A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 725
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from Windert Manufacturing, Trading Investments, Ltd., Los
Angeles, California, and Edward L. Bain and Eva L. Bain, 903
East Lincoln Avenue, Anaheim, California, to permit the establish-
ment of a service station at the intersection of a local street
and an arterial highway within 75 feet of a residential zone, on
the following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
Lots 1, 2, 3, 4, 5, 6 and the easterly 6.25 feet of Lot 7
in Block "A" of Kroeger's Subdivision of Vineyard Lot "D -1,"
in the City of Anaheim, County of Orange, State of California,
as per map recorded in Book 5, Page 34 of Miscellaneous Maps,
Records of said Orange County.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on July 19 19 65 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 1712 Series
1965 -66 denying Conditional Use Permit No. 725
and

WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, the City Council
did elect, upon its own motion, to freview the action of the
City Planning Commission in denying_ said Conditional Use
Permit and did thereupon fix the 17th day of __August___,
1965 as the ti e and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given :;.s required by LQw .end the provisions of Title
18, C pier 18`76 of the Anaheim Municipal Code; and
WHEREAS, at the time .:.nd place fixed for said public
hearing, the City Council did duly hold and conduct'such he;r-
ing and did give all persons interested therein an opportunity.
to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful conside-
ration of the recommendations of the City Planning Commission
and all evidence and reports offered at said hearing, thatt
1. The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municip:.I Code.
2. The proposed use will not adversely affect the
adjoining land uses and the growth and development
of the ,.re& in which it is proposed to be located.
4. The traffic generated by the proposed use will not
repose an undue burden upon the..s reets and high-
ways designed and improved to carry the tr ffic in
the area.
3. The size and sh..pe of the site proposed for the
use is a.dequ ::.te to :.11ow, the full development of
the proposed use in a manner not detrpnental to the
particular area nor to the peace, health, safety
and general welfare.
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying said Conditional Use Permit be, and the
sme is hereby disapproved and that Conditional Use Permit
No. 725 be, and the same is hereby, granted permitting
the establishment of a service station at the intersection of
a local street and an arterial highway within 75 feet of a resi-
dential zone, on the property hereinbefore described, subject
to the following conditions:
1. That the sidewalks and curbs shall be removed and /or
reconstructed along Lincoln Avenue, as required by the
City Engineer and in accordance with standard plans and
specifications on file in the Office of the City Engineer.
2. That the curbs shall be removed and /or reconstructed
along Vine Street, as required by the City Engineer and
in accordance with standard plans and specifications on
file in the Office of the City Engineer.

3. That sidewalks shall be installed along Vine Street,
as required by the City Engineer and in accordance
with standard plans and specifications on file in the
Office of the City Engineer.
4. That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of the
Director of Public Works and Superintendent of Streets.
5. That Conditions Nos. 1, 2, 3 and 4 above mentioned
shall be complied with prior to final building inspec-
tion.
6. That this Conditional Use Permit is granted subject
to the completion of Reclassification Proceedings
No. 65- 66 -16, now pending.
7. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked Exhibits Nos. 1, 2
and 3.
The City Council hereby reserves
such Conditional Use Permit for good cause
owners, their heirs, successors or assigns
Anaheim Municipal Code and regulations and
herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 17th day of August, 1965.
