1967-676RESOLUTION NO. 67R- 676 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRI- TORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE SANTA ANA CANYON ANNEXATION NO. 1 DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim did on the 5th day of December 1967 receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim; and WHEREAS, prior to the circulation or filing of said petition, notice of intention to annex said territory, contain- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission; and WHEREAS, said Local Agency Formation Commission has rendered its decision, as provided in Section 54797 of the Government Code, approving said annexation; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is uninhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council finds from evidence and reports received that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one fourth (1/4) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: PROPOSED SANTA ANA CANYON ANNEXATION NO. 1 TO THE CITY OF ANAHEIM That parcel of land located in the County of Orange, State of California, described as follows Beginning at a point in the existing City Limit line of the City of Anaheim, said point of beginning being at the intersection of the Southerly line of Tract No. 936, as shown on a Map recorded in Book. 30, pages 1 and 2 of Miscellaneous Maps, records of Orange County, California, with the Westerly line of Lot 8 of said Tract No. 936, as established by the Yorba Annexation to the City of Anaheim, passed by Ordinance No. 1777, November 13, 1962, filed with the Secretary of State August 10, 1964 and recorded August 13, 1964 in the office of the County Recorder of Official Records of Orange County, California; thence Following along the said existing City Limit lines of the City of Anaheim, the following courses and distances: North 0 18° East 2,101 feet, more or less, along a portion of the Westerly line of Lot 8 of said Tract No. 936, to an intersec- tion with the Southerly line of Santa Ana Canyon Road; thence South 85 52" 09" East 117.46 feet, more or less, along a portion of the Southerly line of said Santa Ana Canyon Road to the beginning of a tangent curve concave Northerly and hav- ing a radius of 2,110 feet, more or less; thence Easterly along said curve through a central angle of 12 37° 17'° an arc distance of 465 feet, more or less, to an inter- section with the Southerly prolongation of the West line of Lot 4 of the Dominguez Estate, as shown on a Map of Survey filed in Book 2, page 15 of Record of Surveys in the office of the County Recorder of Orange County, California; thence North 0 00 East 1,208 feet, more or less, along said Southerly prolongation and said Westerly line of Lot 4 of said Dominguez Estate to the Northwest corner of said Lot 4, said Northwest corner of Lot 4 also being the Northeast corner of Lot 3 of said Dominguez Estate; thence North 61 35' West 95 feet, more or less, along a portion of t ''?ortherly line of Lot 3 of said Dominguez Estate to an intersection with the Southerly prolongation of the Easterly line of the land conveyed to Arnulfo 0. Dominguez by deed re- corded December 1, 1911 in Book 190, page 325 of Official Re- cords of Orange County, California; thence North 1 50° East 730 feet, more or less, along the said Page 2 Proposed Santa Ana Canyon Annexation No. 1 to the City of Anaheim Southerly prolongation and Easterly line of the land conveyed to said Arnulfo O. Dominguez to the Northeast corner of said parcel of lands thence North 57 11' 07" West 150 feet, more or less, along a portion of the Northerly line of the land conveyed to said Arnulfo O. Dominguez to an intersection with the Easterly line of the land conveyed to the State of California by deed re- corded October 14, 1952 in Book 2395, page 522 of Official Records of Orange County, California; thence North 1 08' 53" East 415 feet, more or less, along a portion of the Easterly line of the land conveyed to said State of California to an intersection with the Southerly line of the land described in the boundary line agreement and grant deed conveyed to Joe Leung Young and Louie Ho Young, husband and wife, recorded March 31, 1964 in Book 6983, pages 893 through 899 of Official Records of Orange County, California; thence Leaving the said existing City Limit line of the City of Anaheim, following along the said Southerly line of the land conveyed to said Joe Leung Young and wife, the following courses and distances: South 56 30' East 920.27 feet, South 87 30' East 953.07 feet to an intersection with the Northerly prolongation of the Westerly line of the land conveyed to Daniel S. Halladay by deed recorded August 13, 1936 in Book 841, page 134 of Official Records of Orange County, California; thence South 6 00' 00" East 87 feet, more or less, along said Northerly prolongation to the Northwest corner of the land con- veyed to said Daniel S. Halladay; thence North 69 00' 00" East 287.20 feet along the Northerly line of the land conveyed to said Daniel S. Halladay to the Northeast corner of said parcel; thence South 140 feet along the Easterly line of the land con- veyed to said Daniel S. Halladay to the Southeast corner of said land, said Southeast corner also being the Northwest corner of that land conveyed to Howard L. Budlong and Rose Marie Budlong, husband and wife, by deed recorded February 14, 1961 in Book 5629, page 12 of Official Records of Orange County, California; thence continuing South 1,250 feet, more or less, along the Westerly line of the land conveyed to said Howard L. Page 6 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as SANTA ANA CANYON ANNEXATION NO. 1, and that notice of such proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have peti- tioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section 35311 of the Government Code. BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their consents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 23rd day of January 19 68 at the hour of 1:30 o'clock P. M., at the City Council Chamber in the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed; and that at any time before the closing of said hearing on protests, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this reso- lution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circula- tion, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: the Placentia Courier and that such publication shall be completed at least twenty (20) days prior to the date of hearing herein above specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexa- tion to be mailed to the Board of Supervisors of such County. The foregoing notices shall be given not less than twenty (20) days before the first public hearing on the proposed annexation. -7- THE FOREGOING RESOLUTION is approved and signed by me this 5th day of December 1967.
