1981-453 --- RESOLUTION NO. 81R-453 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A CERTAIN PUBLIC SERVICE EASEMENT LOCATED WEST OF B~CH BOULEVARD, SOUTH OF ORANGE AVENUE. ,.-..,.., " WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate cer- tain public streets, highways or publ~c service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law: and WHEREAS, on the 22nd day of September, 1981, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation: and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not re- served and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of that public utility easement, more specifically described as follows: All the right, title and interest in and to that certain easement acquired by the City of Anaheim, as successor in interest to Southern California Edison Company, who acquired title by an instrument recorded October 2, 1953, in Book 2587, page 189, Official Records of Orange County, California, said easement being more particu- larly described as follows: - An easement for an electric line, consisting of poles, necessary guys and anchors, cross-arms, wires and other fixtures and appliances, over the following described real property: The East 1/2 of the East 1/2 of the Southeast quarter of the Southeast quarter, and the East 8.00 feet of the West 1/2 of the East 1/2 of the Southeast quarter of the Southeast quarter, all of Section 14, Township 4 South, Range 11 West, S.B.B. & M. 81-1A -1- -- .--..,.,.-. - Excepting therefrom the North 385.00 feet. Also excepting therefrom the South 714.00 feet. Also excepting therefrom the East 40.00 feet thereof. ~. Said line of poles shall be erected and maintained within a 2.00-foot strip of land, the centerline of which is described as follows: A line parallel with and 12.00 f~et southerly, measured at right angles from the north l~ne of the above de- scribed parcel of land, said str~p of land to terminate westerly and easterly in the westerly and easterly bound- aries of said parcel of land. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange.
