RESOLUTION NO. 6711\-541 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANC$ NO. 1907 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zqning variance from EMMA M. PELLEW, owner of certain real property situated in ithe City of Anaheim, County of Orange, State of California, desc~ibed as follows: The northwest quarter of the no~thwest quarter of the northeast quarter of Section 13, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, County of Orange, State of California, as per Il~p recorded in Book 51, page 10 of Miscellaneous Maps in the office of the County Recorder of said County. Except that portion thereof lying northerly of the following described line: Beginning at a point on the westerly line of said northwest quarter of the north- west quarter, South 00 58' 58N West 68.66 feet from the northwest corner thereof; t4ence South 890 01' 02N East 57.00 feet; thence North 390 03' 46" East 36.38 feet to a line parallel with and southerly 40.00 feet from the northerly line of said section; thence South 890 00' 14" East 276.00 feet alQng said parallel line; thence South 780 47' 59a East 101.61 feet; thence South 840 45' 20" East 227.02 feet to the easterly line of said northwest quarter of the northwest quarter. .,..~ AND WHEREAS, the city Planning Co~ssion did hold a public hearing at the City Hall in the" City of Anaheim upon said petition on August 28, 1967 , notice of whi.ch said publi.c hearing was duly given as required by law and ~he provisions of Title .18, Chapter 18.76 of the AnahelLm Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt R~solution No. PC67-l94 recommending that Variance No. 1907 be granted, subject to the conditions therein set forth ; and , -1- - .-. --- WHEREAS, thereafter, withi:Q. twenty-two (22) days from the date of the adoption of said resQlution, the City Council did elect, upon its own motion, to r~view the action taken by the City Planning Commission in gr~ting said variance and did set a public hearing thereon to ije held on the 26th day of se~ember , 19 67 , at 1:30 o'clock P.M. in the City Hall in e City of Anaheim and notiQe of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or e~traordinary circum- stances or conditions appl~cable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same v~cinity and zone. 2. That such a variance is nec~ssary for the preser- vation and enjoyment of a $ubstantial property right possessed by other pItoperty in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESO~VED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the property hereinbefore described to be subdivided into thirty-nine (39) R-l lots, with a waiver of the minimum front yard setback requirement (Section 18.24.030(1-a) of the Anaheim Municipal Code), and a waiver of ainimum lot width requirement (Section 18.24.030(4-a) of the Anaheim Municipal Code), subject to the following conditions: 1. That this variance is granted subject to the com- pletion of Reclassification Proceedings No. 67-68-15 now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No.1"; PROVIDED, HOWEVER, that a maximum of 25% of the lots, exclusive of the cul-de-sac lots, may be developed with a 20-foot setback. The City Council hereby re$erves the right to revoke such variance permit for good cause or failure of said owner, her heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein.
