1965-216A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM FINDING AND DETERMINING
THAT TITLE 18 OF THE ANAHEIM MUNICIPAL
CODE RELATING TO ZONING SHOULD BE AMENDED
AND THAT THE BOUNDARIES OF CERTAIN ZONES
SHOULD BE CHANGED
WHEREAS, the City Planning Commission of the City of
Anaheim did hold a public hearing in Reclassification Proceed-
ings No. 64 -65 -92 to consider an amendment to
Title 18 of the An heim Municiiiir Code relating to zoning, and
to consider a change in the boundaries of the zone or zones
hereinafter mentioned and described, and at said hearing did
receive evidence and reports from persons interested therein
and from its staff; and
WHEREAS, within a period of forty days following said
hearing the Planning Commission did duly adopt a resolution
containing a report of its findings, a summary of the evidence
presented at s id hearing, and recommend tion that the pro-
posed amendment be adopted by the City Council and that a
certain zone or zones be changed =s hereinafter set forth; =nd
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings =nd recommend tion of the City
P1nning Commission the City Council did fix the 16th day
of March 19 65 as the time, and the City Council
Chambers in the Cityl of the City of Anaheim as the place
for a public hearing upon said proposed amendment to Title 18
of the Anaheim Municipal Code, end the exclusion of said
property, hereinafter described, from the zone or zones in
which it is now situated and the incorporation thereof in the
zone or zones hereinafter set forth, and did give notice there-
of in the manner and form as provided in said Title 18 of the
Anaheim Municipal Code; and
WHEREAS, at the time and place fixed foi?said public
hearing the City Council did hold and conduct such public
hearing and did give all persons interested therein an oppor-
tunity to be heard, :and did receive evidence and reports, and
did thereupon consider the summary of evidence presented at
said public hearing before the P1 nning Commission, its report
of findings =nd recommendation; and
WHEREAS, the City Council does find and determine
that the amendment to Title 18 of the Anaheim Municipal Code
should be adopted and that the property hereinafter described
should be excluded from the zone or zones in which it is now
situated and incorporated in the zone or zones as hereinafter
set forth;

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of An =heim that Title 18 of the Anaheim Municipal
Code be, and the same is hereby, mended and that the following
described property, situated in the City of Anaheim, County
of Orange, State of California, to wit:
64 -65 -92
The East 100 feet of that portion of Lot 3 of Helen
and Lynch's Subdivision of a portion of the West one
half of Section 16, in Township 4 South, Range 10
West, in the Rancho San Juan Cajon de Santa Ana, in
the City of Anaheim, as shown on a map thereof re-
corded in book 51, page 7, et seq., Miscellaneous
Maps, records of said Orange County, and as shown
on a map thereof recorded in book 442, page 158,
Deeds, records of Los Angeles County, California
described as follows:
Beginning at a point 324.46 feet West of the North-
east corner of the Northeast quarter of the Northwest
quarter of the Northwest quarter of said Section 16,
and running thence South 661.49 feet to the South
line of said Northeast quarter; thence West along
said South line 335.57 feet to the West line of said
Northeast quarter; thence North along said West line
662.05 feet to the North line of said Northeast
quarter; thence East along said North line 335.71
feet to point of beginning.
EXCEPTING THEREFROM that portion included within the
following described property.
Beginning at a point in the North line of said Sec-
tion, said point being South 89 08' 42" West 324.46
feet from the Northeast corner of the Northwest quarter
of the Northwest quarter of said Section; thence South
0 51' 18" East 38.87 feet; thence South 87 35' 00"
West 336.17 feet; thence North 0 25' 50" West 48.03
feet to said North line; thence North 89 08' 42"
East to the point of beginning.
ALSO EXCEPTING THEREFROM that portion of said land
lying Southerly of a line described as beginning at
a point in the East line of the above described land
distant 250 feet South of the Southeast corner of
the land described in the above exception; thence
Westerly parallel with the South line of the North-
east quarter of the Northwest quarter of the North-
west quarter, of said Section 16 to the West line of
said Northeast quarter.
be excluded from R -A, AGRICULTURAL ZONE, and incorporated in
C -3, HEAVY COMMERCIAL ZONE, upon the following conditions:
1. (a) That all engineering requirements of the
City of Anaheim along Lincoln Avenue, including prep-
aration of improvement plans and installation of all
improvements, such as curbs and gutters, sidewalks,
street grading and paving, drainage facilities, or
other appurtenant work shall be complied with as
required by the City Engineer and in accordance
with standard plans and specifications on file in
the Office of the City Engineer; and (b) that a
bond in an amount and form satisfactory to the City
of Anaheim shall be posted with the City to guar-
antee the installation of said engineering require-
ments.

2. That the owners of subject property shall pay to
the City of Anaheim the sum of $2.00 per front
foot, along Lincoln Avenue, for street lighting
purposes.
3. That the owners of subject property shall pay to
the City of Anaheim the sum of 15Q per front foot
along Lincoln Avenue, for tree planting purposes.
4. That trash storage areas shall be provided in ac-
cordance with approved plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final build-
ing inspection.
5. That the 35 -foot setback established by the City
Council along Lincoln Avenue shall be observed in
the development of subject property; and, further,
that plans for the development of subject property
shall be subject to approval by the City Council
prior to the issuance of a building permit.
6. That a 6 -foot strip of landscaping, not less than
12 inches in height, shall be provided along the
Lincoln Avenue frontage of subject property; that
additional landscaping, not less than 3 feet in
height, shall be provided for 2% of the remainder
of the parking area; and that said landscaping shall
be installed, along with irrigation facilities, prior
to final building inspection.
7. That conditions Nos. 1(b), 2 and 3 above mentioned
shall be complied with within a period of 180 days
from date hereof, or such further time as the City
Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized and directed to prepare and submit
to the City Council an ordinance amending Title 18 of the
Anaheim Municipal Code to accomplish the objects herein found
and determined to be necessary and proper.
THE FOREGOING RESOLUTION is signed and approved by
me this 16th day of March, 1965.
