A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM SETTING FORTH LOCAL CONDITIONS JUS-
TIFYING AMENDMENTS TO THE NATIONAL ELECTRICAL
CODE, 1981 EDITION.
WHEREAS, Health and Safety Code Section 17958.5 provides
for a city to make changes or modifications in the National
Electrical Code, 1981 Edition, as are reasonably necessary because
of local climatic, geographical or topographical conditions; and
WHEREAS, Health and Safety Code Section 17958.7 requires
the City Council to make express findings of the necessity for
modifications in the National Electrical Code before adopting such
changes; and
WHEREAS, the Chief Electrical Inspector of the City of
Anaheim has recommended that the National Electrical Code, 1981
Edition, be adopted by the City with certain modifications and
amendments which are required by local conditions.
NOW, THEREFORE, BE IT RESOLVED that the modifications to
the National Electrical Code recommended by the Chief Electrical
Inspector are hereby expressly found to be necessary on account of
local conditions as follows:
Section 15.16.020 of the Anaheim Municipal Code. This
amendment requires aluminum conductors, where expressly
permitted, to be not less than AWG in size. This
amendment is necessary due to product studies for the
locality which show such minimum size is reasonably
necessary because of local climatic and environmental
conditions to avoid a hazard or danger to the safety
of persons or property.
Section 15.16.030 of the Anaheim Municipal Code. This
amendment requires undergrounding of electrical connec-
tors to accessory buildings, uses and other specified
locations. This amendment also requires raceways be
installed to approved accessible locations where space
circuit protective devices, or space for such devices,
are provided on the buss in any flush or semiflush
mounted panel. It is felt necessary to require conduc-
tors to be placed underground due to the incidence of
accidental contact by metal ladders, pipe, kites, swim-
ming pool scoops and brushes, cranes and other similar
items. Overhead conductors are also subject to being
disconnected as a result of wind storms. If raceways
are not provided when spare circuits are provided for,
a hazard is usually created when owners or tenants add
additional wiring. In any case, slipshod wiring,
usually surface, is done creating an additional hazard.
There is no requirement for spare circuits but if they
are provided, it is felt to be important that a raceway
be installed to utilize the circuits without damaging
parts of the permanent structure. This amendment is
necessary because of local soil, wind and other climatic
and geographical conditions.
Section 15.16.040 of the Anaheim Municipal Code. This
amendment requires a minimum of one receptacle outlet in
each carport and garage, whether attached or unattached
to the dwelling in order to provide the same degree of
convenience and safety to detached garages and carports
as the Code provides for attached garages.
Section 15.16.050 of the Anaheim Municipal Code. This
amendment requires at least one wall switch controlled
lighting outlet in every carport in order to provide
lighting for safe use in carports similar to that re-
quired for garages.
Section 15.16.060 of the Anaheim Municipal Code. Utility
company conductors can deliver tremendous amounts of cur-
rent when faulted due to mechanical injury, etc. This
current is immediately transferred to the structure,
causing fire or explosion. This amendment would provide
for reasonable protection of the structure and would con-
tain most of the faults within the raceway.
Section 15.16.070 of the Anaheim Municipal Code. This
amendment requires a single fusible switch or automatic
circuit breaker to disconnect all ungrounded conductors
supplying each separately metered occupancy. This amend-
ment is necessary because of local climatic and geograph-
ical conditions and power consumption patterns which
require a single main switch to avoid a hazard or danger
to the safety of persons or property. In the absence of
this amendment, the Code would allow up to six main dis-
connects for any one occupancy or service, thus allowing
connection of additional circuits to a service without any
protection to panel buses from overloading. A single
main disconnect, as required by this amendment, provides
the necessary safety to the electrical system and, in
addition, allows fast disconnection in time of emergency.
Section 15.16.080 of the Anaheim Municipal Code. Due to
the occupant load and lesser degree of safety that is pro-
vided by use of nonmetallic sheathed cable, this amendment
limits its use to residential structures of three floors
or less above grade. A few of the dangers justifying this
restriction are as follows:
(a) penetration of cables unknowingly by nails
after completion of the structure;
(b) mechanical damage to cables by workmen during
construction;
(c) safety hazards created by persons attempting
to add new wiring;
ATTEST:
(d) transference of a fault in the cable immediately
to the structure; and
(e) likelihood of mechanical damage during fire or
earthquake with consequent lack of protection for
emergency power to elevators and exit lights.
BE IT FURTHER RESOLVED that a copy of this Resolution,
together with the Ordinance adopting the National Electrical Code,
1981 Edition, as amended, be filed with the State Department of
Housing and Community Development.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 8th day of December, 1981.
