1967-478 ""'""" ,"-- RESOLUTION NO. 67R- 478 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRI- TORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE WAlli~ER-LM4BERT ANNF:XA'T'TON DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OWNING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim did on the 1st day of Augvst , 19~, receive a written petition asking that certa1n new territory described in said petition be annexed to the City of Anaheim; and WHEREAS, prior to the circu;Lation or filing of said petition, notice of intention to annex said territory, contain- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission; and WHEREAS, said Local Agency Formation Commission has rendered its decision, as provided in Section 54797 of the Government Code, approving said annexation; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is uninhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council finds from evidence and reports received that at the time of the filing and receipt of said petition, it was and now is signed by owners of not less than one-fourth (1/4) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and WHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was uninhabited and is contiguous to the City of Anaheim; and ,---.... ~VHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: -1- .-....< - - - - - - ~- - - - - -- -~----------- PROPOSED WARNER LAMBERT ANNEXATION TO THE CITY OF ANAHEIM ..-.... ,I"" That parcel of land located in the County of orange, State of California, described as follows: Beginning at a point in the existing City Limit line of the City of Anaheim, as established by the Northeast Annexation No. 3 to the City of Anaheim passed by Ordinance No. 1542, January 17, 1961, filed with the Secretary of State July 10, 1964 and recorded July 17, 1964 in the office of the County Recorder of Official Records of Orange County, California, said point of beginning being the Southeast corner of the land conveyed to George Albertus Collman and Mary F. Collman, hus- band and wife, by deed recorded May 22, 1951 in Book 2191, page 307 of Official Records of orange County, California, said point of beginning being distant the following courses and distances from the centerline intersection of orangethorpe Avenue and Taylor Street, South 00 27' 00" East 2,288.83 feet, more or less, South 800 59' 47" East 1057.64 feet, more or less, South 760 29' 49" East 52.24 feet, more or less, as said intersection is shown on a Record of Survey filed in Book 37, page 25 of Record of Surveys in the office of the County Recorder of Orange County, California; thence 1. South 760 30' East 1,316 feet, more or less, along a portion of the said existing City Limit line of the City of Anaheim to the Southeast corner of that certain parcel of land con- veyed to F. E. Campbell and Gladys Campbell, husband and wife, by deed recorded June 27, 1957 in Book 3955, page 279 of Official Records of Orange County, California; thence 2. North 00 25' West 2,360 feet, more or less, along a portion of the said existing City of Anaheim City Limit line, also being the East line of the land conveyed to said F. E. Campbell and wife, and the Northerly prolongation thereof to an inter- section with the Southerly right of way line of the Atchison, Topeka and Santa Fe Railroad (50 feet wide), as shown on a Record of Survey filed in Book 37, page 25 of Record of Sur- veys in the office of the County Recorder of said Orange County, California; thence 3. North 810 29' 00" West 1,297.95 feet, more or less, along the Southerly line of the land conveyed to said Warner-Lambert Pharmaceutical Company and the Northwesterly prolongation thereof to the Southeast corner of that certain parcel of land conveyed to Leon F. Boisseranc by deed recorded March 3, 1939 in Book 982, page 405 of Official Records of orange County, California; thence 5. North 810 28' 45" West 1,164.04 feet, more or less, along the South line of the land conveyed to said Leon F. Boisseranc and the Northwesterly prolongation thereof to the Southeast corner of that certain parcel of land described in the decree of distribution to the Heirs of Savina N. Peralta, recorded August 1, 1966 in Book 8006, pages 115, 116 and 117 of Offi- cial Records of Orange County, California; thence 6. South 880 33' 23" West 72.41 feet, more or less, along the South line of the last mentioned parcel of land to an inter- section with the Easterly line of that certain parcel of land described as Parcel Three in the deed recorded May 22, 1962 in Book 6116, page 845 of Official Records of orange County, California; thence 7. South 00 25' 00" East 230.10 feet, more or less, along a portion of the East line of the last mentioned parcel of land to the Southeast corner thereof; thence 8. North 750 21' 00" West 1,252.25 feet, more or less, along the South line of the land described in Parcel Three in the last mentioned deed and the Northwesterly prolongation thereof to the Southeast corner of that certain parcel of land des- cribed in quitclaim deed recorded March 19, 1956 in Book 3441, page 302 of Official Records of Orange County, Cali- fornia; thence 9. North 750 14' 48" West 1,165.12 feet, more or less, along the Southerly line of the land described in said quitclaim deed and the Northwesterly prolongation thereof to the Southwest Page 3 . .. North 00 27' 00" West 439.13 feet, more or less, along the West line of the last mentioned parcel of land to an inter- section with the Northwesterly prolongation of the Southerly line of the land conveyed to the aforementioned George Albertus Collman and wife, by deed recorded May 22, 1951 in Book 2191, page 307 of Official Records of Orange County, California, said point of intersection also being in the existing City of Anaheim City Limit line as established by the aforementioned Northeast Annexation No.3; thence 11. South 800 59' 47" East 1,057.64 feet, more or less, South 760 29' 49" East 52.24 feet, more or less, along the said Northwesterly prolongation and the Southerly line of the land conveyed to the said George Albertus Collman and wife, also being a portion of the said existing City Limit line of the city of Anaheim, to the point of beginning. ,..--, Page 4 - NOW~ THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that such proposed annexation be designated as WARNER-LAMBERT ANNEXATION and that notice of such proposed annexation be hereby given as hereinafter provided. ~" BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have petitioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section ,,3D of the Government Code. AND BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their con- sents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 3rd day of Octobef 1 96...L-, at the hour of 1:30 , oDclock P. M., at the City Counc1.l Chaiii'l:>er in the City Hall of the City o-rAnaheim be, and the saine is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real pro- perty within the territory proposed to be annexed; and that at any time before the closing of said hearingon protests, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit~ The Anaheim Bulletin of Anaheim, Orange County, California~ and also in a newspaper of general circulation, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit ~. The placentia Courier ; and that such pub- lication shall be completed at least twenty (20) days prior to the date of hearing hereinabove specified. ,..,-- AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized ,and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said asses,sinent roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County.
