1981-390RESOLUTION NO. 81R-390 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 66R-27 APPROVING A REVISION TO EXHIBIT NO. 7 OF THE SANTA ANA CANYON ACCESS POINTS STUDY TO PRO- VIDE ACCESS TO A CERTAIN SITE LOCATED AT THE SOUTHWEST CORNER OF SANTA ANA CANYON ROAD AND FAIRMONT BOULEVARD AND WAIVING CITY COUNCIL POLICY NO. 201. WHEREAS, the City of Anaheim has heretofore adopted the Santa Ana Canyon Access Points Study ("Study") designating certain approved limited access points along Santa Ana Canyon Road as a logical and reasonable method of providing access to certain prop- erties abutting Santa Ana Canyon Road at such time as said proper- ties were to be developed for uses more intense than those then currently existing; and WHEREAS, said Study is a portion of the Circulation Element of the General Plan of the City of Anaheim and is used in conjunction with the acquisition and/or vacation of abutters' rights of access to Santa Ana Canyon Road in connection with the approval of development of said abutting properties; and WHEREAS, the owner of certain property abutting Santa Ana Canyon Road has requested the City to consider a revision to said Study to show a potential access point to Santa Ana Canyon Road for a 6.6 acre proposed commercial shopping center site located at the southwest corner of Santa Ana Canyon Road and Fairmont Boulevard; and WHEREAS, the Planning Commission has heretofore held a duly noticed public hearing and has recommended that the proposed revision to said Study be approved as set forth in Planning Commission Resolution No. PC81-127; and WHEREAS, the City Council did hold a duly noticed public hearing on August 18, 1981, to consider said request and did re- ceive testimony and evidence relating thereto; and WHEREAS, the City Council, after due inspection, investi- gation and study, and after due consideration of all evidence and reports offered at said hearing, does hereby amend said Study in the manner hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED that the City Council of `""`~ the City of Anaheim does hereby amend Resolution No. 66R-27 approv- ing a revision to Exhibit No. 7 of the Santa Ana Canyon .Access Points Study shown as Revision 9b on Exhibit "A" prepared by the City of Anaheim Planning Department and submitted to the City Council in conjunction herewith, subject to the following conditions: -1- 1. That an access point be permitted approximately 440 feet west of the centerline of Fairmount Boulevard consisting of a 10- foot wide, b5-foot long deceleration lane for eastbound traffic entering the proposed center and an 18-foot wide right turn only for traffic exiting the center. ~- 2. That the proposed bicycle lane shall be relocated to follow the proposed sidewalk onto the subject property and shall not cross the access lane, except at a designated crosswalk. 3. That the proposed equestrian trail shall be located on the north side of Rio Grande Drive and the west side of Fairmont Boulevard; also providing a trail easement which traverses the north- west boundary along the SAVI Canal which is necessary for connection to the Santa Ana Canyon trail extending from the west; that the owner of subject property dedicate and improve the equestrian and hiking trails in accordance with standard plans and specifications on file in the office of the City Engineer; and that the riding and h iking trail remain adjacent to Santa Ana Canyon Road, if the re- quested access onto Santa Ana Canyon Road is denied. 4. That prior to issuance of a building permit, the developer shall submit specific circulation plans to the Traffic Engineer for approval. 5. That prior to the issuance of a building permit, the devel- oper shall submit specific plans to the Planning Commission for approval. 6. That the developer pay for the installation of full traffic signalization at the intersection of Fairmont Boulevard and Santa Ana Canyon Road. 7. That the proposed vehicular ingress and egress on Rio Grande Drive from the center be eliminated. 8. That the circulation plan relative to pedestrian, bikeway and vehicular traffic be reviewed by staff as articulated. Circula- tion plan to include maintenance of the median opening for a period of two years at which time it will be reviewed by the Council. 9. That the specific plans for treatment of roof-mounted equipment as f_ar as visual and sound attenuation be approved by the Planning staff and also sound attenuation plans for the truck loading area on the west side of the market. 10. That each tenant's lease or occupancy agreement shall con- tain a requirement that all commercial vehicles serving such busines- ' ses shall use the Santa Ana Canyon Road access point as the sole means of ingress and egress to the shopping center, and that said require- ment shall be strictly enforced by the lessor. -2- BE IT FURTHER RESOLVED that nothing contained in th is resolution shall be deemed to authorize access over and across said access point herein approved or be deemed an abandonment ',~y the City of any abutter's rights of access currently held by the City of Anaheim; such access shall be deemed approved only upon a subsequent vacation of the abutter's rights of access at the location of said access point in accordance with the procedures specified in Streets and Highways Code Section 8300 et seq. and compliance with all conditions imposed thereon including payment of any compensation which may be required by the City of Anaheim for the purchase of said abutter's rights of access. BE IT FURTHER RESOLVED that the City Council does hereby waive Council Policy No. 201.
