A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF l'.NAHEI.M GRANTING VARIANCE NO. 1906
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zbning variance from JAMES
E!~ll, owner of certain real property situated in the City of
Anaheim, County of Orange, State of California, described as
follows:
The southerly 129.25 feet of the easterly 259.00 feet
of that portion of the southeast quarter of Section 34,
Township 3 South, Range 10 We$t, in the Rancho San
Juan Cajon de Santa Ana, partly in the City of Anaheim,
and partly in the City of Fullerton, in the County of
Orange, State of California, as said section is shown
on a map recorded in Book 51, page 7 of Miscellaneous
Maps, in the Office of the County Recorder of said
County, described as follows:
Beginning at a point North 1001.50 feet from the
southeast corner of said southeast quarter; thence
North 318.50 feet; thence West 676.50 feet; thence
South 318.50 feet; thence East 676.50 feet to the
point of beginning.
Said land is included within the area shown on a map
filed in Book 59, page 18 of Record of Surveys, in
the office of said County Rec~rder.
AND WHEREAS, the City Plan~ing Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on August 14, 1967 , notice of which said public
hearing was duly grvenas required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
~VHEREAS, said City Planning Commission, after due
inspection, investigation and studieS made by itself and in its
behalf, and after due consideration ~f all evidence and reports
offered at said hearing, did adopt Resolution No. PC67-183
recommending that Variance No. 1906 be granted, subject to
the conditio~s therein set forth; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action taken by
the City Planning Commission in grantint said variance and
did set a public hearing thereon-t:o be he d on the 26th day
of Se~tember , 19 67 ,at 1:30 o'clock P.M. in the City
Hall in the City of Anaheim and notice of such public hearing
was duly given as required by law and the Provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and

NHEP-EAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:

1. There are exceptional or e~traordinary circum-
stances or conditions applicable to the property
involved or to the intende~ use of the property
that do not apply g"enerally to the property or
class of use in the same vicinity and zone.
2. That such a variance is ne~essary for the preser-
vation and enjoyment of a $ubstantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
questior..
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property ~r improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not adversely
affect the comprehensive general zoning plan.
NOW, 'rHEREFORE, BE IT RESOl,VED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permittin9 the establishment of an
existing optical service as a conforming use in an M-l, Light
Industrial Zone (Section 18.52.020 of the Anaheim Municipal Code),
on the property hereinbefore described, subject to the following
conditions:
1. That the owner of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot,
along RaYmond and Kimberly Avenues, for street
lighting purposes.
2. That the owner of subject property shall deed to
the City of Anaheim a IS-foot radius corner return,
at the southwest corner of Raymond and Kimberly
Avenues, for street widenimg purposes.
3. That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of the
Director of Public Works and Superintendent of
streets, prior to final building inspection.
4. That Conditions Nos. 1 and 2 above-mentioned shall be
complied with prior to the issuance of a building
perini t or within a period of 180 days from date hereof,
whichever occurs first, or such further time as the
City Council may grant.
5. That subject property shall be developed SUbstantially
in accordance with plans and specifications on file
T,'lith the City of Anaheim, marked "Exhibit 1. I,

The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
his heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the conditions herein. Said
variance is granted for the term prescribed by the Anaheim
Hunicipal Code unless othenvise specified herein.
