A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 672
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
HUGH B. SPRAGUE, SR. and MARTHA V. SPRAGUE, 757 North East Street,
Anaheim, California, to establish a service station within 75
feet of a residential zone, establish a walk -up restaurant, and
permitting a waiver of the maximum height limitation within 150
feet of a single- family residential zone to permit the establish-
ment of a proposed market, and a waiver of the minimum parking
spaces required for the market and walk -up restaurant, on the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
The Northerly 225.00 feet of the Easterly 164.00
feet of Vineyard Lot A -1, in the City of Anaheim,
County of Orange, State of California, as per map
recorded in Book 4, pages 629 and 630 of Deeds, in
the Office of the County Recorder of Los Angeles
County, California.
Said land is included within the area shown on a
map filed in Book 21, page 12 of Record of Surveys,
in the Office of said County Recorder.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on February 1 ,19 65 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. 1524 Series 1964 -65
denying Conditional Use Permit No. 672
and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in denying said Conditional Use
Permit and did thereupon fix the 2nd day of March
19 65 as the time and the Council Chamber in the City Hall

(b) Establish a walk -up restaurant;
(c) Permit a waiver of the maximum height limitation
within 150 feet of a single family residential zone
to permit the establishment of a proposed market;
(d) Permit a waiver of the minimum parking spaces
required for the market and walk -up restaurant,
on the property hereinbefore described, be, and the same is
hereby denied, without prejudice.
THE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of March, 1965.
of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 672 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying Conditional Use Permit No. 672 be, and the same is
hereby sustained, and that the request of Hugh B. Sprague, Sr.
and Martha V. Sprague for a Conditional Use Permit to:
(a) Establish a service station within 75 feet of a
residential zone;

AND I FURTHER CERTIFY that the Mayor of the City
