1985-045RESOLUTION NO. 85R-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING CERTAIN CONDITIONS OF APPROVAL AS SET FORTH IN RESOLUTION NO. 75R-134 RELATING TO ZONING RECLASSIFICATION PROCEEDINGS NO. 74-75-26 WHEREAS, the City Council of the City of Anaheim adopted Resolution No. 75R-134 on March 18, 1975, in Zoning Reclassification Proceedings No. 74-75-26, finding and determining that Title 18 of the Anaheim Municipal Code relating to zoning boundaries should be amended and that the boundaries of certain zones should be changed, subject to certain conditions of approval contained therein; and WHEREAS, the Planning Commission of the City of Anaheim has heretofore determined that the public necessity, convenience and general welfare require the amendment of certain conditions of approval of said Resolution No. 75R-134, and has recommended such amendment to the City Council; and WHEREAS, the City Council has heretofore held a duly noticed public hearing to consider said amendment of conditions and did give all persons interested therein an opportunity to be heard and did receive reports and evidence, and did consider the same; and WHEREAS, the City Council does find and determine that the public necessity, convenience and general welfare require that certain conditions of approval of said Resolution No. 75R-134 be amended in the manner hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval as set forth in Resolution No. 75R-134 relating to Zoning Reclassification Proceedings No. 74-75-26 be, and the same are hereby, amended by amending Condition Nos. 12 and 15 thereof to read as follows, respectively: "12. That subject property shall be developed with general offices substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 3 of Exhibit No. 1, and Exhibit Nos. 2 through 5. 15. That the regular hours of operation shall be limited to 7:00 a.m. to midnight daily." BE IT FURTHER RESOLVED that new Condition No. 16 be, and the same is hereby, added to Resolution No. 75R-134, to read as follows: "16. That a covenant limiting the use of the subject property to general office uses shall be approved by the City Attorney and recorded in the Orange County Recorder's Office by the property owner. Proof of said recordation shall be furnished to the Planning Department on or before February 22, 1985." BE IT FURTHER RESOLVED that except as herein expressly amended, Resolution No. 75R-134 shall remain in full force and effect. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Ordinance No. 3435 to conform to the provisions of this resolution.
