WHEREAS, the City of Anaheim has owned and operated
and electric utility for seventy years last past; and
RESOLUTION NO. 65R -763
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXTENSION,
REPLACEMENT AND EXPANSION OF THE DISTRIBU-
TION SYSTEM OF UTILITIES OPERATED BY THE
CITY, BY THE CITY'S EMPLOYEES.
WHEREAS, it

WHEREAS, due to the expansion and growth of said
City by annexation of territory to said City and the increase
of population therein, it has become necessary for the City
to extend, replace and expand the transmission and distribu-
tion systems of the electrical and water utilities, including,
but not limited to, water lines, power and electric lines,
poles, cables and other appurtenances and works necessary
for the proper distribution of water and electrical energy to
said inhabitants and areas; and
WHEREAS, Section 1211 of the Charter of the City of
Anaheim provides, in part, that "every contract involving an
expenditure of more than Two Thousand Five Hundred Dollars
($2,500.00) for the construction or improvement of public
utilities shall be let to the lowest and best
responsible bidder after notice and
WHEREAS, by reason of its experience and the exper-
ience of the Utilities Department of said City, the City Council
is of the opinion that the work of constructing, extending,
replacing, expanding and installing said facilities for said
public utilities will be performed better, more efficiently,
and more economically by the City with its own employees; and
WHEREAS, the extension and replacement of said Public
Utilities by City employees is not an expenditure by contract
and, therefore, not governed by Section 1211 of the City Charter,
but there is a possibility that such use of City employees for
such work could be construed to be in violation of said Section
1211 of the City Charter; and
WHEREAS, said Section 1211 provides that the City
Council may, by resolution, except projects for the extension,
replacement or expansion of the transmission or distribution sys-
tem of any existing public utility operated by the City; and
WHEREAS, in order to clarify the intent of the City
Council of the City of Anaheim in the matter of the use of City
employees for the extension, replacement or expansion of public
utilities owned and operated by the City of Anaheim;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Utilities Director should be and

he is hereby authorized to proceed to have any work mentioned
in this resolution done with City employees and that all such
projects are hereby declared excepted from the requirements of
Section 1211 of the Charter of the City of Anaheim.
BE IT FURTHER RESOLVED that purchase of supplies or
equipment for such projects or work shall be in accordance with
Section 1211 of the Charter of the City of Anaheim and subject
to exemption by action of the City Council where appropriate.
THE FOREGOING RESOLUTION is approved and signed by
me this 5th day of October, 1965.
