A RESOLUTION OF THE CITY COUNCIL OF THE CITY
-~- OF ANAHEIM AMENDING THE RATES, RULES AND
REGULATIONS FOR THE SALE AND DISTRIBUTION OF
ELECTRIC ENERGY AS ADOPTED BY CITY COUNCIL
RESOLUTION NO. 71R-478 AND AMENDED BY CITY
COUNCIL RESOLUTION NOS. 73R-25, 73R-373,
73R-531, 74R-75, 74R-630, 75R-243, 75R-344,
75R-345, 76R-41, 76R-377, 76R-528, 76R-817,
76R-464, 77R-628, 78R-458, 78R-665, 79R-292,

WHEREAS, the City of Anaheim maintains an electric
distribution system for the furnishing of electricity to
residents and inhabitants of the City of Anaheim and has
adopted Electric Rates, Rules and Regulations for the sale
and distribution of electric energy; and
WHEREAS, it is the policy of the City Council that
Anaheim's Electric Utility shall be self-supporting from
charges made by the City for electric energy furnished to
consumers and for services rendered in connection therewith;
and
WHEREAS, by Resolution 79R-190, the City Council
delegated to the Public Utilities Board the authority to
conduct hearings pursuant to the Public Utility Regulatory
Policies Act of 1979; and
WHEREAS, a hearing was held on June 25, 1981 before
the Public Utilities Board and evidence was presented in
connection with the proposed revision of electric rates; and
WHEREAS, the Public Utilities Board considered the
California Environmental Quality Act and made the following
findings:
1. The largest single item requiring a revenue increase
considering the test period of July 1, 1981 through
June 30, 1982 is purchased power at an estimated
cost of $106,231,000.
2. Other operating expenses and capital expenditures
estimated to cost $17,331:,000 are due to salary
increases and higher material costs.
3. Debt service requirements and an increase in reserve
amounts estimated to cost $1,894,000 are required to
meet financial reserves and requirements.
4. The transfer to the general fund in an amount
estimated to be $4,126,000 is authorized by the City
Charter and constitutes an Intra-City transfer.

5. The working capital build-up in an amount
estimated to be $123,000 is necessary to provide
a reserve margin to meet current debts as they
mature and thus constitutes a reserve requirement.
`~' 6. The matters covered in la through le above come
within Section 21080(8) of the Public Resources
Code of the State of California thus the establishment
of these rates is exempt from the California
Environmental Quality Act; and
WHEREAS, a Notice of Hearing in compliance with the
National Energy Act of 1978 was published as follows:
1. On June 8, 9, 10 and 11, 1981, a notice of the
public hearing on electric rates was published in
the Anaheim Bulletin and proof thereof is on file
with the Secretary of the Public Utilities Board.
2. On June 7, 8, 10 and 11, 1981, a notice of the
public hearing on electric rates was published in
the Santa Ana Register and proof thereof is on file
with the Secretary of the Public Utilities Board.
3. On June 7, 8, 10 and 11, 1981, a notice of the
public hearing on electric rates was published in the
Orange County Edition of the Los Angeles Times and
proof thereof is on file with the Secretary of the
Public Utilities Board; and
WHEREAS, the Public Utilities Board has considered the
proposal of the Public Utilities Department and has considered
the evidence presented at the public hearing; and
WHEREAS, the Public Utilities Board has made the following
findings with respect to the need for an electric rate increase:
1. The Electric System revenue requirement of the Anaheim
Public Utilities Department will be established, as
set forth below, on the basis of projections for a
Test Period consisting of the twelve months July 1,
1981 through June 30, 1982.
2. A reasonable estimate of the revenue requirement for
Purchased Power Expenses for the test period is
$106,231,000 as shown in Exhibit DLA-l.
3. A reasonable estimate of the revenue requirement for
other operating expenses for the test period is
$11,922,000 as shown in Exhibit DLA-l.

4, A reasonable estimate of the revenue requirement
for Capital Expenditures for the test period is
$5,409,000 as shown in Exhibit DLA-1.
5. A reasonable estimate of the revenue requirement for
Debt Service and Reserve Increases for the test period
is $1,894,000 as shown in Exhibit DLA-1.
6. A reasonable estimate of the revenue requirement for
transfer to the general fund for the test period is
$4,126,000 as shown in Exhibit DLA-1.
7. A reasonable estimate of the revenue requirement
offsets due to other electric revenues and interest
income for the test period is $1,985,000 as shown in
Exhibit DLA-l.
8. A reasonable estimate of the revenue requirement
for working capital build-up for the test period is
$123,000 as shown in Exhibit DLA-1.
9. An estimated revenue requirement of $127,720,000 as set
forth below is appropriate for the test period:

10. It is appropriate to perform a cost-of-service study
in order to determine the allocated revenue requirement
for the test period for the following customer classes:
Residential; Small Commercial; Large Commercial;
Industrial; Agricultural and Pumping; Street Lights;
and Municipal.
11. The customer class revenue requirements as determined
on the basis of a cost-of-service analysis are shown
in Exhibit RWE-1 and are appropriate:

12. Section 1221 of the City Charter provides that utility
rates charged to a class of consumers shall be uniform
within the class and shall be based on cost-of-service
for the class. Section 1221 also provides that lifeline
rates may be established, which rates would not neces-
sarily be based on cost-of-service.
13. The California Public Utilities Commission has
established lifeline rates for Southern California
Edison Company (Edison) and Edison is the retail
supplier of electric service in all the communities
surrounding Anaheim, and therefore, it is appropriate
to establish residential lifeline rates for Anaheim.
14. To the extent that the Anaheim lifeline rates produce
lower revenues than would be produced by rates based
on cost-of-service, the rates charged for non-lifeline
sales must be increased above the level of rates based
on cost-of-service. The difference between the revenues
from sales made at the lifeline rates and revenues from
those sales made at cost-of-service rates is the life-
line shortfall.
15. In allocating the lifeline shortfall to the non-lifeline
customers, it is appropriate to give consideration to
both cost-of-service and the retail rates of Edison.
16. On the basis of the preceding finding, the class
revenues under the proposed rates as shown in Exhibit
RWE-3 are reasonable and appropriate:

WHEREAS, the Public Utilities Board considered the
Public Utility Regulatory Policies Act of 1978 (PURPA) Standards
and made the following findings:
1. The retail electric sales of the Anaheim Public
Utilities Department exceed 500 million kilowatt-
hours per year and, therefore, the Department is
covered by Title 1 of the Public Utilities Regulatory
Policies Act of 1978.
2. The California Public Utilities Commission does not
have rate-making authority with respect to the
Anaheim Public Utilities Department and, therefore,
responsibility for the consideration and determination
of certain ratemaking standards set forth in PURPA lie
with this Board and the Anaheim City Council.
3. Consideration was given five standards of Title I,
Section 111 of PURPA, and to Title II, Section 210 -
Cogeneration and Small Power Production of PURPA.
Each of the five standards of Title. I, Section 111,
and Title II, Section 210, are discussed in the
prepared testimony presented by the Public Utilities
Department.
4. The cost-of-service standard of Title I, Section 111
of PURPA. The Public Utilities Department presented
an allocated cost-of-service study and presented
rates for each customer class which were based on
cost-of-service. The rates recommended by this Board
differ from cost-of-service only to the extent necessary
to distribute the lifeline short-fall to the remaining
customer classes. As shown in Finding 16, pages 4 and 5
of this resolution, except for the Residential class,
all classes will pay rates which produce revenues equal
to or greater than the allocated cost of service.

5. The Declining Block Rate Standard of Title I,
Section 111 of PURPA. The energy components of
the rates recommended by this Board do not have
declining block energy charges except for those
contained in the Residential Lifeline Rates,
and the metered rate of Schedule LS-2 - Lighting -
Street and Highway, Customer-Owned installation.
The City currently has no customer on the metered
rate under Schedule No. LS-2.
6. The Time-Of-Day Rate Standard of Title I, Section 111
of PURPA. The Public Utilities, Department is
installing Time-of-Day meters and plans to conduct
a time-of-day metering study and develop the
information necessary to estimate the magnitude
of savings and costs which would be associated
with time-of-day rates. It would be premature for
the Department to offer time-of-day rates without
sufficient study.
7. The Seasonal Rate Standard of Title I, Section 111
of PURPA. The Public Utilities Department intends
to continue to study seasonal rates in conjunction
with its studies of time-of-day and interruptible
rates. Therefore, no determination with respect
to seasonal rates is made at this time.
8. The Interruptible Rate Standard of Title I, Section
111 of PURPA. The Public Utilities Department intends
to continue to study interruptible rates in conjunction
with its studies of time-of-day and seasonal rates
and cogeneration rates. Therefore, no determination
with respect to Interruptible rates is made at
this time, but will be addressed on a case-by-case
basis for cogeneration.
9. The Load Management Techniques Standard of Title I,
Section 111 of PURPA, the Master Metering, Automatic
Adjustment Clauses, Information to Consumers,
Procedures for Termination of Electric Service and
Advertising Standards of Title I, Section 113 of
PURPA, and the Lifeline Rates Standard of Title I,
Section 114, of PURPA. The Public Utilities Department
has or is in the process of implementing the Public
Utilities Board's findings for these standards for
the last electric rate proceeding. Therefore, no
additional determination with respect to these
standards is made at this time.
10. The Cogeneration and Small Power Production provision
of Section 210 of Title II of PURPA. The Public
Utilities Department presented a report entitled
"Proposed Policies And Procedures For Non-discriminatory

Cogeneration and Small Power Production Rates"
prepared by R. W. Beck and Associates. At this
time, there are no known cogeneration or small
power production facilities which are ready to
interconnect with the City. We believe that
implementation of cogeneration and small power
production rates and regulations can best be
accomplished on a case-by-case basis.
WHEREAS, based on the findings hereinabove made,
the Public Utilities Board of the City of Anaheim recommend
to the City Council that the Council adopt the findings of
the Public Utilities Board with respect to the matters contained
herein and adopt the electric rates as shown in Exhibit RWE-4
to become effective for service rendered on and after July 1,
1981; and
WHEREAS, the City Council has considered the
evidence and concurs with the findings of the Public Utilities
Board as set forth hereinabove.
NOW, THEREFORE, BE IT RESOLVED that the findings of
the Public Utilities Board be, and they are hereby, adopted by
the City Council of the City of Anaheim.
BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that the Electric Rates, Rules and Regulations
adopted by City Council Resolution No. 71R-478 and amended by
City Council Resolution Nos. 73R-25, 73R-373, 73R-531, 74R-75,
74R-630, 75R-243, 75R-344, 75R-345, 76R-41, 76R-377, 76R-528,
75R-817, 77R-464, 77R-628, 78R-458, 78R-665,79R-292, 79R-309,
79R-335, 79R-669, 80R-81, 80R-186, 80R-480, and 81R-123, be
amended as follows to wit:

B. Billing Demand:
..The billing demand in any month shall be the average kilowatt input
indicated or recorded by instruments to be supplied, owned, and maintained
by the City and at the City's expense upon the consumer's premises adjacent
• to the watt-hour meter, in the 15 minute interval in which the consumption
of electric energy is greater than in any other 15 minute interval in the
month, but not less than either (1) 50% of the contracted for or connected
load, or (2) 50% of Lhe highest billing demand in the preceding eleven
months, whichever is the greater. However, in no case shall the billing
demand be less than 200 K'W. Billing demand shall be determined to the
nearest KTJ. Whenever the measured maximum demand has exceeded 400 KW for
three consecutive months and thereafter until,it has fallen below 300 KW
for 12 consecutive months, a 30 minute. interval will be used. Where the
demand is intermittent or subjected to violent fluctuations, the maximum
demand may be based on a shorter interval.

ENERGY COST ADJUSTMENT
APPLICABILITY •
Applicable to all areas served by the Utility and to all kilowatt hours billed
utiaer all rate schedules as defined uradez the special conditions of the rate
schedules.
PURPOSE.
To provide far increases and decreases of the Utility's charges for electric
service to reflect increases and decreases in the energy component of the cost
of purchased power,
APPLICATION OF ENERGY COST ADJUSTMENT
The Energy Cost Adjustment Billing Factor or Factors (ECABF), in cents per kwh,
which are set forth below, shall be applied to kilaaatt hours soi.d on
and after the effective date, as also set forth below, and continuing
thereaf[er until the next Energy Cost Adjustment Billing Factors become
effeetive. The dollar amount to be added to or subtrac~ed from each bill due
to the Energy Cost Adjustment shall be obtained by multiplying the number of
kilowatt hours for which, the bill is rendered by the applicable Energy Cost
Adjustment Billing Factor or Factors. The Energy Cost Adjustment 3illing
Factor for Lifeline Service: shall be applied to all kilowatt hours purchased
at the Lifeline rate. The Energy Cost Adjustment Bi11ir.R Factor for other
than Lifeline service shall be applied to all kilowatt hours purchased at rates
other than the Lifeline rate.

CALCULATION OF THE ENERGY COST ADJUSTMENT BILLING FACTORS
1. The Energy Component of Purchased Power Costs included in the Utility's
Base Rates is 4,322 cents per kilowatt hour.
2. The Initial Energy Cost Adjustment Billing Factors established under
this Schedule ECA shall be determined as follows, based on estimated data
available 1 to 30 days before the Factors are to become effective:
a. Determine the energy, in kwh, estimated to be purchased by the
Utility in the first six months during which the Base Rates shall be
in effect. ,.
b. For the period stated in part a) above, determine the estimated
amount, in dollars, of the energy component of the cost of
purchased power.•
c. For the period stated in part a) above, determine the energy, in
kwh, estimated. to be sold by the Utility under all rate schedules
except the Lifeline portion of the rate schedule.
d. The Initial Energy Cost Adjustment Billing Factor applicable to
all sales except the Lifeline portion of sales shall be calculated
by~the following formula:

Where: C = The estimated amount, in dollars, of the energy component
of the cost of purchased power for the six month period
as determined in b) above.
P = The estimated amount of purchased energy, in kwh, for the

month period as determined in part c) above.
e. The Initial Energy Cost Adjustment Billing Factor applicable to
Lifeline rates shall be -0.514 per kwh.
3. Following the Initial Energy Cost Adjustment Billing Factors, all
subsequent Energy Cost Adjustment Billing Factors shall be determined as follows:

a. An Energy Cost Balancing Account shall be established. At the
end of each month, the account balance will be calculated by:
i. Subtract from the balance which existed at the end of the
prior month the amount, in dollars, (which may be positive or
negative) by which the actual cost of .the energy component of
purchased power for the current manth exceeds the product of
4.322 cents per kwh times the actual amount of purchased energy,
in kwh, for the current month.
ii. Add the amount, in dollars, recovered from the application of
ECA Billing Factors which were effective during the month. Such
amount shall be the product of kwh of energy billed during the
month and the applicable ECA Billing Factors.
b. Within 45 days after the end of each month, the Public Ut.iiities
Department shall prepare and distribute as set forth in (d) following,
a report which shall show:
i. The ECA Billing Factors charged during each of the preceding
twelve months.
ii. The balances in the Energy Cost Balancing Account at manth
end for each of the preceding twelve months.
iii. Estimated amounts of the following items for each of the
subsequent six months: -
.Purchased energy, in kwh.
.Energy component of purchased power cost, in dollars.
.Lifeline energy sales, in kwh.
.Non-Lifeline energy sales, in kwh.
.Amounts, in dollars, expected to be recovered based on
continued application of the then currently effective
Energy Cost Adjustment Billing Factors.
Resulting Balances in the Energy Cost Balancing Account based
on the estimates listed above.
c. The Public Utilities Department shall then develop, if necessary,
revised ECA Billing Factors to become effective at a date determined
by the Public Utilities Department. The revised ECA Billing Factors wit
be designed by giving consideration to the following factors:
i. Rate stability is desirable and frequent changes in the ECP.

ii. The balance in the Energy Cost Balancing Account should be
maintained between a positive $2,000,000 and a negative $250,000.
It shall be the practice of the Public Utilities Department to
make appropriate adjustments to the ECA Billing Factors, based on
the estimates for the six-month forecast period, so as to maintain
the account balance within the established limits. If, at any time
the account balance does become greater. than a positive $2,000,000,
or less than a negative $250,000, an adjustment in the ECA Billing
Factors shall be made so as to return the account balance to within
the established limits.
d. The Public Utilities Department shall furnish to the Public
Utilities $oard and to the City Council the report discussed in
part b) together with notice of any revised ECA Billing Factor.
e. The Public Utilities Department generally will make the revised
ECA Billing Factors effective as of the first ,day of the appropriate
month.
f. Lifeline Rates
Until such time as the City Council gives the Public Utilities
Department authority to increase the charges to Lifeline
customers, the ECABF for Lifeline customers will remain at the
initial level of -0.5144 per kwh.

B. Billing Demand: -
..The billing demand in any month shall be the average kilowatt input
indicated or recorded by instruments to be supplied, owned, and maintained
by the City and at the City's expense upon the consumer's premises adjacent
to the watt-hour meter, in the 15 minute interval in which the consumption
of electric energy is greater than in any other 15 minute interval in the
month, but not less than either (1) 50% of the contracted for or connected
load, or (2) 50% of the highest billing demand in the preceding eleven
months, whichever is the greater. However, in no case shall the billing
demand be less than 200 h'W. Billing demand shall.be determined to the
nearest 1CW. Whenever the measured maximum demand has exceeded 400 KW for
three consecutive months and thereafter until.it has fallen below 300 KW
for 12 consecutive months, a 30 minute. interval will be used. Where the
demand is intermittent or subjected to violent fluctuations, the maximum
demand may be based on a shorter interval.

The monthly minimum charge shall be the monthly Service Charge.
SPECIAL CONDITIONS
A. The rate applies to service rendered at 240 or 480 volts at the option of the
consumer. 746 watts shall be equivalent to 1 HP.
B. Whenever, upon test, any equipment is found to be delivering more than 125
of its capacity as indicated by its nameplate rating, the City may disregard
the nameplate rating and base its charges upon the actual output as calculated
from the test.
C. Where the use of energy is seasonal or intermittent, no adjustment will be
made for any temporary reduction of connected load. Any customer resuming
service on such connected load within 12 months after it was disconnected,
will be required to pay all charges which would have been billed if the
temporary reduction of connected load had not been made.
D. Energy Cost Adjustment:
The rates above are subject to adjustment as provided for in Schedule ECA.
The applicable energy cost adjustment billing factor set forth therein will
be applied to all kWh billed•under this schedule.

SPECIAL CONDITIONS
A. Standard Equipment Furnished. Mast arm construction will be furnished.
Enclosed luminaires will be furnished for lamps of 2500 lumens, or larger.
Such standard lighting equipment will be attached to wood poles.
B. Other Than Standard Equipment. Where the customer requests the installation
of other than the standard equipment and such requested equipment is acceptable
to the City, the City will install the requested equipment provided the customer
agrees to advance the estimated difference in cost installed between such
equipment and standard equipment. Advances made for this purpose will not be
refunded. Facilities installed. in connection with such agreements become and
remain the sole property of the City.
C. Hours of Service:. Approximately 4140 hours per year.
D. Energy Cost Adjustment: The rates above are subject tp adjustment as
provided for in Schedule ECA. The applicable energy cost adjustment billing
factor set forth therein will be applied to 20 kwhr per month per 1000 lumens
for incandescent lamps, to 8 kwhr per month per 1000 lumens for mercury vapor
lamps and to 5 kwhr per month per 1000 lumens for high pressure sodium vapor
lamps.
