A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R -600 AND
AMENDED BY RESOLUTION NOS. 73R -255, 73R -387, 73R -532, 74R -433,
75R -315, 75R -469, 75R -479, 76R -378, 78R -418, 78R -419, 78R -459,
79R -643, 80R -304, 81R -124, AND 81R -402.
WHEREAS, the City of Anaheim maintains a water distribution system
for the furnishing of water to residents and inhabitants of the City of
Anaheim and has adopted Water Rates, Rules and Regulations for the sale and
distribution of water; and
WHEREAS, it is the policy of the City Council that Anaheim's Water
Utility shall be self - supporting from charges made by the City for water fur-
nished to consumers and for services rendered in connection therewith; and
WHEREAS, the Public Utilities Board held a public hearing on June 17,
1982 and evidence was presented in connection with the proposed revisions of
water rates and fees; and
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the following findings:
1. The largest single item requiring a revenue increase considering the
test period of July 1, 1982 through June 30, 1983 is water supply at
an estimated $5,702,000.
2. Other operating expenses and capital expenditures estimated to cost
$12,432,000 are due to labor cost increases and higher material costs.
3. Debt service requirements and an increase in reserve amounts estimated
to cost $2,007,000 are required to meet financial reserves and re-
quirements.
4. The transfer to the general fund in an amount estimated to be $443,000
is authorized by the City Charter and constitutes an Intra -City
transfer.
5. The fee increases for temporary service, service connections, meter
installations, inspection services, plan check services, and primary
distribution main extensions are due to labor cost increases and
higher material costs.
6. The matters covered in 1 through 5 above come within Section 21080 (b)
(8) of the Public Resources Code of the State of California thus the
establishment of these rates are exempt from the California
Environmental Quality Act.
WHEREAS, a Notice of Hearing was published as follows:
1. On June 9, 10 and 11, 1982, notice of the public hearing on water
rates was published in the Anaheim Bulletin and proof thereof is on
file with the Secretary of the Public Utilities Board.
2. On June 9, 10 and 11, 1982, notice of the public hearing on water
rates was published in the Santa Ana Register and proof thereof is on
file with the Secretary of the Public Utilities Board.
3. On June 9, 10 and 11, 1982, notice of public hearing on water rates
was published in the Orange County Edition of the Los Angeles Times
and proof thereof is on file with the Secretary of the Public
Utilities Board.
WHEREAS, the Public Utilities Board has considered the proposal of
the Public Utilities Department and has considered the evidence presented at
the public hearing; and
WHEREAS, the Public Utilities Board has made the following findings
with respect to the need for an increase in the water rates:
1. The Water System revenue requirement of the Anaheim Public Utilities
Department will be established, as set forth below, on the basis of
projections for a Test Period consisting of the twelve months July 1,
1982 through June 30, 1983.
2. A reasonable estimate of the revenue requirement for water supply
costs for the test period is $5,702,000 as shown in Exhibit DLA -1.
3. A reasonable estimate of the revenue requirement for other operating
expenses for the test period is $4,999,000 as shown in Exhibit DLA -1.
4. A reasonable estimate of the revenue requirement for capital expendi-
tures for the test period is $7,433,000 as shown in Exhibit DLA -l.
5. A reasonable estimate of the revenue requirement for debt service and
reserve increases for the test period is $2,007,000 as shown in
Exhibit DLA -1.
6. A reasonable estimate of the revenue requirement for transfer to the
General Fund for the test period is $443,000 as shown in Exhibit DLA -1.
7. A reasonable estimate of the revenue requirement offsets due to other
water revenues and interest income for the test period is $8,423,000
as shown in Exhibit DLA -l.
8. A reasonable estimate of the revenue requirement due to working
capital increase for the test period is $425,000 as shown in Exhibit
DLA -1.
9. An estimated revenue requirement of $12,586,000 as set forth below, is
appropriate for the test period:

10. It is appropriate to perform a cost -of- service study in order to
determine the allocated revenue requirement for the test period for
the following customer classes: Single - Family Residential;
Multi- Family Residential; Residential Outside City; Commercial/
Industrial; Municipal; Irrigation; and Private Firelines.
11. The customer class revenue requirements as determined on the basis of
a cost -of- service analysis are shown in Exhibit RWE -3 and are appro-
priate. The estimated total allocated annualized revenue requirement
of $12,745,000 as set forth below includes $159,000 to provide for
revenue lag and is appropriate.

12. Section 1221 of the City Charter provides that utility rates charged
to a class of consumers shall be uniform within the class and shall be
based on cost -of- service for the class.
13. On the basis of the preceding finding, the class revenues under
the proposed rates as shown in Exhibit RWE -1 are reasonable and
appropriate:

14. Citizens are concerned about lifeline rates. As a result of
statements made by citizens at the public hearing, there is public
concern with respect to the current lifeline policy of electric rates
and interest in the possibility of establishing lifeline water rates.
WHEREAS, based on the findings hereinabove made, the Public Utilities
Board of the City of Anaheim recommended to the City Council that the Council
adopt the findings of the Public Utilities Board with respect to the matters
contained herein and adopt the water rates and fees as proposed and authorize
the Board to appoint an Ad Hoc citizens committee to study the lifeline
policies of the water and electric utilities.
WHEREAS, the City Council has considered the evidence and concurs
with the findings of the Public Utilities Board as set forth hereinabove.
NOW, THEREFORE BE IT RESOLVED that the findings of the Public
Utilities Board be, and they are hereby, adopted by the City Council of the
City of Anaheim.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim
that the Water rates, Rules and Regulations adopted by City Council Resolution
Nos. 72R -600 and amended by City Council Resolution Nos. 73R -255, 73R -387,
73R -532, 74R -433, 75R -315, 75R -469, 75R -479, 76R -378, 78R -418, 78R -419,
78R -459, 79R -643, 80R -304, 81R -124 and 81R -402 be amended as follows, to wit:

*By September 1 each year, beginning in 1974, the Utilities General Manager
shall place on file with the City Clerk a report showing the horsepower and
KWH consumption for each well pump and the LaPlama and Linda Vista Booster
pumps for the fiscal year just completed. This report shall be based on
data from the Monthly Pump Report prepared by the Water Engineering
Division and shall be adjusted for any electrical energy displaced by
use of natural gas or diesel fuel.

2) The pumping surcharge amount is then computed by dividing the cost
per A.F. by 435.6 hundred cubic feet per A.F. and this result divided
by the system loss factor as follows, for July 1, 1980:

3) The amount of the high elevation commodity adjustment and the data
elements required to compute the commodity adjustment shall be
shown in the HIGH ELEVATION PUMPING SURCHARGE SUMMARY Section each time
commodity adjustment is changed during the fiscal year.
E. APPLICATION OF HIGH ELEVATION PUMPING SURCHARGE
The high elevation pumping surcharge for all rate schedules shall be
adjusted as necessary by the Utilities General Manager to reflect the
pumping cost per A.F. of water in the high elevation area. The increased
cost of water shall be rounded to the nearest mill per 100 cubic feet and
added to the commodity charge for each rate block of each water schedule
rate charge.
The 22 percent Special Facilities Surcharge defined in Rule No. 15,
Section B, is not applicable to the high elevation pumping surcharge
amount.

of one.

RULE NO. 13
TEMPORARY SERVICE
A. CONDITIONS OF SERVICE
The City shall, if no undue hardship to its existing customers will
result therefrom, furnish temporary service for construction work,
circuses, Christmas tree lots, bazaars, fairs, plumbing pressure
testing, or other similar uses, that because of their nature will
not be used steadily or permanently. All such services shall be
subject to the following conditions:
1. Application for temporary service with appropriate deposit shall
be made to the Utility. The deposits for temporary service shall
be refunded after charges for permits, water consumption, loss
or damage of meter and fittings, and installation and removal
charges have been deducted at the termination of service.
2. Temporary service connections may be terminated at any time,
and will be made at the discretion of the Utility.
3. Charges for loss or damage to meter and fittings will be based
upon current prices.
4. Temporary services shall generally be taken from existing
outlets on the water system or from fire hydrants designated
by the Utility. Any special outlets shall be installed at the
customer's expense.
5. Backflow prevention devices, and approved plumbing materials may
be required for certain types of uses, and shall be installed
at the customer's expense.
6. An Eddy Valve will be required on all fire hydrant connections.
B. METERED SERVICES
Generally all temporary services will be metered, and will be subject'
to the following conditions:
1. Deposits for metered services shall be as follows:
a• 2 and smaller meters $270.00
b. 2'- and larger Meters $500.00

3. If the meter is installed and removed by the Utility, the charge shall
be $160.00. If the meter is installed only, or removed only by the
Utility, the charge shall be $80.00
4. Temporary meters may be moved from one location to another, only
with the approval of the Utility.
C. UNMETERED SERVICES
If in the opinion of the Utility, the setting of a temporary meter is
impractical or uneconomical, a temporary unmetered service connection
can be made. Unmetered connections will be subject to the following
conditions.
1. Fees for unmetered services, other than spacers, shall be as follows:
a. Permit Charge - $13.00
b. Commodity charge - based on current rate and estimated quantity
to be used.
2. For subdivisions requiring two inch or smaller meters, spacer
connections may be provided for the purpose of pressure testing
and for eliminating damage to permanent meters during the grading
of parkways. A maximum period of use is ninety (90) days,
subject to extension by the Utility. After the expiration of the
permit, the Utility may remove the spacers and install the meters.
A meter must be installed before any landscaping is done or the
dwelling is occupied. There will not be any permit fees for spacer
connections.
D. RATES
Rates for temporary service shall be as specified in Rate Schedule W -T.

4. Primary Distribution Mains
a. Primary Distribution Mains which supply water to all areas of
the system shall be paid for by acreage fees assessed on all
properties in the system except those properties excluded in
(1) above. The fees will be based upon gross acreage served
by domestic water service and /or fire protection, and will be
due at the time application for water service is made, or the
property is developed. This does not apply to application for
temporary or irrigation service. The water main extension fees
shall be$1,778 per acre.
The above fees will be calculated to the nearest one hundredth
(.01) acre.
Publicly -owned facilities such as freeways, flood control
channels, and water spreading basins may not be required to
pay the water main extension fees if water service for these
properties is not required. If a portion of these facilities
require water service, the water main extension fees shall be
paid on that portion requiring service.
b. When a Primary Distribution Main must be extended to a new
subdivision or development, the Utility will extend the main
up to five hundred (500) feet. If an extension greater than
500 feet is required, the developer will pay for the extension
that is in excess of 500 feet, in addition to the normal water
main extension fees. The developer's portion of the cost shall
be reimbursed to him without interest as acreage fees are col-
lected from others connecting to the extended main within a
refund area designated by the Utility at the time the advance
is made. The reimbursement agreement shall be in effect for a
period of ten (10) years. In no case shall the reimbursement
exceed the developer's cost of the extension.

d. The Utility shall charge an Inspection Fee of $32.00 per hour
for time spent inspecting the Secondary Distribution System
installed by a developer or his contractor. The developer
shall pay this fee prior to final acceptance of these water
improvements.
e. The Utility shall charge a Plan Check Fee of $32.00 per hour
for time spent checking or reviewing plans for additions to
the Secondary Distribution System. The Utility shall estimate
the Plan Check Fees when plans are first submitted, and this
estimated cost shall be deposited before plan check or plan
review begins. When the plan check process is completed, the
Utility shall collect or refund the difference between the
estimated cost and the actual cost of plan check.
6. Main Enlargements - When the Utility's present distribution systems
will not meet the water demands of a customer or developer, the
customer or developer may be required to pay the cost of any
necessary main replacement, less credit for the expired life of
the existing main.

SERVICE CONNECTIONS METERS AND CUSTOMER'S FACILITIES
A. GENERAL
1. For all. services, other than those where the developer is installing
the main, the Utility shall furnish and install the service connection,
meter and meter box after application is made and all applicable fees
are paid.
2. In new subdivisions, and in other cases where the developer installs
the mains, the developer shall furnish and install the service con-
nection and meter box, and the Utility shall furnish and install the
meter.
3. The service connection, meter, and meter box will generally be in-
stalled at a convenient location between the curb or edge of pavement
and the property line. If it is considered impractical to install
the facilities in this location, they may be installed upon the
customer's premises, in which case an easement will be required.
4. The service connection will generally determine the point of delivery
of water service to the customer.
B. SERVICE CON NECTION AND WATER

a. All connections larger than two inch and any special service,
including fire lines shall be made at the developer's expense.
All labor, equipment, and material to be furnished by the
developer.
b. Request for such services shall be made to the Public Utilities
Department, Water Engineering Division. A $750.00 deposit is
required to cover the cost of plan checking and inspection.
9. Increase in existing service and /or meter size.
In the event a customer is required or requests a larger service,
connection and /or meter for his property, the fees as stated in
Sections 3, and 5 above will apply. The credit value for salvaging the
meter and box will be used for the cutting and plugging of the old

C. CUSTOMER'S RESPONSIBILITY
The customer, as a condition precedent to receiving service shall:
1. Furnish and lay the necessary piping to make the connection to the
place of consumption.
2. Provide a main valve on the piping between the service connection and
the point of customer use, as per Development Services Department
Standards.
3. Provide a bacteria clearance certificate for services 3 inch and
larger, except fire lines.
D. OWNERSHIP AND ABSENCE OF RENTAL OBL IGATION WHERE FACILITIES ARE ON
PREMISES OF CUSTOMER
1. The service pipe, curb stgp,.meter,, and meter box located wholly
or partially upon a customer's premises are the property of the
Utility.
2. No rent or other charge will be paid by the Utility where the
Utility -owned service facilities are located on a customer's
premises.
E. ACCESS TO PREMISES OF CUSTOMER
to The Utility shall at all reasonable hours have access to meters,
service connections and other property owned by it which may be
located on customer's premises for purposes of installation,

BE IT FURTHER RESOLVED by the City Council of the City of Anaheim
that the amended Water Rates, Rules and Regulations be made effective for
service rendered on and after July 1, 1982.
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim
that the Public Utilities Board appoint an Ad Hoc citizens committee to study
the lifeline policies of the water and electric utilities.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
