A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PUBLIC UTILITY EASEMENT.
(84-3A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 15th day of January, 1985, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that Public
Utility Easement, more specifically described as follows:
That certain easement granted to Southern California
Edison Company in the City of Anaheim, County of
Orange, State of California by Document Number 5605,
recorded in Book 1800, page 419, Official Records of
said Orange County and subsequently acquired by said
City of Anaheim by Document Number 8860, recorded by
Book 9431, page 619 Official Records of said Orange
County described as follows:
That portion of Lots 3 and 6 in Tract #865 as per map
recorded in Book 28 of Miscellaneous Maps, page 18,
Records of said Orange County, which was conveyed to
the Grantor herein by deed recorded August 14, 1948
in Book 1636 of Official Records, page 334, Records
of said Orange County.
All poles shall be erected and maintained within one
foot of the following described line:
Beginning at a point in the Northerly line as said
property of the Grantor, which point is approximately
400 feet Easterly, measured thereon from the
Southwesterly line of said Lot 3; thence
Southeasterly parallel to said Southwesterly line 580
feet; thence Southeasterly 200 feet; thence Southerly
535 feet; thence Southeasterly approximately parallel
to the Southwesterly line of said Lot 6, a distance
of 200 feet..
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of ~~anuary,
