A RESOLUTION OF THk CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AGREEMENTS FOR MUTUA:L
FIRE PROTECTION BETWEEN TEE CITY OF ANAELIM
AND TEE CXNTY OF ORANGE AND TEE CITIES OF
SANTA ANA, ORANGE, GARDEN GROVE, STANTON,
PLACENTIA, FULLERTON AND BUENA PARK; AND
AUTHORIZING THE EXECUTION THEREOF.
WIllEAS, the Cities of AnaEeim, Santa Ana, Orange,
Garden Grove, Stanton, Placentia, Fullerton and Buena Park
and the County of Orange all maintain and operate fire protec-
tion organizations in their respective Cities and in the case
of the County, throughout the unincorporated area, all within
Orange County, California; and
WHEREAS, It is the desire of said Cities and said
County of Orange to render aid, each. to the other, to combat
the effect of fire and avoid loss of life and property wUen
such aid is necessary; and
WHEREAS, said Cities and County of Orange desire to
enter into agreements for mutual aid fire protection and
rescue services pursuant to the provisions of the 'Joint
Exercise of Power Act" (Gov. Code Sec. 6500-6547 and H. 3.
Div. 12, Pt. 1, Ch. 2, Sec. 13050, 13051 and 1302).
NOW, THEREFORE, BL IT RESOLVED by the City Council of
the City of Anaheim that the proposed Agreements for Mutual
Fire Protection, a form of which is attached hereto and made
a part hereof, to be made and entered into by the City of
Anaheim with the County of Orange and the Cities of Santa
Ana, Orange, Garden Grove, Stanton, Placentia, Fullerton and
Buena Park separately, providing that the parties to said
agreements will furnish rescue and fire protection personnei,
equipment, materials and supplies, and render such fire pro-
tection and rescue services to each other as may be necessary
to suppress fires or handle rescue of a magnitude beyond the
control of a single party, upon the terms and conditions there-
in set forth, be, and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreements
for and on behalf of the City of Anaheim.

THIS AGREEMENT, made and entered into this day of

WHEREAS, the parties hereto, maintain and operate fire protection
organizations in their respective cities, and in the case of the County, throughout
the unincorporated area, all within Orange County, California; and
WHEREAS, it is the desire of the parties hereto to render aid, each to
the other, to combat the effect of fire and avoid loss of life and property, when
such aid is necessary as herein set forth; and
WHEREAS, the parties hereto desire to effect the purpose of this agreement
pursuant to the provisions of the "Joint Exercise of Power Act" (Gov. Code Sec.
6500 -6547) and H. S. C. Div. 12, Pt. 1, Ch. 2, Sec. 13050, 13051 and 13052.
NOW, THEREFORE, the parties hereto mutually agree as follows:
1. To furnish rescue and fire protection personnel, equipment, materials
and supplies, and to render such fire protection and rescue services to each other
as may be necessary to suppress fire or handle rescue and /or other emergency of a
magnitude that has developed, or appears to develop, beyond the control of a single
party and therefore requires the combined forces of the parties hereto.
2. Such mutual aid shall be provided within the limits of the County
of Orange on the basis of the "running cards," and each party hereto agrees to keep
the central dispatching office and the secondary dispatching office informed as to
the status of all equipment available for mutual aid hereunder. The Fire Chief, or
other person in charge of the fire protection organization of each of the parties
hereto, shall, in every case of requested aid, determine the limit of assistance
which his organization can render hereunder without depleting fire or rescue pro-
tection resources, personnel, and equipment for the area where his primary responsi-
bility exists; and no party hereto shall be required to furnish aid hereunder in
excess of the amount so determined.
3. No response to a mutual aid request provided for in this agreement
will be made by the parties hereto unless such request is received through the
established communication channels common to each party and made by a responsible
fire official of the party requesting such aid. All requests for mutual aid shall
be first made to the central dispatching office, if in operation; and in event such
office for any reason is unable to handle such traffic, such request shall be made
to the secondary dispatching office.
4. The County of Orange Fire Dispatching Office shall act as the central
dispatching office, and in event this office is unable to handle such traffic, the
City of Santa Ana Dispatching Office shall act as a secondary dispatching office,
as may be further agreed to in written form of procedure.
5. Any mutual aid extended under this agreement is extended with the
express understanding that the responsible local fire official (in whose juris-
diction an incident requiring mutual aid has occurred) shall remain in charge at
such incident, including the direction of that personnel and equipment provided him
through the operation of this mutual aid agreement.
6. Each party hereto shall repair and replace, at its own proper cost
and expense, any item of equipment which is damaged or fails for any reason. All
dry powder, foam material, CO2, wet water, and other expendable items used while
responding to a mutual aid call to extinguish, contain, or prevent the spread of
fire or avert loss of life and property shall be paid for by the party hereto
requesting mutual aid.
6.1 In the event of dispute relative to replacement, cost, quantities,
or types of consumables used, an arbitration board shall make final determination.
This board, which shall serve without compensation, shall consist of three dis-
interested members selected by the Chairman of the County Board of Supervisors.
7. This agreement shall remain in full force until terminated as herein
provided for and no termination by any of the parties hereto shall affect this agree-
ment as between the other parties hereto. Any party to this agreement may terminate
the same by serving notice of intention so to do upon the Clerk of the governing
body of each of the other parties hereto, which notice may be served by mail, and
this agreement shall terminate, as to the rights and liabilities of the party serving
such notice, fifteen days after the latest date of filing with any such Clerk.

IN WITNESS WHEREOF, the parties hereto have caused this agreement to be
executed and have agreed that the same shall be in effect from the date first
hereinabove written.
