A RESOLUTION OF THE CITY CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING REIMBURSEMENT OF
THE CITY FROM THE PLANNED LOCAL DRAINAGE
FACILITIES FUND FOR THE FAIRMONT BOULEVARD
DRAINAGE REIMBURSEMENT AREA RELATING TO THE
COST OF DRAINAGE FACILITIES CONSTRUCTED BY THE
CITY WITHIN SAID DISTRICT.
WHEREAS, on January 15, 1974, by Resolution No. 74R-11,
the City Council duly adopted the Master Plan for Drainage for the
City of Anaheim, which Plan established particular drainage areas
specified therein; and
WHEREAS, Section 17.08.400 of the Anaheim Municipal Code,
adopted pursuant to the authority of Section 66483 of the
Government Code, requires subdividers or developers of property
within said drainage areas to pay certain drainage fees in such
amounts as established by Resolution of the City Council; and
WHEREAS, on July 26, 1977, the City Council adopted
Resolution No. 77R-532 establishing drainage fees for the Fairmont
Boulevard Drainage Reimbursement Area as described therein
(hereinafter "Fairmont Area"); and
WHEREAS, the City of Anaheim has heretofore collected
drainage fees from subdividers or developers of property within
said Fairmont Area; and
WHEREAS, the City of Anaheim has heretofore constructed
certain drainage facilities ("facilities") as shown on the Master
Plan of Drainage for the Fairmont Area at a total cost to City of
$195,840.52; and
WHEREAS, Section 66483 of the Government Code authorizes
the City to be reimbursed for the cost of such facilities from the
Planned Local Drainage Facilities Fund for the Fairmont Area
("Fund"); and
WHEREAS, no other reimbursement agreements are currently
existing which would constitute obligations or debts payable from
such Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
..,.,..... City of Anaheim that the appropriate City officers and employees
are hereby authorized and directed to reimburse to the City the
sum of $195,840.52 from the Planned Local Drainage Facilities Fund
for the Fairmont Boulevard Drainage Reimbursement Area.
BE IT FURTHER RESOLVED that tYie reimbursement to City
herein directed shall constitute an encumbrance upon said Fund
superior to any reimbursement agreement or other obligation
hereinafter entered into or accruing.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of September, 1985.
