A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 762
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
TIERRA DE ORA, a Partnership, 1621 East 17th, Street, Santa Ana, Cali-
fornia, to establish an operation for the excavation, processing,
storage, wholesaling and distribution of sand and gravel, including
an accessory office, a weighing station and a caretaker's residence,
with a waiver of the required landscaping areas abutting streets and
highways, on the following described property, situated in the City
of Anaheim, County of Orange, State of California, to wit:
Parcel 1: Lot 18 in Block 36 of the Yorba Linda Tract, as shown on
a map recorded in book 5, pages 17 and 18 of Miscellaneous Maps,
records of Orange County, California.
Excepting therefrom the East 39.79 feet.
Also excepting the North 15Q feet of the East 189.79 feet thereof.
Parcel 2: The North 379.60 feet of that portion of Lot 19 in
Block 36 of the Yorba Linda Tract, as shown on a map recorded in
book 5, pages 17 and 18 of Miscellaneous Maps, records of Orange
County, California, lying West of the East 764.79 feet of said
Lot 19.
Excepting therefrom the East 25 feet.
Parcel 3: The South 146.54 feet of that portion of Lot 19 in Block
36 of the Yorba Linda Tract, as shown on a map recorded in book 5,
pages 17 and 18 of Miscellaneous Maps, records of Orange County Cal-
ifornia, lying West of the East 764.79 feet of said Lot 19.
Parcel 4: The North 109.41 feet of that portion of Lot 22 in Block
36 of the Yorba Linda Tract, as shown on a map recorded in book 5,
pages 17 and 18 of Miscellaneous Maps, records of Orange County,
California, lying West of the East 764.79 feet of said Lot 22.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on .September 2 1965 notices of which
said public hearing were duly given as required by law'and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code;. and
WHEREAS, said Commission, after due inspection, in-
vestigation studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing, did adopt its Resolution No. 1786- Series_,66

and
WHEREAS, thereafter, within twenty -two (22) days from
the date of the adoption of said resolution, a written appeal
was filed with the City Council protesting the action of the
City Planning Commission in denying said Conditional
Use Permit and said appeal was set for public hearing on
November 2 19 65 at the City Hall, in the City
of Anaheim, and notices of such public hearing were duly given
as required by law and the provisions of Title 18, Chapter
18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hear-
ing, that Conditional Use Permit No. 762 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Com-
mission denying Conditional Use Permit No. 762 be,
and the same is hereby sustained and that the request of
TIERRA DE ORA, a Partnership, for a conditional use permit to
establish an operation for the excavation, processing, storage,
wholesaling and distribution of sand and gravel, including an
accessory office, a weighing station and a caretaker's residence,
with a waiver of the required landscaping areas abutting streets
and highways, on the property hereinbefore described, be, and
the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of December 19 65
