1965-164WHEREAS, considerable traffic congestion presently
exists and is progressively increasing at the intersection of
Dale Street and Crescent Avenue; and
WHEREAS, a study has been completed and the conclusion
drawn that traffic conditions at said intersection warrant the
installation of a traffic signal and intersection lighting system
for the proper and orderly movement of traffic; and
WHEREAS, the Cities of Anaheim and Buena Park are
willing to cooperate in the installation of the required traffic
signals and intersection lighting systems and in the contribu-
tion to the maintenance of said systems subsequent to their
installation; and
WHEREAS, said Cities of Anaheim and Buena Park desire
to enter into an agreement to provide for the installation of
said traffic signal and intersection lighting system and to
specify the proportionate share of the costs that are to be
borne by each of said Cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this day submitted to the
City Council to be made and entered into by and between the City
of Anaheim and the City of Buena Park, providing for the instal-
lation and maintenance of a traffic signal and intersection
lighting system at the intersection of Dale Street and Crescent
Avenue, upon the terms and conditions hereinafter set forth,
and specifying the proportionate share of costs to be borne by
each of said Cities, be, and the same is hereby approved, That
the terms and conditions of said agreement are as follows:
I. INSTALLATION
RESOLUTION NO. 65R 164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE CITY OF BUENA PARK WITH
REFERENCE TO THE INSTALLATION OF A TRAFFIC
SIGNAL AND INTERSECTION LIGHTING SYSTEM AT
THE INTERSECTION OF DALE STREET AND CRESCENT
AVENUE.
The intersection at Crescent and Dale is to be improved
with a traffic signal and intersection lighting system.
Said work of improvements shall be referred to hereinafter
as the "Project."
1. Buena Park Shall:
A. Prepare the detailed plans, specifications
and estimates for the Project.
B. Approve the plans and specifications as to
design and construction features affecting
the construction and operation of that portion
of the Project within Buena Park.

C. Have jurisdiction of the construction area
within Anaheim and Buena Park.
D Be designated as the contracting and con-
struction agent for the parties to do and
perform all acts and things necessary or
required in order to construct the Project
in accordance with the plans and specifi-
cations, including material control, inspec-
tion of the construction work, and to execute
and deliver all documents necessary or re-
quired in connection with the construction
and completion of said Project, including
certificate of day labor, equipment and
material costs and certification of completion
of the Project.
E. Upon completion of the Project, to submit a
full, true and correct copy of documents,
certificates and itemized bills to Anaheim,
setting forth the construction and instal-
lation costs and costs of design, survey and
construction engineering.
2. Anaheim Shall:
A. Assist in the preparation of the detailed
plans, specifications and estimates for the
Project,
B. Approve the plans and specifications as to
design and construction features affecting
the construction and operation of that
portion of the Project within Anaheim.
C. Prepare maps and deeds for all necessary
additional rights of way in the City of
Anaheim.
D. Acquire the rights of way for its portion of
the Project and certify to Buena Park that
such acquisition will be accomplished prior
to award of contract.
E. At all times during the progress of the con-
struction of the Project have access to the
work for the purpose of inspection thereof
and should Anaheim deem any remedial measures
to be necessary, Anaheim shall notify Buena
Park thereof.
F. Anaheim shall reimburse City of Buena Park and
pay to the City of Buena Park its share of all
the costs within thirty (30) days after the
submission of the statement of the construction
and installation costs and costs of design,
survey and construction engineering as herein
before mentioned.

BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of March 1965.

3 The proportionate share of the cost of the con-
struction and installation to be borne by the
respective cities shall be determined in the
same ratio to the total cost of such traffic
signal and intersection lighting construction
and installation as the number of legs of the
intersection that provide access to abutting
property located within each city, and that
ratio is two (2) legs in the City of Anaheim and
two (2) legs in the City of Buena Park. The
proportionate share of cost to be borne by the
respective parties shall be based on contract
prices, and the City of Buena Park's share
shall be one -half (1/2) of the cost of the
Project and the City of Anaheim's share of the
cost shall be one -half (1/2) of the cost of the
Project. For budget purposes only it is
estimated that the City of Anaheim s share of
the Project shall be in the amount of fifty five
hundred dollars ($5,500), including the design,
survey and construction engineering. This
figure is merely an estimate, and the actual
proportionate share of each city shall be based
upon the contract prices.
4. In addition to its proportionate share of con-
struction and installation cost, which is based
upon the contract prices, the City of Anaheim
shall pay its share of design, survey and con-
struction engineering costs, and such amount
shall be ten per cent of the construction and-
installation costs, which are chargeable to
Anaheim, based on the contract unit cost.
5. Any and all road work which is necessary in
connection with the Project shall be paid for
by the respective parties on the basis of the
actual work done within the geographical limits
of their respective jurisdiction, and such shall
be paid for on the basis of contract prices.
II. MAINTENANCE
After the completion of the 'roject, the traffic
signal and intersection lighting system shall be maintained
by Anaheim and Buena Park shall pay to Anaheim, upon sub-
mission of said maintenance and energy costs, one -half (1/2)
of the total amount.
