A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 3477
(REHEARING).
WHEREAS, after a request for variance by HABIB
MANSOURI-FAR and JOSEPH N. MAKABI, owners, and CHARLES A. ROSS,
agent, to construct a one and two story 22-unit apartment
complex, was received, a public hearing before the Planning
Commission of the City of Anaheim was held upon due and proper
notice, a result of which Variance No. 3477 was forwarded to the
City Council without recommendation pursuant to Anaheim Municipal
Code Section 18.03.070.020 covering the following described
property:
THAT PORTION OF THE EAST HALF OF THE SOUTHWEST QUARTER
OF THE SOUTHWEST QUARTER OF SECTION 14, IN TOWNSHIP 4
SOUTH, RANGE 11 WEEST, IN THE RANCHO LOS COYOTES,
COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A
MAP THEREOF RECORDED IN BOOK 51 PAGE 11, OF
MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY,
DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF THE SOUTHWEST
QUARTER OF SAID SECTION 14, BEING THE CENTER LINE
INTERSECTION OF BALL ROAD (60.00 FEET WIDE) AND WEST
1326.33 FEET ALONG THE SOUTH LINE OF SAID SOUTHWEST
QUARTER OF SECTION 14 TO THE TRUE POINT OF BEGINNING;
THENCE NORTH 0 DEGREES 15 MINUTES 13 SECONDS WEST
375.00 FEET; THENCE SOUTH 89 DEGREES 37 MINUTES 25
SECONDS WEST 100.00 FEET; THENCE SOUTH 0 DEGREES 14
MINUTES 48 SECONDS EAST 375.00 FEET TO THE SAID SOUTH
LINE OF THE SOUTHWEST QUARTER OF SECTION 14; THENCE
ALONG SAID SOUTH LINE NORTH 89 DEGREES 37 MINUTES 25
SECONDS EAST 100.04 FEET TO THE TRUE POINT OF
BEGINNING; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council did deny said application; and
.~... WHEREAS, thereafter, within the time provided by law,
the applicant did request a rehearing on said application and the
City Council did grant said request and conducted said rehearing
as prescribed by law and, as a result thereof, the City Council
does hereby make the following findings:
1. That there no special circumstances applicable to the
property which do not apply to other property in the same vicinity
and zone.
2. That strict application of the zoning code does not
deprive the property of privileges enjoyed by other property in
the same vicinity and zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said Variance be, and the same is hereby,
denied.
BE IT FURTHER RESOLVED that the time within which
rehearings must be sought is governed by the provisions of Section
1.12.100 of the Anaheim Municipal Code and the time within which
judicial review of final decisions must be sought is governed by
Section 1094.6 of the Code of Civil Procedure and Anaheim City
Council Resolution No. 79R-524.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 1 t day of October, 1985.
