A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SETTING FORTH LOCAL CONDITIONS
JUSTIFYING AMENDMENTS TO THE UNIFORM BUILDIL~TG
CODE, 1979 EDITION.
WHEREAS, Health and Safety Code Section 17958.5 provides
for a city to make changes or modifications in the Uniform Building
Code, 1979 Edition, as are reasonably necessary because of local
climatic, geographical or topographical conditions; and
WHEREAS, Health and Safety Code Section 17958.7 requires
the City Council to make express findings of the necessity for
modifications in the Uniform Building Code before adopting such
changes; and
WHEREAS, the Chief Building Inspector of the City of
Anaheim has recommended that the Uniform Building Code, 1979
Edition, be adopted by the City with certain modifications and
amendments which are required by local conditions.
NOW, THEREFORE, BE IT RESOLVED that the modifications
to the Uniform Building Code recommended by the Chief Building
Inspector are hereby expressly found to be necessary on account
of local conditions as follows:
Sections 15.04.001 through 15.04.304(f) of the Anaheim
Municipal Code. These sections are administrative in
nature and adopt the 1979 Uniform Building Code by
reference as well as make it compatible with other
Codes enforced by the City of Anaheim.
Section 15.04.407 of the Anaheim Municipal Code. This
amendment changes the definition of the Front of Lot,
and is necessary to make the Building and Zoning Codes
compatible.
Section 15.04.420 of the Anaheim Municipal Code. This
amendment adds a definition for swimming pools which
are regulated in Section 6.56 of the Anaheim Municipal
Code.
Section 15.04.426 of the Anaheim Municipal Code. This
amendment is necessary to allow planned unit development
with small lots in which an open space under common
ownership provides the necessary distance between build-
ings to prevent conflagration. This is consistent with
current building practice throughout the State.

Section 15.04.1101 of the Anaheim Municipal Code. This
amendment includes masonry fences over th ree (3) feet
high in the definition of an M Occupancy and is neces-
sary in order to regulate this type of fence which is
in common use as property line fences in residential
tracts and is regulated by Zoning ordinances. Many
masonry fences are placed adjacent to public right-of-
way.
Section 15.04.1716 of the Anaheim Municipal Code. The
City of Anaheim is geographically a city of high tourism.
Because of the family-oriented attractions and amusement
parks within the City and vicinity, a substantial percent-
age of all transient accommodation occupants within the
City are families with small children. Consequently, it
is necessary to amend the guardrail spacing requirements
as set forth in Section 1716 of the Uniform Building
Code, 1979 Edition, for the sa_f_ety and welfare of such
children who otherwise might not be adequately protected
by such guardrails.
Section 15.04.1807 of the Anaheim Municipal Code. This
amendment reduces the maximum height above which high
rise residential and office buildings must be .f_ire
sprinklered from 75 to 55 feet above the lowest level
of fire department vehicle access. This amendment is
necessary due to the inability of the City fire suppres-
sion forces to attack and suppress fires in buildings
over 65 feet in height without these features.
Section 15.04.2623 of the Anaheim Municipal Code. This
amendment requires a vapor barrier beneath a concrete
floor slab in Group I, R and R, Div. 3 occupancies and
is necessary because of local soil and climatic condi-
tions.
Section 15.04.3503 of the Anaheim Municipal Code. This
amendment requires sound insulation in exterior walls of
residential building in noise-critical areas and is ne-
cessary to comply with State laws.
Section 15.04.3504 of the Anaheim Municipal
amendment specifies the methods of obtaining
with State mandated noise regulations and is

BE IT FURTHER RESOLVED that a copy of this Resolution,
together with the Ordinance adopting the Uniform Building Code,
as amended, be filed with the State Department of Housing and
Community Development.
