A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM APPROVING AN
AMENDMENT TO CERTAIN CONDITIONS OF
APPROVAL IN CONDITIONAL USE PERMIT
NO. 1215 AND AMENDING RESOLUTION
NO. 71R-65.
WHEREAS, the city Council of the City of Anaheim
heretofore adopted Resolution No. 71R-65 approving Conditional
Use Permit No. 1215, subject to certain conditions specified
therein; and
WHEREAS, the permittee has now requested an
amendment to certain of said conditions of approval; and
WHEREAS, the city Council held a duly noticed
public hearing on January 15, 1991, at which hearing the City
Council did receive and consider evidence, both oral and
documentary, relating to said request; and
WHEREAS, the city Council hereby finds and
determines that the amendment of said conditions of approval in
the manner hereinafter set forth is reasonably necessary to
protect the public peace, health, safety or general welfare, or
necessary to permit reasonable operation under said Conditional
Use Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the conditions of approval heretofore
imposed in Conditional Use Permit No. 1215 as set forth in
Resolution No. 71R-65 be, and the same are hereby, amended by the
deletion of Condition No. 9 therefrom and the addition of new
Conditions Nos. 12 through 20 thereto, to read as follows:
"12. That the owner/developer of subject property shall
record an agreement to provide off-site parking across
Carpenter Avenue from subject site. Said agreement
shall be submitted to the Planning Department and
approved as to form by the City Attorney. Said
agreement shall specify the number and location of the
off-site parking spaces and shall assure that said
spaces shall be accessible and available at all times
for parking in conjunction with the use for which said
parking spaces are required. Said agreement shall be
recorded in the Office of the County Recorder and a
recorded copy filed with the Planning Department.
13. That prior to issuance of a building permit, the
appropriate traffic signal assessment fee shall be paid
to the City of Anaheim in an amount as established by
City Council resolution.

14. That any additional amusement devices shall be subject
to approval of an arcade permit, processed through the
Zoning Division of the Planning Department.
15. That at least two (2) uniformed security guards shall
be present in the parking lot during hours of operation
on Friday and Saturday nights in order to prevent
parking lot loitering.
16. That that portion of subject property currently zoned
RS-A-43,000 shall be rezoned to ML.
17. That subject property shall be developed substantially
in accordance with plans and specifications submitted
to the city of Anaheim by the petitioner and which
plans are on file with the Planning Department marked
Revision No. 3 of Exhibit Nos. 1 through 4.
18. That prior to issuance of a building permit, or within
a period of one (1) year from the date of this
resolution, whichever occurs first, Condition Nos. 1, 2
and 5, above-mentioned, shall be complied with.
Extensions for further time to complete said conditions
may be granted in accordance with Section 18.03.090 of
the Anaheim Municipal Code.
19. That prior to final building and zoning inspections,
Condition No. 6, above-mentioned, shall be complied
with.
20. That approval of this application constitutes approval
of the proposed request only to the extent that it
complies with the Anaheim Municipal Zoning Code and any
other applicable city, State and Federal regulations.
Approval does not include any action or findings as to
compliance or approval of the request regarding any
other applicable ordinance, regulation or requirement."
BE IT FURTHER RESOLVED that, except as expressly
amended herein, Resolution No. 71R-65 shall remain in full force
and effect.
THE FOREGOING RESOLUTION is approved and adopted
by the City Council of the City of Anaheim this 15th day of
