A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT (C.L.D. NO. 14961)
BETWEEN THE LOS ANGELES SALT LAKE RAILROAD
COMPANY AND ITS LESSEE, UNION PACIFIC RAIL-
ROAD COMPANY, AND THE CITY OF ANAHEIM WITH
REFERENCE TO THE OPENING OF LA PALMA AVENUE
CROSSING NO. 3Y -19.4 AND THE CLOSING OF NORTH
STREET CROSSING NO. 3Y -19.5.
WHEREAS, the Los Angeles Salt Lake Railroad Company
and its Lessee, Union Pacific Railroad Company, Utah corpora-
tions, own and operate a line of railroad known as the Anaheim
Branch upon said Railroad Companies' right of way in the City
of Anaheim; and
WHEREAS, the City proposes to open a public highway
known as La Palma Avenue across said right of way and tracks,
which crossing is identified as 3Y -19.4; and
WHEREAS, pursuant to an order of the Public Utilities
Commission, a public highway known as North Street, which now
exists across said right of way and tracks at the crossing
identified as 3Y -19.5, is to be closed; and
WHEREAS, the City and said Railroad Companies desire
to enter into an agreement with reference to the opening of the
La Palma Avenue crossing and the closing of the North Street
crossing; and
WHEREAS, said Railroad Companies have tendered to the
City an agreement, to be entered into between said Railroad
Companies and the City, providing for the opening of said La
Palma Avenue crossing and the closing of said North Street
crossing upon the terms and conditions, and for the estimated
cost hereinafter set forth, which agreement the City Council
finds would be for the benefit and best interest of the City
and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement (designated ''C.L.D. NO.
14961' tendered to the City of Anaheim by the Los Angeles
Salt Lake Railroad Company and its Lessee, Union Pacific Rail-
road Company, Utah corporations, providing for the opening of
La Palma Avenue Crossing No. 3Y -19.4 and the closing of North
Street Crossing No. 3Y -19.5, upon the terms and conditions and
for the estimated cost as follows:
1. At the proposed La Palma Avenue Crossing No. 3Y- 19.4),
the Railroad Companies, at the sole expense of the
City, will install four (4) flashing light signals
(No. 6 Standard of the Public Utilities Commission
of the State of California), omitting back lights
on signals in median strip, and interconnect said
flashing light signals with the automatic grade
crossing signals of the Atchison, Topeka and Santa
Fe Railway Company; install planking, asphalt,
and rehabilitate the track between the rails and
two (2) feet outside of and parallel to the rails;
all at the estimated cost of Eighteen Thousand Nine
Hundred Seventy Dollars ($18.970.00).

be and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 23rd day of February, 1965.

2. At the North Street Crossing No. 3Y -19.5, the
Railroad Companies, at their own expense, will
install forty -eight (48) lineal feet of wooden
post barricade immediately west of the existing
crossing so as to close the same as well as
remove the crossing between the rails and two
(2) feet outside of and parallel to the rails.
3 The reimbursement of the Railroad Companies by
the City, as set forth above in Item 1, shall be
made within thirty (30) days after rendition of
bill therefor. Such cost shall include the actual
cost of labor and materials plus customary
additives, and as stated in Item 1, is estimated
to be Eighteen Thousand Nine Hundred Seventy
Dollars ($18,970.00) chargeable to the City. It
is understood that said amount is an estimate
only and actual cost shall govern. Bills
rendered by the Railroad Companies shall be
supported by itemized invoices showing unit
prices on materials and unit rates on labor
and equipment.
