1967-668NO. 67R-668 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANA= APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEYENT BETWEEN THE CITY OF ANAHEIM AND THE COUNTY OF OR1=, WITH REFERENCE TO THE CONSTRUCTION OF ROADWAY IMPROVE ON ORANGETHORPE. WHEREAS, the County of Orange is proposing to construct roadway improvements on Orangethorpe Avenue between Linda Vista Street and Imperial Highway; and. HEREAS, portions of the proposed improvements are in the City of Anaheim; and WHEREAS, the County and the City consider it in the best interest of economics and public safety to combine the improvement in their respective jurisdictions into one project; and WHEREAS, the County has offered to design, contract and inspect said City portions of the project; and WHEREAS, the County of Orange has tendered to the City a form of agreement to be entered into between the parties, providing for the inclusion of the City's portions of said im- provement in the County's project; and WHEREAS, the City Council finds that the terms and con- ditions of said agreement are fair and reasonable, and that said agreement should be approved. NOW, THEREFORE, DE IT RESOLVED by the City Council of the City of Anaheim that the agreement tendered to the City of Anaheim by the County of Orange to be made and entered into between the parties, providing for the incorporation of the City's portions of the roadway improvements hereinabove referred to into the County's project, upon the terms and conditions hereinafter set forth, be, and the same is hereby approved. Said terms anC conditions are as follows: 1. COUNTY SFALL: A. Be designated as Project Engineer, Contracting and Construction Agent for the parties to do and perform all things necessary in order to construct the proposed improvement of Orangethorpe Avenue between Linda Vista Street and Imperial Highway; including the acquisition of right of way within the City, and to execute and deliver all documents required in connection with the construction and completion of said project, including Certificate of Cost and Certificate of Completion of the project. B During the period of construction have jurisdic- tion over the construction area including that portion of the project within the City area. ATTEST; C. Submit the proposed right of way agreement for the City right of way to City for review and approval prior to actual acquisition of said City right of vay. 2. CITY SHALL. A. Approve the plans and specifications as they pertain to construction and maintenance features for City portions of the project, prior to advertising for construction. B. At all time during the progress of construction of said project have access to the work thereon for the purpose of inspection thereof, and should the City deem any remedial measures to be necessary, City shall notify County thereof. C. Finance all right of way and construction costs for work done within the City. 3. The total estimated cost for the City portion is presently $25,000.00, which sum includes an estimate of the engineering and overhead for the City portion, including right of way acquisition costs 4. The City's share of the right of way and construction costs shall be determined on the basis of the amount of right of way acquired and construction work done on said portion of roadway lying within its boundaries, as these boundaries exist at the time of advertising the project. 5. Upon completion of construction of said portion of pavement, the County shall submit full, true and correct copies of documents, certificates and iteraized bills to the City and City shall reimburse County within thirty (30) days uuon submission of such costs. Such bills shall be based on the actual right of way acquisition costs and the actual quantities of construction and the unit prices bid for the contract; and shall also contain a charge for engineering and inspection based on the proportion of contract cost for the portion within the City to the total contract cost and the total engineering and inspection costs, 1us a charge for overhead on the engineering and inspection performed by the County, and exclusive of administrative overhead. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute said agreement for and on behalf of the City of Anaheim. THE.
