RESOLUTION NO. q7R-428
A RESOLUTION OF THE CITY CqUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANqE NO. 1894 .

WHEREAS, the City Planning Commission of the City of
Anaheim did receive a petition for zdning variance from
ANGELO ZABY, owner . '
of certain real property situated in !the City of Anaheim, County
of Orange, State of California, desc~ibed as follows:
The Northerly 265 feet of the Westerly 460
feet of the Northwest quarter of the Northwest
quarter of the Northeast quarter of Section 27,
Township 4 South, Range lOWest, in the Rancho
San Juan Cajon de Santa Ana, as shown on a Map
recorded in Book 51, page 10 of Miscellaneous
Maps, records of Orange County, California.
EXCEPTING THEREFROM the North 190 feet of the
West 220 feet thereof.
AND WHEREAS, the City Planqing Commission did hold a
public hearing at the City Hall in t~e City of Anaheim upon said
petition on Julv 6, 1967 ,notice of which said public
hearing was duly given as required b~ law and the provisions of
Title 18, Chapter 18.76 of the Anahe~m Municipal Code; and
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in its
behalf, and after due consideration of all evidence and reports
offered at said hearing, did adopt Resolution No.PC67-l48 Bee,..
*~ , recommending that Va~iance No. 1894 be denied

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council of the City of Anaheim protesting
the action of the City Planning Commission denvinq said
variance, and said appeal was set for public hearing on
~gust S ' 19 67 , at 7:00 oUc1ock P.M. at the City
. 1 in t e City of Anaheim, and noti.ce of such public hearing
was duly given as required by law and the provisions of Title 18,
Chapter 18.76 of the Anaheim Municipal Code; and

WHEREAS, after due investigation and studies made by
itself and in its behalf, and after due consideration of all the
evidence and reports offered at said hearing, the City Council
does find and determine that:

There are exceptional or extr~ordinary circum-
stances or conditions applic~le to the property
involved or to the intended u~e of the property
that do not apply generally t~ the property or
class of use in the same vicinity and zone.

2. That such a variance is neces~ary for the preser-
vation and enjoyment of a sub$tantial property
right possessed by other prop~rty in the same
vicinity and zone and denied to the property in
question.
3. That the granting of such variance will not be
materially detrimental to the public welfare or
injurious to the property or improvements in such
vicinity and zone in which the property is located.
4. That the granting of such variance will not
adversely affect the comprehemsive general zoning
plan.
NOW, THEREFORE, BE IT RESOLVEW by the City Council of the
City of Anaheim that a conditional zonimg variance be, and the same
is hereby granted permitting the expansion of an existing free-
standing sign, with a waiver of the maximum area limitation of a
free-standing sign (Section 18.62.090(4~a) of the Anaheim Municipal
Code}, on the property hereinbefore described, subject to the
following condition:
That subject property shall be developed
substantially in accordance with plans and
specifications on file with the City of
Anaheim, marked Exhibits Nos. 1 and 2.
The City Council hereby reserves the right to revoke
such variance permit for good cause or failure of said owner,
his heirs, successors or assigns, to comply with the Anaheim
Municipal Code and regulations and the condition herein. Said
variance is granted for the term prescribed by the Anaheim
Municipal Code unless otherwise specified herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 1st day of August, 1967.
