orange, State of Cali- fornia, described as follows: Beginning at the intersection of the westerly line of the 5.00 acre parcel shown on a map filed in Book 26, page 20 of Records of Survey of said Orange County with the southerly line of the Santa Ana Valley Irrigation Company right of way as shown on said map; thence South 11° 33' 20" West 609.21 feet, more or less, along the westerly line of the land conveyed to Ralph E. Poh and wife, by deed recorded June 1, 1966 in Book 7947, page 914 of Official Records of said Orange County, to the most southwesterly corner of said land; thence South 47° 56' 30" East 40.35 feet, more or less, along a portion of the southerly line of the land conveyed to said Ralph E. Poh and wife, to a point, said point being in the north- erly terminus of a line bearing North 27° 56' 03" East and having a distance of 282.63 feet, as shown on a map of survey filed in Book 62, page 26 of Record of Surveys in the office of the County Recorder of Orange County, California; thence following along a portion of the boundaries of the land shown on the last mentioned Record of Survey the following courses and distances: South 27° 56' 03" West 262.63 feet, North 47° 25' 17" West 199.92 feet and South 4° 37' 37" East 549.44 feet; thence WEST 378.76 feet to the centerline of Walnut Canyon Road as described in the deed recorded November 19, 1964 in Book 7309, page 781 of said Official Records; thence along said centerline the following described courses: North 0° 21' 57" West 710.00 feet to the beginning of a tangent curve concave easterly, having a radius of 600 feet; Northerly 165.70 feet along said curve through a central angle of 15° 49' 23"; North 15° 27' 26" East, tangent to said curve, 219.44 feet to the beginning of a tangent curve, concave westerly, having a radius of 600 feet and Northerly 334.59 feet along said curve through a central angle of 31° 57' 03" to said southerly right of way line thence, leaving said centerline, South 78° 26' 40" East 646.58 feet to the point of beginning. be excluded from A-1, GENERAL AGRICULTURAL DISTRICT (Orange County zoning) and incorporated in C-1, GENERAL COMiiERCIAL ZONE, at such time as said property is annexed to the City of Anaheim, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 37 feet in width, from the center line of the street, along Walnut Canyon Road, for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 48 feet in width along the northerly property line of subject prop- erty, for street purposes, including a 15-foot radius corner return at Walnut Canyon Road. 3. (a) That all engineering requirements of the City of Anaheim along Walnut Canyon Road and the newly dedicated street along the northerly property line, including preparation of improvement plans and in- -2- stallation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer; and (b) that a bona in an amount and form satisfac- tory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineer- ing requirements. 4. That the owners of subject property snail pay to the City of Anaheim the sum of $2.00 per front foot, along Walnut Canyon Road and the newly dedicated street along the northerly property line. 5. That the owners of subject property small pay to the City of Anaheim the sum of 15Q per front foot along Walnut Canyon Road and the newly dedicated street along the northerly property line. 6. That trasri storage areas snail be provided in accor- aance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning ins ec- tions. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 8. That all air conditioning facilities shall be properly shielaea from view, and the sound buffered from ad- jacent residential homes, prior to final building and zoning inspections. 9. That any lighting that is provided within the parking area shall be on light standards of a maximum height of 6 feet and shall be directed downward and away from any abutting property lines. In addition, ail exter- nal lighting stall be directed downward and away from the property lines. That this condition shall be com- plied with prior to final building and zoning inspec- tions. 10. That Conditions Nos. I, 2, 3(b), 4 and 5 above mentioned shall be complied with within a period., of two years from gate hereof, or such further time as the City Council may grant. 11. That a precise plan of development conforming to the C -n, Commercial Hillside Zone site development standards, for all phases, shall be approved prior to the issuance of a building permit, in order to insure architectural compatibility with the over -all concept of the Hill and canyon area. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the -3- Anaheim Municipal Code to accomplish the objects herein fount_ and determined to be necessary and proper.
