1967-605RESOLUTION NO. 67R -605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 960 IN PART. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from VOGE, INC., 7601 Crenshaw Boulevard, Los Angeles, California 90043, to establish a restaurant with on -sale beer and wine, and permitting a waiver of the 6 -foot masonry wall requirement (Section 18.40.070(2 -a -4) of the Anaheim Municipal Code), on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of Lot 16 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hamel and filed in the office of the county recorder of Los Angeles County, California, a copy of which is shown in book 3, Page 163, et seq, entitled 'Los Angeles County Maps," records of said Orange County, described as follows: Beginning at a point on the center line of South Street, North 74 36' 05" East 111.50 feet from the northwest corner of the land conveyed by deed recorded October 28, 1947 in book 1590 page 187 of Official Records, said corner being South 74 36' 05" West 373.10 feet from the intersection of said center line with the center line of Placentia Avenue; thence South 15 45' 25" East 188.75 feet, parallel with the West line of said land to the northwesterly line of the land described in the deed to William H. Grebel, et ux, recorded July 3, 1948 in book 1663, pages 397 and 398 of Official Records; thence North 74 36' 05" East to the northeast corner of said land; thence North 0 05' 15" East 195.84 feet along said center line of Placentia Avenue to said center line of South Street; thence South 74 36' 05" West 261.60 feet to the point of beginning. EXCEPT that portion of said land included within South Street, as shown on said map. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on August 28 19 67 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. $C67 -196 SimmWmpc granting Conditional Use Permit No. 960, bi to certain conditions therein set forth and -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 31st day of October 19 67 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission gr nti}� g said conditional use permit be, and the same is hereby sustained and that Conditional Use Permit No. 960 be, and the same is hereby, granted permitting the establishment and operation of a restaurant, without the sale of alcoholic beverages, and permitting a partial waiver of the 6 -foot masonry wall requirement along the north property line (Section 18.40.070(2 -a -4) of the Anaheim Municipal Code), on the property hereinbefore described, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. -2- 2. That the parking area shall be lighted with a "down- lighting" type of lights, which shall be directed away from the property lines to protect the residential integrity of the area, and no flashing lights of any type shall be be placed on any signs. 3. That all vehicular access rights to South Street shall be dedicated to the City of Anaheim, except for a 24 -foot driveway, 12 feet on each side of a line projected southerly from the center line of the alley leading north from South Street. 4. (a) That a 6 -foot decorative masonry wall shall be constructed along the west property line; (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said wall; and (c) that a 42 -inch decorative masonry wall shall be constructed along the north property line to the rear of the required planting strip. S. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked Exhibits 1, 2, 3 and 4, revised; provided, however, that the structure shall be orientated to State College Boulevard. 6. That Conditions Nos. 1, 2 and 4(b) and (c) above mentioned shall be complied with prior to final building and zoning inspections. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
