A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REVOKING AND TERMINATING CONDITIONAL
USE PERMIT NO. 2151.
WHEREAS, on December 15, 1980, the Anaheim City Planning
Commission did, by Resolution No. PC80 -238, grant Conditional Use
Permit No. 2151, subject to certain conditions therein specified; and
WHEREAS, on April 5, 1982, the Planning Commission did
hold a hearing on said matter and thereupon did adopt Resolution No.
PC82 -58 revoking its approval of Conditional Use Permit No. 2151; and
WHEREAS, within the time provided by law, said decision
was appealed to the City Council of the City of Anaheim; and
WHEREAS, on May 25, 1982, the City Council did conduct a
duly noticed public hearing pursuant to the provisions of Section
18.03.091 of the Anaheim Municipal Code to determine if the grounds
existed under the provisions of Anaheim Municipal Code Section
18.03.092.040 for the termination of Conditional Use Permit No. 2151
for exercising said permit contrary to the express terms or conditions
of approval; and
WHEREAS, after considering all of the evidence and
testimony offered at said hearing, the City Council does hereby find
that the permittee has exercised Conditional Use Permit No. 2151
contrary to the express terms or conditions of approval contained in
Resolution No. PC80 -238 as follows:
I. That permittee violated the permit which specified a
maximum number of fifteen (15) for -sale cars on the premises at any
one time by having as many as 25 vehicles for -sale on the premises at
one time.
2. That permittee violated the permit which specified that
all mechanical and related work shall be conducted wholly inside the
building by continually repairing vehicles outside the building.
3. That the use for which approval was granted has been so
exercised as to be detrimental to the public health or safety or so as
to constitute a nuisance by having an on -site camper being used as
living quarters, by parking for -sale cars on Lemon Street and La Palma
Avenue and on an adjacent commercial lot and by the reckless movement
of for -sale cars entering and exiting the site.
NOW, THEREFORE BE IT RESOLVED by the City Council of the
City of Anaheim that, for each of the reasons hereinabove specified,
Conditional Use Permit No. 2151 be, and the same is hereby, revoked
and Resolution No. PC80 -238 is hereby declared null and void.
BE IT FURTHER RESOLVED that the time within which judicial
review must be sought with regard to the revocation of Conditional Use
Permit No. 2151 is governed by the provisions of Section 1094.6 of the
{ Code of Civil Procedure of the State of California.
ti THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 25th day of May, 1982.
