A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ANAHEIM CREATING
UNDERGROUND DISTRICT NO. 4 (LA
PALMA AVENUE - PHASE 1).
WHEREAS, a public hearing was held by the City Council of
the City of Anaheim on June 2, 1992, at the hour of 6:00 p.m., to
ascertain whether the creation of an undergrounding district
within a designated area of the City would further the public
health, safety and welfare by promoting one or more of the
purposes set forth in Section 17.24.020 of the Anaheim Municipal
Code; and
WHEREAS, notice of the time and place of such hearing was
provided by the City Clerk by mail to all affected property
owners as shown on the last equalized assessment roll and
affected utility companies at least ten days prior to the date of
the hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ANAHEIM AS FOLLOWS:
1. The City Council hereby finds and determines that the
creation of an undergrounding district within the area set forth
on the map entitled "Underground District No. 4 (La Palma Avenue
- Phase 1)", a copy of which is attached to this Resolution as
Exhibit "A" and incorporated herein as though set forth in full,
will further the public health, safety and welfare by promoting
one or more of the Durposes set forth in Section 17.24.020 of the
Anaheim Municipal Code.
2. Pursuant to Section 17.24.060 of the Anaheim Municipal
Code, the city Council hereby declares the above-described area
to be an underground utility district, to be known as Underground
District No. 4 (La Palma Avenue - Phase 1).
3. The City Council does hereby fix January 18, 1993, as
the date on which affected property owners must be ready to
receive underground service, and does hereby order the removal
and underground installation of overhead facilities, as defined
in Subsection .060 of Section 17.24.010 of the Anaheim Municipal
Code, within Underground District No. 4 (La Palma Avenue - Phase
1) on or before February 1, 1993.
4. The City Council hereby finds and declares that the
undergrounding within Underground District No. 4 (La Palma
Avenue - Phase 1) will avoid or eliminate a heavy concentration
of overhead distribution and transmission facilities up to 69 kV
and that the streets and rights-of-way within Underground
District No. 4 (La Palma Avenue - Phase 1) are extensively used
by the general public and carry a heavy volume of vehicular
traffic.
5. The city Council hereby requests that all utilities
which provide service within Underground District No. 4 (La Palma
Avenue - Phase l) underground up to one hundred (100) feet of
each property owner's service lateral at the utility's expense in
accordance with the provisions of that utility's applicable rule
on file with the Public Utilities Commission.
6. The City Clerk is hereby directed to notify all
affected utilities and all persons owning real property within
Underground District No. 4 (La Palma Avenue - Phase l) as
provided in Section 17.24.090 of the Anaheim Municipal Code.
THE FOREGOING RESOLUTION is approved and adopted by the
