A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
OF AN AGREEMENT WITH THE COUNTY OF ORANGE
WITH REFERENCE TO A LIGHTING AND TRAFFIC
SIGNAL SYSTEM AT THE INTERSECTION OF DOWL-
ING AND LA PALMA AVENUES.
WHEREAS, considerable traffic congestion presently
exists and is progressively increasing at the intersection of
Dowling Avenue and La Palma Avenue; and
WHEREAS, a study has been completed and the conclusion
drawn that traffic conditions at said intersection warrant the
installation of a traffic signal and intersection lighting sys-
tem for the proper and orderly movement of traffic; and
WHEREAS, the City of Anaheim and the County of Orange
are willing to cooperate in the installation of the required
traffic signals and intersection lighting systems and-in the
contribution to the maintenance of said systems subsequent to
their installation, and desire to enter into an agreement pro-
viding for the joint installation and maintenance of said traf-
fic signals and intersection lighting systems.
NOW THEREFORE BE IT RESOLVED by the City Council
of the City of Anaheim that an agreement be made and entered
into between the City of Anaheim and the County of Orange, pro
viding for the joint installation of a lighting and traffic
signal system at the intersection of Dowling and La Palma Avenues,
upon the following terms and conditions:
1. CITY SHALL:
A. Prepare the detailed plans, specification and esti-
mates for the project.
B. Approve the plans and specifications as to design
construction features affecting the construction and opera-
tion of that portion of the project within the County.
C. Have jurisdiction of the construction area within
the City and the County.
D. Be designated as the contracting and construction
agent for the parties to do and perform all acts and things
necessary or required in order to construct the project
in accordance with the plans and specifications, including
material control, inspection and construction work, and to
execute and deliver all documents necessary or required in
connection with the construction and completion of said
project, including certificate of day labor, equipment and
material costs and certificate of completion of the project.
E. Upon completion of the project, submit a full, true
and correct copy of documents, certificates and itemized
bills to the County, setting forth the construction and
installation costs and costs of design, survey and construc-
tion engineering.
2. COUNTY SHALL:
A. Approve the plans and specifications as to design

and construction features affecting the construction and
operation of that portion of the project within the
County.
B. Prepare maps and deeds for all necessary additional
rights of way in the County.
C. Acquire the rights of way for its portion of the
project and certify to the City that such acquisition
will be accomplished prior to award of contract.
D. At all times during the progress of the construc-
tion of the project have access to the work for the pur-
pose of inspection thereof and should the County deem any
remedial measures to be necessary, notify City thereof.
E. Reimburse the City and pay to the City the County's
share of all the costs within thirty (30) days after the
submission of the statement of the construction and installa-
tion costs and costs of design, survey and construction
engineering as hereinbefore mentioned.
3. COST. The proportionate share of costs to be borne
by the respective parties shall be based on contract prices,
and the County's share shall be one quarter of the cost of the
project and the City's share of the cost shall be three quarters
of the cost of the project. It is estimated that the total
cost of installation will be approximately Twenty Five Thousand
Dollars ($25,000.00), plus engineering and contingencies. In
addition to its proportionate share of construction and installa-
tion cost, the County shall pay one quarter of the design, survey
and construction engineering costs.
4. ROAD WORK. Any and all road work which is necessary
in connection with the project shall be paid for by the respec-
tive parties on the basis of the actual work done within the
geographical limits of their respective jurisdiction, and such
shall be paid for on the basis of contract prices.
5. MAINTENANCE. After the completion of the project,
the traffic signal and intersection lighting systems shall be
maintained by the City, and the County shall pay to City, upon
submission of said maintenance and energy costs, one quarter
of the total amount.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 7th day of December, 1965.
