A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHE114 APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND ANAHEIM UNION HIGH SCHOOL DISTRICT
PROVIDING FOR THE JOINT USE OF CERTAIN PROP-
ERTIES AT AND CONTIGUOUS TO BROOKHURST JUNIOR
HIGH SCHOOL.
WHEREAS, the governing bodies of the City of Anaheim
and the Anaheim Union High School District have jurisdiction
over the same territory; and
WHEREAS, Anaheim Union High School District is the
owner of Brookhurst Junior High School, located at 611 North
Brookhurst Street in the City of Anaheim; and
WHEREAS, the City of Anaheim is the owner of prop-
erty which it will develop as a public park, said property
being contiguous to and immediately to the west of said junior
high school; and
WHEREAS, there is located on the western boundary of
said junior high school a driveway running north and south,
which said driveway would be useful as an access to said pro-
posed park if said driveway were available for the use of the
City; and
WHEREAS, the City and said School District desire to
enter into an agreement for the joint use of said properties;
and
WHEREAS, Anaheim Union High School District has
tendered to the City a form of agreement, dated August 26, 1965,
the terms and conditions of which the City Council finds to be
satisfactory and in the best interests of the parties.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement tendered to the City
of Anaheim by Anaheim Union High School District, dated
August 26, 1965, to be made and entered into between the parties,
providing as follows:
1. The City will construct a lighted baseball diamond
overlapping the said properties, the exact location
to be agreed upon by the parties to the agreement.
2. The City is to have the nonexclusive use of said
driveway in entering and leaving said proposed park.
3. The City will have the use of said baseball diamond,
subject to the prior rights of the School District,
as hereinafter described.
4. The City will maintain at its expense the area
within said baseball diamond. Lining will be done
for games only, not practices.

5. The School District will have priority of use of
said baseball diamond during school hours and, in
addition thereto, during regularly scheduled base-
ball games conducted during non school hours or
vacation periods. The School District will furnish
to the City a schedule of such games on or before
the first day of January of each year.
6. The cost of electricity to light said baseball
diamond when in use by the School District shall
be paid by it.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of September, 1965.
