A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING THE OFFER OF E. D. JOHNSON
AND COMPANY TO FURNISH ALL LABOR AND MATERIAL
TO INSTALL STREET LIGHTING IN TRACT N0 :2451,
JOB NO. 961; AND AUTHORIZING THE EXECUTION OF
AN AGREEMENT TO BE MADE AND ENTERED INTO WITH
SAID E. D. JOHNSON AND COMPANY.
WHEREAS, the City Council did adopt Resolution No.
65R -654 finding and determining that public convenience and
necessity require the construction and completion of a public
improvement in the City of Anaheim, to wit:
Furnish all labor and material necessary to
install 4 dead end standards, in Tract No.
2451, in the City of Anaheim, per City of
Anaheim design No. 730, or equal, and
appurtenant work as per plans and specifications,
Job No. 961.
AND WHEREAS, E. D. Johnson and Company has offered to
furnish all labor and material to install said street lighting
in accordance with the design, plans, profiles, drawings and/
or specifications prepared by the Public Works Department of
the City of Anaheim, and to install the same within thirty
working days from and after the execution of a contract to be
made and entered into by and between E. D. Johnson and Company
and the City, for the price of $1,926.00; and
WHEREAS, the City Council finds that said price is the
lowest obtainable for the furnishing of all labor and material
to install said street lighting, and that the offer of E. D.
Johnson and Company should be accepted upon the conditions
hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of E. D. Johnson and Company
to furnish all labor and material to install 4 dead end standards,
in Tract No. 2451, in the City of Anaheim, per City of Anaheim
design No. 730, or equal, and appurtenant work as per plans and
specifications, Job No. 961, in accordance with the design,
plans, profiles, drawings and /or specifications prepared by the
Public Works Department of the City of Anaheim, be, and the
same is hereby, accepted, upon the following conditions:
1. That all labor and material shall be furnished and
the installation of said street lighting completed
within thirty (30) working days from and after the
execution of a contract to be made and entered into
by and between E. D. Johnson and Company and the
City of Anaheim.
2. That in the furnishing of all labor and material for
the installation of said street lighting it shall be
expressly understood and agreed that said E. D.
Johnson and Company is acting as an independent
contractor and not as an agent, servant or employee
of the City of Anaheim.

ATTEST:
AND BE IT FURTHER RESOLVED that the purchase price for
the furnishing of all of said labor and material for the instal-
lation and completion of said public improvement above described
shall be paid to E. D. Johnson and Company at the times and in
the manner set forth in the specifications and addenda thereto
on modifications thereof prepared by the Public Works Department,
prior to the opening of bids.
BE IT FURTHER RESOLVED that the said E. D. Johnson and
Company shall carry public liability and property damage insur-
ance in an amount not less than $100,000.00 for injuries, includ-
ing accidental death, for any one person, and subject to the same
limit for each person in an amount not less than $300,000.00 on
account of any one accident, and property damage insurance in an
amount not less than $50,000.00; and shall take out and maintain
during the life of said contract workmen's compensation insur-
ance covering all of its employees on the project; and public
liability and property damage insurance to cover vehicles used
or maintained by it in the performance of said work connected
with said improvement, with liability limits of not less than
$50,000.00 for any one person, and $100,000.00 for any one acci-
dent, and property damage of $1 0,000.00.
That said E. D. Johnson and Company shall also furnish
a Faithful Performance Bond and a Labor and Material Bond for
100% of the cost of said public improvement.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to enter into a contract
with. D. Johnson and Company in the usual form approved by the
City Attorney, upon the terms and conditions herein specified, and
the terms contained in the standard form of contract of the City
of Anaheim for public improvements.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of September, 1965.
