A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ADOPTING RESIDENTIAL DESIGN
GUIDELINES FOR AFFORDABLE HOUSING DEVELOPMENT
WHEREAS, the City of Anaheim has established the following
programs and ordinances which are designed to increase, improve
and preserve the City's supply of low and moderate income
housing available at an affordable housing cost: (a) the
Density Bonus ordinance as set forth in Chapter 18.99 of the
Anaheim Municipal Code; (b) the Senior Citizens Apartment
Projects ordinance as set forth in Chapter 18.94 of the Anaheim
Municipal Code; (c) the Single Room Occupancy Housing Policy
which was adopted on November 19, 1991; and (d) the sale of
surplus land owned by the City of Anaheim for affordable
housing purposes; and
WHEREAS, the City of Anaheim has adopted a Housing Element
to the City's General Plan, the implementation of which
requires the City's Community Development Department to prepare
a design manual and implement residential design guidelines for
"all housing projects making use of public resources, either
directly through public funding and/or indirectly through such
programs as density bonuses"; and
WHEREAS, Section 18.99.080.040 of the Anaheim Municipal
Code requires that plans for housing projects for which a
density bonus is sought shall be submitted to the Community
Development Department for design review, and the Community
Development Department shall review the projects design and
make a recommendation thereon to the Planning Commission; and
WHEREAS, Section 18.94.025 of the Anaheim Municipal Code
requires that plans for senior citizen housing projects shall
be submitted to the Community Development Department for design
review, and the Community Development Department shall review
project's design and make a recommendation thereon to the
Planning Commission in connection with the Planning
Commission's decision on the conditional use permit for such
project; and
WHEREAS, Section B(3) of the City's Single Room Occupancy
Housing Policy, as adopted by the Anaheim City Council on
November 19, 1991, requires that plans for single room
occupancy housing projects shall be submitted to the Community
Development Department for design review, and that such
projects shall be consistent with surrounding uses and
compatible in size, scale and architecture; and
WHEREAS, Government Code Sections 54221 to 54232,
inclusive, and Section 54237 authorize cities to sell or lease
surplus land and residential property to public entities for
the purpose of developing and maintaining low-- and moderate-
income housing thereon; and
WHEREAS, Government Code Section 50570 authorizes cities to
sell, lease or otherwise transfer surplus property to housing
corporations, limited dividend corporations or nonprofit
corporations for the development of housing thereon, available
to persons and families of low- or moderate-income;
WHEREAS, cities are authorized to issue and/or participate
in the issuance of bonds for the purpose of financing or
assisting in the financing of construction or rehabilitation of
housing for persons and families of low- and moderate-income;
and
WHEREAS, the Community Development Department has prepared
a design manual entitled "Residential Design Guidelines", a
copy of which is attached hereto and incorporated herein by
reference; and
WHEREAS, the Residential Design Guidelines establish a
six-phase process for pre-application conferences, conceptual
and final design review, design plan check and construction
inspection in addition to the review process otherwise required
of development projects under the City Municipal Code; and
WHEREAS, the Residential Design Guidelines are intended to
establish an advisory process whereby technical assistance is
given to project applicants to ensure a high level of design of
affordable housing projects, to ensure the liveability of new
housing and to provide for the compatability of such housing
projects with neighboring areas; and
WHEREAS, the Residential Design Guidelines do not establish
an additional approval process for affordable housing projects,
but instead are meant to provide additional information for the
City Planning Commission and City Council to consider in their
review and approval of such development projects; and
WHEREAS, the Planning Commission of the City of Anaheim has
recommended to the City Council the adoption of the Residential
Design Guidelines; and
WHEREAS, the City Council of the City of Anaheim desires to
adopt the Residential Design Guidelines as hereinafter set
forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
SECTION 1.
That the City Council hereby adopts those certain
guidelines as attached hereto as the Residential Design
Guidelines of the City of Anaheim which shall be the applicable

design guidelines for the following ordinances, policies and
programs:
(a) The Density Bonus Ordinance, as set forth in
Chapter 18.99 of the Anaheim Municipal Code;
(b) The Senior Citizens' Apartment Projects Ordinance, as
set forth in Chapter 18.94 of the Anaheim Municipal
Code;
(c) The Single Room Occupancy Housing Policy, as adopted
by the Anaheim City Council on November 19, 1991;
The sale of surplus land owned by the City of Anaheim
to the Anaheim Redevelopment Agency, Anaheim Housing
Authority, or other public agency, housing
corporation, limited dividend corporation or nonprofit
corporation, for affordable housing purposes, as set
forth in Government Code Sections 54221 to 54232,
inclusive, 54237 and 50570;
(e) Any bonds which the City issues or participates in for
the purpose of financing or assisting in the financing
of construction or rehabilitation of housing for
persons of low- and moderate-income; and
(f) Any other zoning, land use entitlement, or other
discretionary actions relating to affordable housing,
when the City Council by specific plan, resolution,
policy or ordinance has heretofore or hereinafter
required that such affordable housing project be
subject to a design review process.
SECTION 2.
That any affordable housing agreement by and between the
City of Anaheim and a person or entity which proposes to
construct or substantially rehabilitate housing for persons of
low-and moderate-income at an affordable housing cost, when
such project makes use of public resources, either directly
through public funding or indirectly, shall require that the
developer of such housing project comply with the Residential
Design Guidelines advisory process.
SECTION 3.
That this resolution and the Residential Design Guidelines
shall become effective as of February 25, 1992
