RESOLUTION NOo 67R-426
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DE~ERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIP~ CODE RELATING TO
ZONING SHOULD BE AMENDED }4ND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHdULD BE CHANGEDo
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed ~nd adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a tune and place for the holding of a public hearing
thereon in the manner and as prescribed in Title 18 of the
Anaheim Municipal Code, and after having duly held and conducted
such public hearing to consider said proposed change of zone
or zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty (40) days following
the hearing thereon, the Planning Commission did duly announce
by formal resolution its findings of facts and declare its
opinions and reasons for recommending denial of said proposed
change in the boundaries of the zone or zones hereinafter
mentioned and described; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning C01IlIlission, the City .council did fix the 13th day)f
June , 19 67 , as the time, and the City Council Chambers
in the City Hall in the City of Anaheim as the place for a public
hearing upon said proposed amendment to Title 18 of the Anaheim
Municipal Code, and the exclusion of said property, hereinafter
described, from the zone in which it is now situated and the
incorporation thereof in the zones hereinafter set forth; and did
give notice thereof in the manner and form as provided in said
Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at said public
hearing before the Planning Commission, its report of findings
and recommendations; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
b~ adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW OJ THEREFORE~ BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that all of the property
and area situated in the City of Anaheim, County of Orange,
State of California, described as follows~

The South 140 feet of the East one-half of the Northeast
quarter of the Southeast quarter of Section 14, in Town-
ship 4 South, Range 11 West, in the Rancho Los Coyotes,
in the City of Anaheim, as shmvn on a map thereof recorded
in Book 51, page 7, et seq., Miscellaneous Maps, records
of said Orange County;
EXCEPTING THEREFROM the Easterly 40 feet of said land, as
conveyed to the State of California, by Deed recorded
March 5, 1951, in Book 2153, page 254, Official Records,
and by deed recorded March 1, 1951, in Book 2151, page 460,
Official Records.
be excluded from R-A, AGRICULTURAL ZONE, and incorporated in
R-3, MULTIPLE-FA~rrLY RESIDENTIAL ZONE, upon the following
conditions:
1. That the extension of Hayward Street be dedicated
to the City of Anaheim, from its present terminus,
at the south property line, to the north property
line, for the full width of the street as it now
exists to the south of subject property.
2. (a) That all engineering requirements of the City of
Anaheim along Beach Boulevard and Hayward Street, as
extended, including preparation of improvement plans
and installation of all improvements, such as curbs
and gutters, sidewalks, street grading and paving,
drainage facilities, or other appurtenant work shall
be complied with as required by the City Engineer
ane. in accordance with standard. plans and specifica-
tions on file in the Office of the City Engineer; and
(0) that a bond in an amount and form satisfactory
to the City of ili~aheim shall be posted with the City
to guarantee the installation of said engineering
requirements.
3. That a line be drawn through subject property from
the north to tne soutll on an extension with the
rear line (eas~of the residential tract to the
south; that the property be identified as Lot ~A"
'Vlest of lIayward Street, as extended, Lot "B It immedi-
ately east of Hayward Etreet, as extended, and
Lot tiC'i east of Lot "B, 11 anCL be so designated on a
parcel r::'"ap.
4. That all vehicular access rights to Hayward Street,
as extended, from Lots "B" and "e" be dedicated
to the City of AnaheiIE.
j. That the property identified D.S Lot ;lC' may be
developed. as a re':fular t'i.llo-story R-3 development,
and the lots iCientified as li]\!l and llBt: may be
developed as single-story R-3 lots.

6. That the owner of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot,
along Beach Boulevard and Hayward Street, as
extended, for street lighting purposes.

7. That the owner of subject property shall pay to the
City of Anaheim the sum of l5~ per front foot,
along Beach Boulevard and Hayward Street, as
extended, for tree planting purposes.
8. That the owner of subject property shall deed
to the City of Anaheim an easement for storm
drain purposes over the southerly ten (10) feet
of the easterly 435 feet of subject property;
and a IS-foot temporary easement for construction
purposes adjacent to and northerly of the above-
mentioned storm drain easement.
9. (a) That said storm drain and related facilities
shall be installed from Beach Boulevard to Hayward
Street, as extended, as required by the City
Engineer and in accordance with Plan No. 6478 on
file in the Office of the City Engineer; and
(b) that a bond in an amount and form satisfactory
to the City of Anaheim shall be posted with the
City to guarantee the installation of said storm
drain. (c) That the City $hall contribute to the
cost of said storm drain the sum of $3,109.65,
plus one~half of the remainder of the cost of
construction of said storm drain.
10. That all air conditioning facilities shall be
properly shielded from view.
11. That Conditions Nos. 1, 2(b~6,7, 8 and 9(b) above-
mentioned shall be complied with within a period
of 130 days from date hereof, or such further time
as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and deter-
mined to be necessary and proper.
