RESOLUTION NO. 85R- 321
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM INITIATING A PROPOSAL FOR A
DISTRICT REORGANIZATION DESIGNATED AS ORANGE
COUNTY REORGANIZATION NO. 82.
WHEREAS, the Orange County Special District Task Force
("Task Force") in its January 17, 1984, report to the Board of
Supervisors of the County of Orange identified certain
inefficiencies resulting from multiple governmental agencies
providing similar municipal-type services within the corporate
limits of a city; and
WHEREAS, said report endorsed the full-service
municipality concept and recommended that the cities assume
provision of certain service provided by Garden Grove Sanitary
District and Stanton County Water District; and
WHEREAS, the City Council of the City of Anaheim concurs
with the Task Force finding that multiple grovernmental agencies
performing similar public works functions within the corporate
boundaries of the City of Anaheim contribute to the complexity of
local government and may hinder the ability of city residents to
readily identify and contact the agency responsible for providing
service; and
WHEREAS, the City Council believes that residents of the
City of Anaheim would benefit from a full-service municipal
concept and supports the proposal of the Orange County Special
District Task Force that the City assume the provision of sewer
maintenance and refuse collection services from Garden Grove
Sanitary District and sewer maintenance services from Stanton
County Water District within the corporate limits of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
1. That pursuant to the District Reorganization Act of 1965,
Division 1, Title 6 of the Government Code of the State of
California, the City Council of the City of Anaheim does hereby
request the (i) the boundaries of the Garden Grove Sanitary
District hereinabove referred to and (ii) the boundaries of the
Stanton County Water District hereinabove referred to be
reorganized as set forth in this request and that said request be
approved by the Local Agency Formation Commission of Orange
County, State of California.
2. That the nature of the change of organization is as
follows:
a. Inhabited territory situated within the corporate
limits of the City of Anaheim be detached from the Garden Grove
Sanitary District.
b. Inhabited territory situated within the corporate
limits of the City of Anaheim be detached from the Stanton County
Water District.
3. That this proceeding be designated as Orange County
Reorganization No. 82 for the purpose of the records of the Local
Agency Formation Commission of Orange County, State of California.
4. That the names of all other counties, cities and
districts which will be affected by proposed reorganization are
County of Orange, City of Anaheim, Garden Grove Sanitary District,
and Stanton County Water District.
5. That it be requested that the proposed reorganization be
subject to the following terms and conditions:
a. The fixed assets of the Garden Grove Sanitary
District located within the city limits of Anaheim be transferred
to the City of Anaheim.
b. The fixed assets of the Stanton County Water
District located within the city limits of Anaheim be transferred
to the City of Anaheim.
c. Commencing with the first year that the
reorganization is effective for property tax purposes as provided
in Government Code Section 54962, all property tax revenues which
would have been allocated to Garden Grove Sanitary District from
the area in the corporate limits of Anaheim, had it remained in
the District, shall be allocated to the City of Anaheim.
d. Commencing with the first years that the
reorganization is effective for property tax purposes as provided
in Government Code Section 54962, all property tax revenues which
would have been allocated to Stanton County Water District from
the area in the corporate limits of Anaheim had it remained in the
District, shall be allocated to the City of Anaheim.
e. Funds accumulated in reserve by the Garden Grove
Sanitary District for the purpose of capital improvements or
maintenance thereof shall be allocated to the City of Anaheim
based on the proportion of property tax revenues generated within
the City of Anaheim and allocated to the District as a percentage
of the total property tax revenues of said District.
f. Funds accumulated in reserve by the Stanton County
~-~- Water District for the purpose of capital improvements or
maintenance thereof shall be allocated to the City of Anaheim
based on the proportion of property tax revenues generated within
the City of Anaheim and allocated to the City of Anaheim based on
the proportion of property tax revenues generated within the City
of Anaheim and allocated to the District as a percentage of the
total property tax revenues of said District.

g. That upon completion of said reorganization
detaching territories within the City of Anaheim from the Garden
Grove Sanitation District and the Stanton County Water District,
said territories be relieved from liability for payment of all or
any part of principal or interest or any other amounts which may
be due or become due on account of all or any part of any bonded
indebtedness, contracts, or obligations, including, but not by way
of limitation, any judgment or judgments against Garden Grove
Sanitary District and Stanton County Water District, and that said
territories be relieved from the levying or fixing and the
collection of any taxes or assessments as may be made for the
payment thereof.
h. That the City of Anaheim be granted certain capacity
rights pertaining to the transfer of sewage from City facilities
through facilities owned and operated by the Garden Grove Sanitary
District for the purpose of disposal into Orange County Sanitation
District Facilities in the amount of 3.4 million gallons per day.
i. That the City of Anaheim be granted certain capacity
rights pertaining to the transfer of sewage from City facilities,
through facilities owned and operated by the Stanton County Water
District for this purpose of disposal into Orange County
Sanitation District Facilities in the amount of 1.8 million
gallons per day.
6. That the City Manager, or his authorized representative,
is hereby authorized and directed to file, on behalf of the City
Council, an appropriate application with the Local Agency
Formation Commission requesting said reorganization.
7. That the Maintenance Department of the City of Anaheim is
hereby directed to prepare a map and legal description of the
territory proposed to be detached from the Garden Grove Sanitary
District and the Stanton County Water District.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of July, 1985.
