1982-385RESOLUTION NO. 82R -385 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 2324. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from PEI -CHUNG AND ROSANA HSU CHAO, owners, and PRIME PROPERTY LIMITED and STAN SAKAMOTO, agents, to permit a 15- story, 139 1/2 foot high, 500 room hotel with accessory uses with a waiver of certain provisions of the Anaheim Municipal Code, on certain real property located within the State of California, County of Orange, City of Anaheim, legally described as: THE NORTH 435.00 FEET OF THE EAST 460.00 FEET OF LOT 1 IN TRACT NO. 2854, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 90 PAGES 39 AND 40, OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. SAID LAND IS INCLUDED WITHIN THE AREA SHOWN ON A MAP FILED IN BOOK 37 PAGE 15, OF RECORD OF SURVEYS, IN THE OFFICE OF THE COUNTY OF SAID COUNTY. PARCEL 2: THE EASTERLY 500.00 FEET OF LOT 1 IN BLOCK 15 AS SHOWN ON A PLAT SHOWING SUBDIVISION OF THE SOUTH HALF OF SECTION 21, TOWNSHIP 4 SOUTH, RANGE 10 WEST, BEING A PART OF THE FAIRVIEW COLONY TRACT, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 1 PAGE 33, OF MISCELLANEOUS RECORD MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY. EXCEPTING THEREFROM THAT PORTION INCLUDED WITHIN THE BOUNDARIES OF TRACT NO. 2854, AS PER MAP RECORDED IN BOOK 90 PAGES 39 AND 40, OF MISCELLANEOUS MAPS, IN THE OFFICE OF SAID COUNTY RECORDER; and WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearingo did adopt its Resolution No. PC82 -108 aranting Conditional Use Permit No. 2324 — .- and — WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: . 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular,area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission said conditional use permit be, and the same is hereby, and that Conditional Use Permit No. 2 - Q be, and the same is hereby, granted permitting the hereinabove described hotel and accessory uses with a waiver of the following provision of the Anaheim Municipal Code: SECTION 18.06.060 - Minimum number of parking spaces. (854 spaces required; .- 951 spaces proposed) ATTY -26 (Page 2 of 2 Pages) subject to the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width from the centerline of the street along West for street widening purposes. 2. That all engineering requirements of the City of Anaheim along West Street including preparation of improvement plans and installation of all improvements such as curbs and gutters, side- walks, street grading and pavement, sewer and drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the City Engineer; that street lighting facilities along West Street shall be installed as required by the Office of the Utilities General Manager in accordance with specifications on file in the Office of Utilities General Manager, and security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above - mentioned improvements. Said security shall be posted with the City prior to issuance of building permits. The above - required im- provements shall be installed prior to occupancy. 3. That the owners of subject property shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for tree planting purposes along West Street. 4. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 5. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That subject property shall be served by underground utilities. 7. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer, including construction of a storm drain in West Street from Katella Avenue. 8. That the owners of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as deter- mined by the City Council, for commercial buildings prior to the issuance of a building permit. 9. That an asphalt concrete sidewalk shall be provided along West Street for safe use by pedestrians during construction of the hotel as required by the City Engineer. -3- 10. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. 11. That the proposed hotel shall comply with all signing re- quirements of the CR (Commercial, Recreation) Zone and that no por- tion of any exterior sign constructed on the hotel shall be located at a height exceeding 116 feet above grade. 12. That the southerly driveway on West Street shall be re- stricted to vehicle exiting only as recommended by the City Traffic Engineer. 13. That a comprehensive Signing Plan for vehicular and pedes- trian circulation shall be submitted to the City Traffic Engineer for review and approval. 14. That the design and location of all taxi and bus loading and unloading areas shall be subject to review and approval by the City Traffic Engineer. 15. That the owners shall execute and record a covenant in a form approved by the City Attorney agreeing that if, at any time following completion of the hotel, City conducts a traffic study which indicates that the off - street parking provided by owners is inadequate for the hotel and related uses, owners shall construct two additional levels of parking on the hotel off - street parking structure, or otherwise provide additional off - street parking, in a number and manner satisfactory to the City Engineer. Prior to issu- ance of building permits for the hotel, owners shall post a faithful performance bond with City in an amount as required by the City Engineer to guarantee installation of said additional parking which amount shall be deemed liquidated damages payable to City in the event any such required parking is not constructed in a timely manner. 16. That this Conditional Use Permit is granted subject to the completion of Reclassification No. 66- 67 -61, now pending. 17. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 1 of Exhibit Nos. 1 through 24. 18. Should any condition or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
