A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PIPELINE EASEMENT BETWEEN
ORANGE STREET AND OLIVE STREET. (84-20A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 15th day of October, 1985, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that certain
pipeline easement, more specifically described as follows:
An easement for a concrete pipe line as conveyed to
Anaheim Union Water Company, by deed recorded
November 30, 1934 in Book 716, page 355, Instrument
Number 29575 of Official Records over the northerly
line of the following described property:
All that certain land situated in the State of
California, County of Orange, City of Anaheim,
described as follows:
Vineyard Lot H-2 of Anaheim, as shown on a Map
recorded in Book 4, page 629 and 630 of Deeds of Los
Angeles County, California, together with the south
one-half of that portion of the alley adjoining said
Lot H-2 on the north, abandoned by that certain
Resolution No. 71R-547 of the City Council of the
City of Anaheim, a certified copy of which was
recorded January 6, 1972 in Book 9957, page 175 of
Official Records of Orange County, California,
bounded westerly by the northerly prolongation of the
easterly line of the land described in deed to the
City of Anaheim recorded February 24, 1914 in Book
250, page 110 of Deeds, records of said Orange County
and bounded easterly by the southerly prolongation of
the easterly line of Lot 2 in Block C of the
Resubdivision of Theodore Reiser's Subdivision, as
shown on a Map recorded in Book 1, pages 10 and 11 of
Miscellaneous Maps, records of said Orange County.
~-- Excepting therefrom that portion included within the
land described in deeds to the City of Anaheim
recorded February 24, 1914 in Book 250, page 110 and
April 3, 1912 in Book 210, page 254, both of Deeds,
records of said Orange County.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange at such time as all of the following
conditions precedent to said vacation have been fulfilled:
1. Dedication of alternative easements for drainage.
2. Installation of, and acceptance by, the City of
Anaheim, of a new storm drain facility.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of October,
1985.
