A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANC~ NO. 1892
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zoning variance from

o certa1n real property s1tuated 1n he C1ty of Anahe1m, County
of Orange, State of California, described as follows:
Portion 1
A portion of Lot 1 of Tract No. 1054, in the City of
Anaheim, County of Orange, State of California, as shown
on a map recorded in Book 34, Page 10 of Miscellaneous
Maps, in the office of the County Recorder of said County,
described as follows:
Beginning at the southwest corner of Lot 8 of Tract No.
1602, as shown on a map recorded in Book 46, page 50 of
Miscellaneous Maps, in the offic~ of the county Recorder
of said County; thence North 750 22' 03" East, 122.00
feet along the South line of Lot 8 and 7 of said Tract
No. 1602, to the southeast corner of said Lot 7; thence
South 150 27' 55t1 East, 92.25 feet parallel with South
Lemon Street, as shown on said map of Tract No. 1054;
thence South 740 22' 03" West 122.00 feet, parallel with
the South line of said Tract No. 1602 to the East line of
Lemon Street; thence North 150 27' 5511 West 92.25 feet
along said East line of Lemon Street to the point of be-
ginning.

of said County; thence South 150 27' 5511 East, 92.25 feet
parallel with South Lemon Street, as shown on said map of
Tract No. 1054, to the true point of beginning; thence
North 740 22' 03" East, 122.00 feet, parallel with the
South line of said Tract No. 1602; thence South 150 27'
55" East, 27.75 feet; thence South 740 22' 03" West,
122.00 feet to the East line of Lemon Street; thence North

AND WHEREAS, the City Plann~ng Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
petition on July 17, 1967 , notice of which said public
hearing was duly given as required by law and the provisions of
Title 18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No. PC67-l64
recommending that Variance No. 1892 ~e granted, subject to
certain conditions therein set forth ; and
WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to r~view the action taken by
the City Planning Commission in granting said variance and
did set a public hearing thereon to Be held on the 1st day
of August , 1967 , at 7:00 o'clock P.M. in the City
Hall in the City of Anaheim and notioe of such public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:
1. There are exceptional or e~traordinary circum-
stances or conditions applicable to the property
involved or to the intende~ use of the property
that do not apply generally to the property or
class of use in the same vicinity and zone.
2. That such a variance is necessary for the preser-
vation and enjoyment of a substantial property
right possessed by other property in the same
vicinity and zone and denied to the property in
question.

3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
That the granting of such variance will not adversely
affect the comprehensive general zoning plan.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby granted permitting a waiver of the minimum

front yard setback requirement (Section l8.24.030(lOa) of the
Anahe~ Municipal Code) on Portion No. 1 of the property here-
inbefore described; a waiver of the m imum eave ro'ection
(Section l8.04.090(2~c) of the Anahei Munic~pal Code) on said
Portion No. 1 of the hereinbefore des~ribed property; and
a waiver of the minimum lot width re irement (Section
18. 8.050l-b of the Anahe~m Municipl Code on Portions Nos.
2 and 3 of the property hereinbefore ~escribed, subject to the
following conditions:
1. That the owner of subject p~operty shall deed to
the City of Anaheim a strip of land 32 feet in
width, from the center line of the street, along
Lemon Street, for street wi~ening purposes.
2. That the owner of subject p~operty shall pay to
the City of Anaheim the sum of $2.00 per front
foot, along Lemon Street, f~r street lighting
purposes.
3. That the owner of subject property shall pay to
the City of Anaheim the sum of 15<: per front foot
along Lemon Street, for tree planting purposes.
4. That a Parcel Map to record the approved division
of subject property shall b~ submitted to the City
of Anaheim for approval, an~ then recorded in the
Office of the Orange County Recorder, prior to
final building and zoning inspections.
5. That sidewalks shall be installed along Lemon Street,
as required by the City Englneer, and in accordance
with standard plans and spe~ifications on file in
the Office of the City Engineer, prior to final build-
ing and zoning inspections.
6. That the curbs and gutters shall be repaired along
Lemon Street, as required bV the City Enqineer and
in accordance with standard plans and specifications
on file in the Office of the City Engineer, prior to
final building and zoning inspections.
7. That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of the
Director of Public Works and Superintendent of Streets,
prior to final building and zoning inspections.
8. That the owner of subject property shall pay to the
City of Anaheim the sum of $25.00 per dwelling unit,
to be used for park and recreation purposes, said
amount to oe paid at the time the ouilding permit is
issued.
9. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. 1 and 2.

10. That Conditions Nos. 1, 2 and 3 above-mentioned shall
be complied with prior to the time the building permit
is issued, or within a period of 180 days from date
hereof, whichever occurs first, or such further time
as the City Council may grant.

The City Council hereby reseirves the right to revoke
such variance permit for good cause or failure of said owner, his
heirs, successors or assigns, to comp~y with the Anaheim Municipal
Code and regulations and the conditions herein. Said variance
is granted for the term prescribed by the Anaheim Municipal
Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is signed and approved by me
this 1st day of August, 1967.
