A RESOLUTION OP '!'HE CITY . COUNCIL OP THE CITY
OP ANAHEIM GRANTING COHDXTIONAL USE PERMIT
NO. 2278 .
WHEREAS, the City Plannil11 Co~.s1on of the Cit~ of'
Anaheim did receive an application !for a conditional use p~rm1t
from SHIOW-ING LIN and FANG-LING $RACE LIAO, owners, to permit
a commercial use (doctor's office) of a residential structure
with waiver of the minimum number of off-street parking spaces
on certain real property located in the City of Anaheim, County
of Orange, State of California, legally described as:
LOT 2 OF TRACT NO. 2839, IN THE CITY OF ANAHEIM,
COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP
RECORDED IN BOOK 85 PAGES 9 10 15 INCLUSIVE OF
MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY
RECORDER OF SAID COUNTYr and

13. That Condition Nos. 1, 2, 3, 4, 5, 6, 10, 11 and 12, above-
mentioned, shall be complied with prior to the commencement of the
activity authorized under this resolution, or prior to the time that
the building permit is issued, whichever occurs first, or suoh fur-
ther time as the Planning Commission may grant.
~ 14. That Condition Nos. 7, 8, 9, above-mentioned, shall be
completed within a period of sixty (60) days of approval bYutj'he City
Councilor no later than April 17, 1982.

15. That no trucks, containers, or other vehicles that haul
or contain trash shall be permitted to be parked outside the peri-
meter of the yard.
16. That the eight foot (8') block wall shall be located with
an eighteen foot (18') front yard setb~ck, or not closer than thirty
feet (30') from the curbline.
17. That no structures shall be built in the required setback
area.
18. That berming and planting of magnolia trees shall be
accomplished in the front setback area as stipulated by the OWner.
BE IT FURTHER RESOLVED that the City Council of the City
of Anaheim does hereby find and determine that adoption ofth~~
Resolution is expressly predicated upon applicant's complianc~
with each and all of the conditions hereinabove set forth. Should
any such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent jur-
isdiction, then this Resolution, and any approvals herein contained,
shall be deemed null and void.
THE FOREGOING RESOLUTION is approved and adopted ~y the
City Council of the City of Anaheim this 16th day of February,
1982.

mIEREAS, the City Planning Commission did hold a p.blic
hearing upon said application at the City Hall in the City ot
Anaheim, notices of which public hearing were duly given as re-
quired hy law and the provisions of Title 18, Chapter 18.03 ~f the
Anaheim Municipal Code, and
WHEREAS, said Commission, after due inspection, investi-
gation and studies made by itself and in its behalf and aftet due
consideration of all evidence and reports offered at said hear1nq,
did adopt its Resolution No. PC81-2414, qrantina
Conditional Use Permit No. 2278 , and
mIEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a duly notiCed
public hearing, and
WHEREAS, at the time and pl_ce fixed for saiit publi!c
hearing, the City Council did duly ho~d and conduct such hea~ing
and did give all persons interested therein an opportunity td be
heard and did receive evidence and reports, and
mIEREAS, the City Council finds, after careful conSlider-
at ion of the recommendations of the City Planning Commission land
all evidence and reports offered at s$id hearing, that:
1. The proposed use is properly one fO. r which a condi~ional
use permit is authorized by the Anaheim Municipal Code.
2. The proposed use will not aqversely affect the adjo~ninq
land uses and the growth and development of the area in which it
is proposed to be located.
3. The size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a
manner not detrimental to the particular,area nor to the peace,
health, safety and general welfare.
4. The traffic generated by the proposed use will not ~m-
pose an undue burden upon the streets and highways designed and
improved to carry the traffic in the area.
5. The granting of the conditional use permit under the
conditions imposed will not be detrim~tal to the peace, health,
.afAty and general wellare of the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Comm~ssion

subject to the following conditions:
1. That the existing structure shall be brought up to the
minimum standards of the City of Anaheim, including the Unifcl>rm
Building, Plumbing, Electrical, Mechanical and Fire Codes as'
adapted by the City of Anaheim.
2. That the owners of subject p~operty shall pay the traf-
fic signal assessment fee (Ordinance Nb. 3896) in an amount as
determined by the City Council, for commercial buildings prior to
the issuance of a building permit.
3. That trash storage areas sha~l be provided in accordance
with approved plans on file with the Office of the Executive
Director of Public Works.
4. That subject property shall be developed substanti~lly
in accordance with plans and specifications on file with the iCity
of Anaheim marked Exhibit Nos. 1 and 2.
5. That Condition Nos. 1, 3 and 4, above-mentioned, shall be
complied with prior to final building and zoning inspections.
6. That not more than one physician shall be at work an
the premises at any time.
7. That said permit is hereby granted for a period of two
years and shall be reviewed at that time.
BE IT FURTHER RESOLVED that the City Council of the' City
of Anaheim does hereby find and determine that adoption of thiis
Resolution is expressly predicated upon applicant's complianc~
with each and all of the conditions hereinabove set forth. Should
any such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent juris-
diction, then this Resolution, and any approvals herein contained,
shall be deemed null and void.
