A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 677
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from WILLIAM C. and DORIS B. GARRETT, 1202 N. East Street,
Anaheim, California, and RICHARD V. and ZEDITH S. HATHCOCK,
1202 Kenwood Avenue, Anaheim, California, to permit the establish-
ment of a service station at the intersection of a secondary
highway and a local street and within 75 feet of R -1 zoned prop-
erty, on the following described property situated in the City
of Anaheim, County of Orange, State of California, to wit:
PARCEL NO. 1
That portion of the South 1/2 of the Southwest 1/4 of the
Northwest 1/4 of the Southwest 1/4 of Section 2, Township 4
South, Range 10 West, in the City of Anaheim, County of Orange,
State of California, as said section is shown on a map thereof
recorded in Book 51, page 10, Miscellaneous Maps, records of
said Orange County, described as follows:
Beginning at the most Westerly Southwest corner of Tract No.
2022, as per map recorded in Book 58, pages 24 and 25, Mis-
cellaneous Maps, records of said Orange County, said South-
west corner being in the West line of Southwest 1/4 of the
Northwest 1/4 of the Southwest 1/4 of said Section 2, and
running thence East along the boundary of said Tract 201.77
feet to an angle point therein; thence continuing along said
boundary, South 135.00 feet to the South line of said South-
west 1/4 of the Northwest 1/4 of the Southwest 1/4; thence
West along said South line 200.15 feet to the Southwest corner
of said Southwest 1/4 of the Northwest 1/4 of the Southwest
1/4; thence North 0 41' 20" West along the West line of
said Southwest 1/4 of the Northwest 1/4 of the Southwest 1/4,
135.01 feet to the point of beginning.
PARCEL NO. 2:
Lot 9, Tract 2022, in the City of Anaheim, as shown on a map
thereof recorded in Book 58, pages 24 and 25, Miscellaneous
Maps, records of said Orange County.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on March 1 19 65 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 1553 Series 1964 -65,
denying Conditional Use Permit No. 677
and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to review the action of the
City Planning Commission in denying said Conditional Use
Permit and did thereupon fix the 6th day of April,
19_65 as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given s required by law ?nd the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
he r-irg, the City Council did duly hold nd conduct 'such hear

to be heard and did receive evidence and reports; nd
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, that:
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the are in which it is proposed to be located.
3 The size and shape of the site proposed for the
use is adequate to allow; the full development of
the proposed use in a manner not detrimental to the
particular re. nor to the peace, he lth, safety
and general welfare.
4. The tr :ffic generated by the prop sed use will not
impose an undue burden upon thA,sereets and high
ways designed ,and improved to carry the traffic in
the area.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission den in said Conditional Use Permit be, and the
sake is ere disapproved and that Conditional Use Permit
No. 677 be, an t e same is hereby, gr =anted permitting
the establishment of a service station at the intersection of
a secondary highway and a local street, and within 75 feet of
R -1 zoned property, on Parcel 1 and the southerly 35 feet of
Parcel 2 hereinbefore described, subject to the following
conditions:
1. That sidewalks and driveways shall be installed
along East Street. and Romneya Drive, as required
by the City Engineer and in accordance with
standard plans and specifications on file in the
Office of the City Engineer, prior to final
building inspection.
2. That trash storage areas shall be provided in
accordance with approved plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final
building inspection.
3. That subject property shall be developed substan-
tially in accordance with City of Anaheim Service
Station Minimum Site Development Standards on
file with the City, prior to final building
inspection.
4. That the northerly 50 feet, approximately, of
Parcel 2 shall be landscaped, and that said
landscaping shall be subject to the approval of
the Superintendent of Parkway Maintenance.
5. That this Conditional Use Permit is granted
subject to the completion of Reclassification
Proceedings No. 64 -65 -96 now pending.
The City Council hereby reserves the right to revoke
such conditional use permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 6th day of April, 1965.
