A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 778
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from GRAN COLOMBIA CORPORATION, 1360 South Anaheim Boulevard,
Suite 220, Anaheim, California, to establish a restaurant with
on -sale beer and wine, on the following described property situa-
ted in the City of Anaheim, County of Orange, State of California,
to wit:
That portion of the northwest quarter of the northwest quarter
of Section 9, Township 4 South, Range 10 West, in the Rancho
San Juan Cajon de Santa Ana, city of Anaheim, county of Orange,
state of California, as the northwest quarter of said section
9 is shown on a map of Tract No. 2161, recorded in book 63
pages 33, 34 and 35 of Miscellaneous Maps, in the office of
the county recorder of said county, described as follows:
Beginning at the intersection of the center line of West La
Palma Avenue, 60.00 feet wide, with the center line of Euclid
Avenue, 60.00 feet wide, as shown on said map; thence easterly
440.00 feet along said center line of West La Palma Avenue;
thence southerly 349.98 feet at right angles to said center
line of West La Palma Avenue to the true point of beginning;
thence continuing southerly 223.18 feet along said line to a
line parallel with and northerly 30.00 feet from the northerly
line of the south 22.00 acres of said northwest quarter of the
northwest quarter; thence westerly along said parallel line to
said center line of Euclid Avenue; thence northerly 224.52 feet
along said center line to a point southerly 349.70 feet from
the point of beginning; thence easterly 438.88 feet in a
direct line to the true point of beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on November 19 65 notices of which
said public hearing were d given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies ma,de by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 1841, Series
1965 granting Conditional Use Permit No. 778
subject tqcertain conditions therein _set forth and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting'the action of the
City Planning Commission in u antin said Conditional Use
Permit and said appeal was set for public hearing on
D c mbcz 4 19 6 at the City Hall, in the City of
Ana and notices of such public hearing were duly given as
required by law and the provisions of Title 18, Chapter 18.76
of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that:
1. TIr proposed use is properly one for which a
Conditional Use Permit is authorized by the
,Anaheim Municipal Code.
The roposed use will not adversely affect the
adjoining land uses and the growth and develop
want of the area in which it is proposed to be
located.
The size and shape of the site proposed for the
use is dequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welf: -re.
The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the ::recto
5. The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sibn ranting said Conditional Use Permit be, and the same
is hereby sustained and that Conditional Use Permit
No, 778 be, and the same is herby, granted permitting
the establishment of a restaurant with on -sale beer and wine,
on the property hereinbefore described, subject to the follow-
ing conditions:
1. That the owner of subject property shall deed to the
City of Anaheim a strip of land 53 feet in width, from
the center line of the street, along Euclid Street,
for street widening purposes.
2. That the owner of subject property shall pay to the
City of Anaheim the sum of per front foot along
Euclid Street, for tree planting purposes.
3. That sidewalks and driveways shall be installed along
Euclid Street, as required by the City Engineer and in
accordance with standard plans and specifications on
file in the Office of the City Engineer, prior to
final building inspection.
4. That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of the
Director of Public Works and Superintendent of Streets,
prior to final building inspection.
5. That fire hydrants shall be installed as required and
determined to be necessary by the Chief of the Fire
Department, said fire hydrants to be installed prior
to final building inspection.
6. That the owner of subject property shall pay to the
City of Anaheim the sum of $2.00 per front foot, along
Euclid Street, for street lighting purposes.
7. That Conditions Nos. 1, 2 and 6 above mentioned shall
be complied with within a period of 180 days from date
hereof, or such further time as the City Council may
grant.
The City Council hereby reserves the right to
revoke such Conditional Use Permit for good cause or failure
of said owner, its successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions
herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 14th day of December, 1965.
