A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 696.
WHEREAS, the City Planning Commission of the City of
Anaheim did initiate and propose the granting of a Conditional
Use Permit to permit the operation of an existing service
station as a conforming use in a C -1, General Commercial Zone,
within 75 feet of a residential structure in an R -A Zone, on
the following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
Those portions of Lots 13 and 17, Miles Rancho, in the City
of Anaheim, County of Orange, State of California, as shown
on a Map recorded in Book 4, page 7 of Miscellaneous Maps,
records of said Orange County, together with that portion of
Spadra Road, lying between said lots as shown on said Map,
vacated and abandoned by order of the Board of Supervisors
of said County, a copy of which was recorded May 16, 1917 in
Book 11, page 176 of Miscellaneous Records of said Orange
County, described as follows:
Beginning at the Southwest corner of the land described in
"Parcel 2" in the deed to Foster Oil, Inc., a corporation,
recorded November 6, 1963 in Book 6792, page 871 of Official
Records, said point being on a line parallel with and distant
Northerly 53.00 feet from the center line of La Palma Avenue;
thence along said parallel line North 89 55' 40" East, 74.32
feet to the beginning of a tangent curve concave Northwesterly
and having a radius of 25 feet; thence Northeasterly along
said curve, through a central angle of 104 57' 40", an arc
distance of 45.80 feet to a point on a line parallel with
and distant Westerly 45.00 feet, as measured at right angles
from the center line of Harbor Boulevard, as said center line
is shown on a Map filed in Book 9, page 41 of Record of Sur-
veys, in the office of the County Recorder of said Count;
thence along said last mentioned parallel line, North 15
02' 00" West, 141.10 feet, more or less, to a point on the
Northerly line of said land described in "Parcel 2" to Foster
Oil, Inc.; thence along said Northerly line, South 83 23'
40 West, 62.15 feet to the Northwest corner of said "Par-
cel 2 thence South 0 00' 40" West, 160.71 feet to the
point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on May 10, 1965, notices of which said public hear-
ing were duly given as required by law and the provisions of
Title 18, Chapter 18.76 o the Anaheim Municipal Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 1635 Series 1964 -65,
granting Conditional Use Permit No. 696; and

WHEREAS, thereafter, within twenty-two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to 'view the action of the
City Planning Commission in grantin? said Conditional Use
Permit art did thereupon fix the 8th day of June
19_65 as the ti e and the Council Chamber in the City Hall
of the City of Anahei':: as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by l w and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time ,.nd place fixed for said public
hearing, the City Council did duly hold and conduct 'such he r-
ing and did give all persons interested therein an opportunity.
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is. authorized by the
Anaheim Muunicip 1 Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the .rea in which it is proposed to be locr.. ted.
3. The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrtiental to the
particular rea nor to the peace, health, safety
and general welfare.
The traffic generated by the proposed use will not
impose an undue burden upon t.s reets and high
ways designed and improved to carry the trffic in
the area.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welf re of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission c, said Condition ..1 Use Permit be, and the
same is ereby sustained ;:nd that Conditional Use Permit
No. 6g6 be, and the same is hereby, granted permitting
the operation of an existing service station as a conforming
use in a C -1, General Commercial Zone, within 75 feet of a
residential structure in an R Zone, on the property herein-
before described.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations.
THE FOREGOING RESOLUTION is approved and signed by
me this 8th day of June 19 65
