A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 640.
WHEREAS, the City Planning Commission of the City of
Anaheim did initiate and propose the granting of a Conditional
Use Permit to establish an existing service station as a con-
forming use in a C -1, Neighborhood Commercial Zone within 75
feet of R -1, One- Family Residential Zoned property, on the follow-
ing described property situated in the City of Anaheim, County
of Orange, State of California, to wit:
The Easterly 165 feet of the Southerly 165 feet
of the Southeast quarter of the Southeast quarter
of the Southeast quarter of Section 19, Township
4 South, Range 10 West, in the Rancho Los Coyotes,
as shown on a Map recorded in Book 51, page 10
of Miscellaneous Maps, records of Orange County,
California.
Excepting the Easterly 40 feet lying within the
right of way of Brookhurst Street and the Southerly
40 feet lying within the right of way of Katella
Avenue.
Also excepting therefrom that portion described
as follows:
Beginning at the intersection of the center line of
Brookhurst Street and Katella Avenue; thence North
0 21' 08" West along said center line of Brookhurst
Street a distance of 63.80 feet; thence South 89 38' 52"
West, a distance of 42 feet to the beginning of a non
tangent curve, concave Northwesterly and having a
radius of 22 feet; thence Southwesterly along said
curve through a central angle of 89 57' 35" an arc
distance of 34.54 feet to a non tangent line; thence
South 0 18' 43" East a distance of 42 feet to a point
in the center line of Katella Avenue; thence North
89 41' 17" East along said center line of Katella
Avenue to the point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said application on October 26, 1964, notices of which said
public hearing were duly given as required by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing did adopt its Resolution No. 1398, Series 1964 -65,
granting Conditional Use Permit No. 640; and

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in granting s :id Conditional Use
Permit and did thereupon fix the 1st day of December
19__64 as the tine and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given :s required by law ind the provisions of Title
18, Chapter 1876 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
6tring, the City Council did duly hold :end conduct 'such hear-
ing f,r,ci did give all persons interested therein an opportunity.
to be heard and did receive evidence and reports; :nd
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the are in which it is proposed to be loc!:, ted
The size and shape of the site proposed for the
use is a.dequ,:.te to llow, the full_ development of
the proposed use in a manner not detri 4nental to the
particular ='rea nor to the peace, health, safety
and general welfare.
4. The traffic generated by the prop4 sed use will not
impose an undue burden upon th streets and high
ways designed ,.nd improved to carry the traffic in
the are:..
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission __granting said Conditional Use Permit be, and the
same is hereby sustained and that Conditional Use Permit
No. 640 be, and the same is hereby, granted permitting
the establishment and operation of an existing service station
as a conforming use in a C -1, Neighborhood Commercial Zone
within 75 feet of R -1, One- Family Residential Zoned property,
on the property hereinbefore described.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owner, his heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations.
THE FOREGOING RESOLUTION is approved and signed by
