A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City of
Anaheim has heretofore duly passed and adopted a resolution
recommending denial of a change in the boundaries of the zone
or zones hereinafter mentioned and described, after having
fixed a time and place for the holding of a public hearing
thereon in the manner and as prescribed in Title 18 of the
Anaheim Municipal Code, and after having duly held and conducted
such public hearing to consider said proposed change of zone
or zones, and after having received evidence and reports from
persons interested therein; and
WHEREAS, within a period of forty (40) days following
the hearing thereon, the Planning Commission did duly announce
by formal resolution its findings of facts and declare its
opinions and reasons for recommending denial of said proposed
change in the boundaries of the zone or zones hereinafter
mentioned and described; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City Plan-
ning Commission, the City Council did fix the 14th day )f

hearing upon said proposed amendment to Title 18 of the Anaheim
Municipal Code, and the exclusion of said property, hereinafter
described, from the zone in which it is now situated and the
incorporation thereof in the zones hereinafter set forth; and did
give notice thereof in the manner and form as provided in said
Title 18 of said Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such public
hearing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports and did there-
upon consider the summary of evidence presented at said public
hearing before the Planning Commission, its report of findings
and recommendations; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated,
and incorporated in the zone or zones as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby amended, and that all of the property
and area situated in the City of Anaheim, County of Orange,
State of California, described as follows:

PARCEL "A":
All that certain real property in the City of Anaheim,
County of Orange, State of California, being the Westerly
203.00 feet of Lots 17 and 18 of the P. A. Stanton Tract
as per map thereof recorded in Book 5, Pages 23 and 24,
Miscellaneous Maps, records of said Orange County.
EXCEPTING THEREFROM that portion of said Lot 17 included
within the following described lines: Beginning at a
point on the Westerly line of Section 19, Township 4
South, Range 10 West, in the Rancho Los Coyotes, as per
map recorded in Book 51, Page 10 of said Miscellaneous
Maps, South 0 38' 40" East 441.50 feet from the �North-
west corner of said Section; thence North 89 14' 54"
East 572.84 feet to the West line of Lot 14 in said P. A.
Stanton Tract; thence South 0 38' 40" East 345.00 feet
along the West line of Lots 14 and 15 in said P. A.
Stanton Tract; thence South 89 14' 54" West 572.84
feet to the West line of said Section; thence
North 0 38' 40" West 345.00 feet to the point of
beginning.
Note: For the purposes of this description, the center
line of Magnolia Avenue is assumed to be the Westerly
line of Lots 17 and 18.
PARCEL "B
All that certain real property in the City of Anaheim,
County of Orange, State of California, being Lots 17
and 18 of the P. A. Stanton Tract as per map thereof
recorded in Book 5, Pages 23 and 24 of Miscellaneous
Maps, records of said Orange County.
EXCEPTING THEREFROM the Westerly 203.00 feet thereof
and also EXCEPTING THEREFROM that portion of said Lot 17
included within the following described lines: Beginning
at a point on the Westerly line of Section 19, Township
4 South, Range 10 West, in the Rancho Los Coyotes, as
per map recorded in Book 51, Page 10 of said Miscellane-
ous Maps, South 0 38' 40" East 441.50 feet from the
Northwest corner of said Section; thence North 89 14' 54
East 572.84 feet to the West line of Lot 14 in said
P. A. Stanton Tract; thence South 0 38' 40" East
345.00 feet along the West line of Lots 14 and 15 in
said P. A. Stanton Tract; thence South 89 14' 54" West
572.84 feet to the West line of said Section; thence
North 0 38' 40" West 345.00 feet to the point of
beginning.
Note: For the purposes of this description, the center
line of Magnolia Avenue is assumed to be the Westerly
line of Lots 17 and 18.
be excluded from R -A, AGRICULTURAL ZONE, and incorporated in
the following zones, upon the conditions hereinafter set forth:
That Parcel "A" above described shall be changed
to and incorporated in C -1, GENERAL COMMERCIAL
ZONE; and
That Parcel "B" above described shall be changed
to and incorporated in R -3, MULTIPLE- FAMILY
RESIDENTIAL ZONE.
That said change of zones shall be made upon the following
conditions:
1. That the owner of subject property shall deed to the
City of Anaheim a strip of land 53 feet in width,
from the center line of the street, along Magnolia
Avenue, for street widening purposes, including a
15 -foot radius corner return.
2. That the owner of subject property shall deed to
the City of Anaheim a strip of land 40 feet in
width, from the center line of the street, along
Winston Road, for street widening purposes.
3. (a) That all engineering requirements of the City
of Anaheim along Winston Road, including preparation
of improvement plans and installation of all improve-
ments, such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or other
appurtenant work shall be complied with as required
by the City Engineer and in accordance with standard
plans and specifications on file in the Office of
the City Engineer; and (b) that a bond in an amount
and form satisfactory to the City of Anaheim shall
be posted with the City to guarantee the installa-
tion of said engineering requirements.
4. That the owner of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot,
along Winston Road and Magnolia Avenue, for street
lighting purposes.
5. That the owner of subject property shall pay to the
City of Anaheim the sum of 15 per front foot along
Winston Road and Magnolia Avenue, for tree planting
purposes.
6. That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim.
7. That the owner of subject property shall pay to the
City of Anaheim the sum of $25.00 per dwelling unit,
to be used for park and recreation purposes, said
amount to be paid at the time the building permit
is issued.
8. That all air conditioning facilities for the
commercial portion of subject property shall be
properly shielded from view from abutting streets.
9. That Conditions Nos. 1, 2, 3(b), 4 and 5 above
mentioned shall be complied with within a period
of 180 days from date hereof, or such further
time as the City Council may grant.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 14th day of December, 1965.
